The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.

The Committee's key findings are: the Government should make time for a regular 'State of Scotland' debate, to include devolved matters; The UK and Scottish governments have given a positive response to the idea of appearing before committees of either Parliament; the idea of a 'Scottish Super Grand Committee' composed of Scottish MPs, MSPs and Scottish MEPs should be revisited; changes should be made to allow UK and Scottish parliamentary committees to work together; positive consideration should be given to whether Scottish ministers can give evidence to UK Parliament committees examining Scotland Act Orders; arrangements should be made to remove any unnecessary barriers to access for MSPs visiting Westminster; a programme of exchanges and secondments with the Scottish Parliament should be funded and encouraged by the House.

Book excerpt: The Barnett Formula is the mechanism used by the United Kingdom Government to allocate more than half of total public expenditure in Scotland, Wales and Northern Ireland. The Formula has been used for the last thirty years to determine the annual increase in allocation (the increment). Each year these increments are added on to the previous year's allocation (the baseline) to create what is now a significant block grant of funds. The Formula accounted for almost £49 billion of public spending in 2007-08. Despite the political changes within the United Kingdom the Formula has continued to be used and has never been reviewed or revised. The Formula was only intended to be a short term measure and should no longer be. A UK Funding Commission should be established to assess relative need in the UK's regions and advise on a new method of distributing funding to reflect those needs. The baseline has never been reviewed to take account of changing population patterns; this means that the grant provides funds without reference to the needs of each of the countries and regions of the UK. There should be a link between the grant of funds made to each of the administrations and their actual per capita funding needs. The Committee's research suggests that England and Scotland have markedly lower overall needs per head of population than Wales and Northern Ireland. The Committee suggest that the UK Funding Commission undertake an assessment of relative need now and in the future and that they undertake periodic reviews as well as publish annual data about the allocation of funding between the devolved administrations.

The 2016 referendum vote to leave the EU marked a turning point in the UK’s political system. In the previous two decades, the country had undergone a series of democratic reforms, during which it seemed to evolve into a more typical European liberal democracy. An independent Scottish state would become responsible for deciding how much to spend on research activity and how to distribute research funding. In order to replace the 2012-13 level of Research Council expenditure in Scotland (£307 million), the government of an independent Scottish state would have to spend 0.23 per cent of 2012 GDP on research or seek additional funding from elsewhere such as overseas, businesses or charities. Businesses and research charities could, however, face additional administrative burdens created by divergences in regulatory regimes and tax jurisdictions, meaning funding projects in both the continuing UK and an independent Scottish state could become more complex. UK national institutions would operate on behalf of the continuing UK as before but would have no power or obligation to act in, or on behalf of, an independent Scottish state. In the event of independence the single strategic and highly integrated research framework would be likely to diverge as an independent Scottish state set and deliver its own research priorities. Research collaborations between the continuing UK and an independent Scottish state would be international collaborations associated with levels of risk not present in domestic collaborations. Research excellence is also supported by the ability of researchers and staff to move freely across the UK and elsewhere, thereby supporting the flow of knowledge

This report considers the Government's proposals for implementing the Smith Commission's recommendations, set out in the Command Paper "Scotland in the United Kingdom: An enduring settlement". The Committee considers the process by which these proposals were produced, and then examines their implications for the constitution of the UK as a whole. The Smith Commission was given only two months to produce its recommendations, and took less than four weeks to produce its proposals once the closing date for public submissions was reached on 31 October 2014. This is not to criticise Lord Smith of Kelvin, nor the members of the Smith Commission, who worked effectively to a tight timetable. Its recommendations are, however, necessarily the result of a short process, with minimal time for consultation and for engagement with the UK and Scottish parliaments. Yet the leaders of the three main UK-wide political parties agreed to implement the recommendations of the Smith Commission in advance of its first meeting. The Committee are deeply concerned that this agreement has pre-empted any possibility of meaningful consultation and discussion on the merits of the proposals with either the Scottish or UK Parliament, or indeed with citizens and civil society both in Scotland and across the UK. In particular, it restricts the capacity of the UK Parliament to contribute to the development of these proposals. Nor does the Smith Commission process meet the standards expected for the production of proposals for significant constitutional change.
