Available in PDF, EPUB and Kindle. Book excerpt: How should political power be divided within and among national peoples? Is the nineteenth-century theory of the sovereign and unitary State still fit for purpose in the twenty-first century? If not, can federalism provide a viable alternative model? This collection looks at federalism from the perspective of constitutional law. Taking the United Kingdom as a case study, Part One tracks the historical evolution of the 'Union' and explores the various expressions of federalism that emerged between the eighteenth and twentieth centuries. Part Two then assesses the experience of sovereignty-sharing with other nations in the context of international cooperation. Drawing on the expertise of the foremost commentators in their field, The United Kingdom and the Federal Idea provides a timely and reflective evaluation of how constitutional authority is being re-ordered within and beyond the United Kingdom.

Available in PDF, EPUB and Kindle. Book excerpt: What happened on 1 July 1867? Over 150 years after Canadian Confederation, it seems like a question with an obvious answer. Questions of Order argues that Confederation was not just a political deal struck by politicians in 1867, but a process of reconfiguring political concepts and the basis of political association. Breaking new ground, Questions of Order argues that Confederation was an imperial event that generated new questions, concerns, and ideas about the future of political order in the British Empire and the world. It traces how for many public writers in English Canada, Confederation became an important basis for reimagining political order in the empire and redefining basic political concepts. To some, it marked a clear step in the larger project of imperial federation or even the ultimate union of the English-speaking world. For others, however, it represented the certain fragmentation of the empire into sovereign "national" states. Set in the context of a time of enormous social and cultural change, when so many long-held assumptions and firmly believed truths were faltering in the wave of new scientific and philosophical beliefs, the creation of Canada forced writers and public thinkers to grapple with the nature of political association and attempt to find new answers to critical questions of order.

In these countries, a series of fascinating developments have been under way for more than a decade, characterized by independent thinking, experimentation, and cross-Commonwealth borrowing of constitutional ideas.

Book excerpt: In 2007 the International Association of Constitutional Law established an Interest Group on 'The Use of Foreign Precedents by Constitutional Judges' to conduct a survey of the use of foreign precedents by Supreme and Constitutional Courts in deciding constitutional cases. Its purpose was to determine - through empirical analysis employing both quantitative and qualitative indicators - the extent to which foreign case law is cited. The survey aimed to test the reliability of studies describing and reporting instances of transjudicial communication between Courts. The research also provides useful insights into the extent to which a progressive constitutional convergence may be taking place between common law and civil law traditions. The present work includes studies by scholars from African, American, Asian, European, Latin American and Oceania countries, representing jurisdictions belonging to both common law and civil law traditions, and countries employing both centralised and decentralised systems of judicial review. The results, published here for the first time, give us the best evidence yet of the existence and limits of a transnational constitutional communication between courts.

Book excerpt: The Canadian Senate in Bicameral Perspective is the first book-length scholarly study of the Senate in over a quarter century and the first such analysis of the upper house as one chamber of a bicameral legislature. David E. Smith's aim is to demonstrate the inter-relationship of the two chambers and the constraint this poses for Senate reform. He analyzes past literature on the Senate and current proposals for reform such as Triple-E Senate drawing detailed comparisons between Canada's upper chamber and the upper chambers of Australia, the United States, Germany, and the United Kingdom. There is a revival of interest and literature abroad in upper chambers and also in bicameralism. Using Parliamentary debates and committee reports, as well as a broad reading of comparative literature, The Canadian Senate in Bicameral Perspective sets the Canadian Senate into this international milieu, contextualizing the debate and arguing for a renewed investigation into its future.
