With the influence of EU law, domestic laws regarding consumers have expanded from their origination within the laws of contract and tort, into an independent area of law. This area of law is constantly developing and growing and has, most recently, led up to the proposal of a Consumer Rights Bill, which would cover all types of contracts under which goods are supplied. Although such a Bill would be quite beneficial, its drafting requires a number of obstacles to be overcome. This paper is aimed at outlining both the benefits and problems in drafting such legislation, only after a brief, but concise, summary of the events leading up to the proposal.

Based on an innovative combination of public opinion, protest and media data, it first demonstrates that European integration has become increasingly politicised since the 1990s. Against this background, the Commission is now much more concerned about the public appeal of its policies. That, however, challenges and contradicts the well-worn patterns of supranational regulation in Europe. Rauh systematically compares 17 legislative drafting processes in consumer policy between 1999 and 2009. Based on first-hand insider accounts of involved officials, his analysis indicates that the Commission's policy choices indeed become more consumer friendly under higher levels of public awareness. While this improves the democratic quality of European decision-making, the book also reveals an enhanced conflict potential within the Commission and beyond which threatens to undermine the efficiency of legislative decision-making in the EU.

The making of European consumer law started in the 1970s rather cautiously, but gradually the European Commission took an ever stronger position in promoting not only European consumer law but also in supporting the building of the European Consumer Organisation (BEUC), the umbrella organisation of the national consumer bodies. The book unites the early protagonists who were involved in the making of consumer law in Europe: Guido Alpa, Ludwig Krämer, Ewa Letowska, Hans-W Micklitz, Klaus Tonner, Iain Ramsay, and Thomas Wilhelmsson, supported by the younger generation Aneta Wiewiórowska Domagalska, Mateusz Grochowski, and Koen Docter, who reconstructs the history of BEUC. Niklas Olsen and Thomas Roethe analyse the construction of this policy field from a historical and sociological perspective. This book offers a unique opportunity to understand a legal and political field, that of consumer law and policy, which plays a fundamental role in our contemporary societies.
