Book excerpt: This study is focused on the need to rationalize the existing Mining Act or Republic Act No. 7942 in order to address issues and problems encountered in the implementation process. Mining in the Philippines is a major source of revenues and investments and is encouraged not only as a source of employment but more importantly as resource that needs to be afforded with security for the present generation and, most importantly, for the coming generations. Particularly, while the Philippine business investments programs are at heightened level, the mining industry has to balance the exploration of mining resources with the necessities relating to the environment and the growing challenges of the global resource security. Some problems such as poor acceptability, unclear and unwarranted advocacy and promotion gaps, diverse legal commitments, and inadequate engagements of local governments, among others, contributed to a poor mining implementation management resulting in some local social and economic conflicts that overall result in poor utilization and mobilization of mining resources. The global phenomenon on resource nationalism has affected the Philippines and it made the government much aware of the consequences that might be brought about, thus, the need to strengthen governance of the mining industry and rationalize it in the light of resource security and environmental stability. It is considered view that this research will contribute to the improvement of the policy and legal enabling environment of the mining sector and support the demand and supply configuration in the market with a favorable framework for growth and development in general.

Book excerpt: The archipelago of the Philippines is well endowed with nonferrous mineral resources, and in recent years the Philippine government, acting under the influence of the dominant and seemingly ubiquitous neoliberal development paradigm, has liberalized its mining laws in order to accelerate economic development. Yet the Philippines is also a country highly prone to a variety of natural hazards that have the ability to interact adversely with mining’s potential for environmental degradation. Thus there are great dangers inherent in pursuing such a development paradigm: earthquakes can destabilize tailings storage facilities, typhoons can flood tailings ponds, and mine-pit dewatering can enhance the competition for groundwater resources during droughts. This study explores how these hazards amplify the environmental harm prevalent in mining, and reveals the substantial threat posed to the livelihoods of the archipelago’s poor, as well as the inadequacies of the very institutions designed to protect their environment.

Mine closure planning, well promoted and accepted as good business practice in the global minerals industry, has been primarily technical and precautionary both in approach and focus. Planning, modelling and monitoring strategies incorporate comprehensive and detailed elements such as properties inherent in landforms, climate, geology, flora and fauna, among others. However, locality-based concerns that revolve around resource access and tenure, rights and entitlements tied to locality and indigeneity, labour recruitment, and other non-bio-physical elements are hardly examined. Any mine closure program that omits these elements is deficient and therefore ineffective. Social Terrains of Mine Closure in the Philippines, based on ethnographic research and archival materials, presents the varying experiences of three mines to demonstrate that the mine closure process is an intense locus for competition and compromises among various social actors. This book offers key messages for understanding the complex socio-cultural, economic, political, and business realities that make up the social terrains of mine closure, and will be of great interest to students and researchers in development studies, community development, business studies, anthropology, and sociology. Existing academic and policy literatures generally overlook the phenomenon of ecotourism in areas concurrently affected by extraction industries, but such a scenario is in fact increasingly common in resource-rich developing nations. This edited volume conceptualises and empirically analyses the ‘ecotourism-extraction nexus’ within the context of broader rural and livelihood changes in the places where these activities occur. The volume’s central premise is that these seemingly contradictory activities are empirically and conceptually more alike than often imagined, and that they share common ground in ethnographic lived experiences in rural settings and broader political economic structures of power and control.
