The Global Plan of Action is the outcome of a country-driven process of reporting, analysis and discussion, which also resulted in the preparation of the State of the World's Animal Genetic Resources for Food and Agriculture, the first comprehensive global assessment of livestock diversity and its management. The Conference also adopted the Interlaken Declaration on Animal Genetic Resources, which affirms countries' commitment to the implementation of the global Plan of Action and to ensuring that the world's livestock biodiversity is utilised to promote global food security and remain available to future generations.

Book excerpt: The livestock sector faces a range of challenges, including climate change, emerging diseases, competition for natural resources and evolving demand for animal-source foods, which is increasing globally, especially in developing countries. Genetic diversity of livestock is a key resource for allowing livestock keepers to address these challenges, but this diversity has been in a state of decline. The diminishing genetic diversity thus represents yet another obstacle for sustainable livestock production. Cryoconservation (i.e. ex situ – in vitro conservation) of genetic resources through gene banking provides one of the most powerful tools governments and other stakeholders have to manage genetic diversity in both the short and long term and thereby provide future generations with the tools to meet the challenges ahead. Gene banking genetic resources fits within the context of the Global Plan of Action for Animal Genetic Resources, which was developed and adopted by FAO Member Nations. Specifically, Strategic Priority 9 of the Global Plan of Action is “Establish or strengthen ex situ conservation programmes” and Strategic Priority 11 urges countries to “Develop approaches and technical standards for conservation. To assist countries in the implementation the Global Plan of Action, FAO worked with experts from around the world to prepare technical guidelines. In 2012 FAO published FAO Guidelines on Cryoconservation of animal genetic resources.Gene banking is a long-term effort that needs to be viewed in terms of decades rather than years, as demonstrated by similar systems for agricultural crops. The responsibility for establishing such resources lies squarely within governments’ roles of providing public goods and food security. Gene banking of animal genetic resources is a technology-intense undertaking and the associated technologies are in a continual state of research and development. The livestock sector also continues to evolve rapidly. Since the development and release of the previous guidelines, numerous changes have taken place. Critical among these is a greater appreciation of the opportunities for actively utilizing cryopreserved material to enhance management of in vivo populations, rather than as simply an “insurance policy” to protect breeds against extinction.This key development has led to further changes in gene bank management. First, interaction with users of the stored material has increased. This in turn has created a need to involve stakeholders more closely in the management of genetic collections and to better monitor and document the processes of gene banking to ensure quality management.

The livestock sector has been an active participant in the so-called “genomic revolution.” Advancements in the sequencing of genomes and related genotyping methods have created opportunities for gathering much more information on the molecular level than ever possible, at a faster rate, and for exponentially decreased costs. Scientists and other livestock stakeholders in countries with highly developed economies have been among the main beneficiaries of this revolution. However, the greatly decreased costs of genomic applications have also created opportunities in countries with developing and transitional economies. In many instances, the lack of awareness of these opportunities and in the technical capacity for the full application of genomic tools may represent a greater obstacle to their utilization than the expenses involved.The development of these guidelines and the subsequent application of the information contained herein may help to bridge this gap, bringing new opportunities to light and transferring knowledge that can be used to increase the genetic characterization of AnGR and subsequently improve the sustainable use and conservation of livestock genetic diversity.

The book consists of 11 chapters. Chapter 1 locates intellectual property rights within the armoury of food security policies. Chapter 2 deals with definitional issues and examines the role of intellectual property rights in incentivizing agricultural research and development. Chapter 3 examines the international landscape of intellectual property and the approaches taken to the relationship between intellectual property rights, agricultural biotechnology, access to biological resources, food security and globalization which are taken by the WTO, FAO, CBD and WIPO among the various international and development agencies. Plant variety rights (PVRs) are a specially created form of intellectual property right originally minted to encourage agricultural innovation and Chapter 4 examines the effectiveness of PVRs in a food security context. Agricultural innovation is in part dependent upon access of researchers to the genetic resources of the biodiverse countries of the South. Chapter 5 considers the attempts to construct an international regime to secure this access. The important role of traditional farmers in preserving landraces and cultivars from which improvements can be derived has generated for a call for the recognition of farmers' rights, and this is examined in Chapter 6 together with agitation for the protection of the traditional knowledge which often informs access to the useful genetic resources. Chapter 7 examines the intellectual property implications of the use of genetically modified (GM) crops as a technological solution to food insecurity. The protection of GM crops is achieved through patent protection and Chapter 9 looks at the competition law implications of patent licensing, patent pools and patent thickets. An old intellectual property device that underpinned the commercial development of European agricultural marketing is the geographical indication, and Chapter 8 examines the contribution it might make to achieving food security. Returning to the theme of the role of intellectual property law in incentivizing innovation, Chapter 10 examines its role in promoting agricultural research. The concluding chapter proposes a number of recommendations for action in deploying intellectual property law in the struggle for food security.

The latter, grossly called biodiversity issues relating to the application of intellectual property, has been the subject of a wealth of literature. Yet, the situation of animal genetic resources specifically has only marginally been addressed so far. Many books and articles address ‘biotechnology and agriculture’, but have only plants and seeds in mind. Case-law and specific regulation is equally scarce. Exacerbated by the so-called ‘erosion of animal genetic resources’, climate change, the globalization of the market-place, and a strong concentration of markets, animal genetic resources however demand specific analysis and adjustments in intellectual property law. The decoupling of rights over animal genetic resources as an abstract concept, from those over the concrete animals is a fact today. The application of patents in this context became a full-fledged part of the management of animal genetic resources. This monograph analyzes against this background the impact of the patent system on ownership traditions in agriculture, on animal welfare, and on biodiversity. It looks at how those factors in turn are likely to affect the shape of patent law, and how they should affect it. The author hereby focuses on important specific issues arising, including the following: the underlying elements deciding on the shape of regulation – innovation, economic development, agriculture, human rights, animal welfare, the conservation of resources, and equal trading conditions; the continuing applicability of trademarks, geographical indications, copyright, and trade secrets; patentability rules and exclusions; the extension of patent rights over progeny; the meaning of ‘essentially biotechnological processes’; the legal definitions of ‘morality’ and ‘ordre public’ in the context of animal welfare; and the future of international patent law in the context of global governance theories. With detailed investigation of how three major jurisdictions – the European Union, the United States, and Canada – have regulated the matter, the book highlights unresolved issues in the laws dealing with animal genetic resources. Book excerpt: The history of livestock started with the domestication of their wild ancestors: a restricted number of species allowed to be tamed and entered a symbiotic relationship with humans. In exchange for food, shelter and protection, they provided us with meat, eggs, hides, wool and draught power, thus contributing considerably to our economic and cultural development. Depending on the species, domestication took place in different areas and periods. After domestication, livestock spread over all inhabited regions of the earth, accompanying human migrations and becoming also trade objects. This required an adaptation to different climates and varying styles of husbandry and resulted in an enormous phenotypic diversity. Approximately 200 years ago, the situation started to change with the rise of the concept of breed. Animals were selected for the same visible characteristics, and crossing with different phenotypes was reduced. This resulted in the formation of different breeds, mostly genetically isolated from other populations. A few decades ago, selection pressure was increased again with intensive production focusing on a limited range of types and a subsequent loss of genetic diversity. For short-term economic reasons, farmers have abandoned traditional breeds. As a consequence, during the 20th century, at least 28% of farm animal breeds became extinct, rare or endangered. The situation is alarming in developing countries, where native breeds adapted to local environments and diseases are being replaced by industrial breeds. In the most marginal areas, farm animals are considered to be essential for viable land use and, in the developing world, a major pathway out of poverty. Historic documentation from the period before the breed formation is scarce. Thus, reconstruction of the history of livestock populations depends on archaeological, archeo-zoological and DNA analysis of extant populations. Scientific research into genetic diversity takes advantage of the rapid advances in molecular genetics. Studies of mitochondrial DNA, microsatellite DNA profiling and Y-chromosomes have revealed details on the process of domestication, on the diversity retained by breeds and on relationships between breeds. However, we only see a small part of the genetic information and the advent of new technologies is most timely in order to answer many essential questions. High-throughput single-nucleotide polymorphism genotyping is about to be available for all major farm animal species. The recent development of sequencing techniques calls for new methods of data management and analysis and for new ideas for the extraction of information. To make sense of this information in practical conditions, integration of geo-environmental and socio-economic data are key elements. The study and management of farm animal genomic resources (FAnGR) is indeed a major multidisciplinary issue. The goal of the present Research Topic was to collect contributions of high scientific quality relevant to biodiversity management, and applying new methods to either new genomic and bioinformatics approaches for characterization of FAnGR, to the development of FAnGR conservation methods applied ex-situ and in-situ, to socio-economic aspects of FAnGR conservation, to transfer of lessons between wildlife and livestock biodiversity conservation, and to the contribution of FAnGR to a transition in agriculture (FAnGR and agro-ecology).

The result is a globalising world in which the need for an alternative has become a core part of its political and legal instability, and the authors identify a number of possible alternative platforms to understand life and the living as framed by the 'metacodes' of life. The Elements to Facilitate Domestic Implementation of Access and Benefit-Sharing for Different Subsectors of Genetic Resources for Food and Agriculture aim to assist governments considering developing, adapting or implementing access and benefit-sharing measures, to take into account the importance of genetic resources for food and agriculture (GRFA), their special role for food security and the distinctive features of their different subsectors, while complying, as applicable, with international instruments.This publication contains the original ABS Elements as well as the explanatory notes describing, within the context of the ABS Elements, the distinctive features and specific practices of the different subsectors of GRFA. The explanatory notes were welcomed by the Commission and the FAO Conference in 2019.
