Constituted by the competition authorities of the BRICS countries, in collaboration with universities and research centres, the Working Group's overarching report aims to first provide an overview of key developments in various segments of global food value chains in the BRICS countries and to then focus in more detail on the impact of the recent consolidation in plant protection and seeds segments of value chains.This working paper contributes to the overarching report by providing an overview of developments and competition concerns in the following food and food-related segments in South Africa: 1) Seeds; 2) Fertilizers; 3) Animal feed and poultry; 4) Maize and wheat milling; 5) Dairy; and 6) Retail. These value chains were selected because of their importance as critical inputs into food production and given their significance as part of a typical food basket for consumers in southern Africa. These food products are increasingly retailed through supermarkets in the region. The selected value chains are also important because they have the potential to promote value addition and industrialisation in the region.We employ a framework that allows for the evaluation of competition and regulatory dynamics in agro-processing value chains using a regional value chain (RVC) approach, alongside the global value chain (GVC) approach which has been employed for a range of products including agricultural commodities and cash crops.

In practice, however, a misunderstanding of its fundamental nature can easily result in value-chain projects having limited or non-sustainable impact. Furthermore, development practitioners around the world are learning valuable lessons from both failures and successes, but many of these are not well disseminated. This new set of handbooks aims to address these gaps by providing practical guidance on SFVCD to a target audience of policy-makers, project designers and field practitioners. This first handbook provides a solid conceptual foundation on which to build the subsequent handbooks. It (1) clearly defines the concept of a sustainable food value chain; (2) presents and discusses a development paradigm that integrates the multidimensional concepts of sustainability and value added; (3) presents, discusses and illustrates ten principles that underlie SFVCD; and (4) discusses the potential and limitations of using the value-chain concept in food-systems development. Book excerpt: Modern global food supply chains are characterized by extreme levels of concentration in the middle of those chains. This paper argues that such concentration leads to excessive buyer power, which harms the consumers and food producers at the ends of the supply chains. This paper argues that the harms suffered by farmers are serious enough as to constitute violations of the international human right to food as it is expressed in the Universal Declaration of Human Rights and the International Covenant on Economic, Social and Political Rights, and further argues that world competition law regimes cannot ignore these human rights imperatives. To a certain extent, these right to food imperatives can be accommodated under existing consumerist competition law theories by the interpretive mechanism of conform-interpretation. However, when one bears in mind the truly global scale of modern food supply chains, it becomes obvious that conform-interpretation of competition law with human rights norms will not suffice. Instead, it must be acknowledged that the protection of a minimum level of producer welfare congruent to those producers' right to a minimum adequate level of food must find a place among the aims of any credible theory of competition law. Moreover, current doctrines of extraterritorial jurisdiction of competition control must also be revised.

This shift enabled an unprecedented economic convergence: poor countries grew rapidly and began to catch up with richer countries. Since the 2008 global financial crisis, however, the growth of trade has been sluggish and the expansion of GVCs has stalled. Meanwhile, serious threats have emerged to the model of trade-led growth. New technologies could draw production closer to the consumer and reduce the demand for labor. And trade conflicts among large countries could lead to a retrenchment or a segmentation of GVCs. World Development Report 2020: Trading for Development in the Age of Global Value Chains examines whether there is still a path to development through GVCs and trade. It concludes that technological change is, at this stage, more a boon than a curse. GVCs can continue to boost growth, create better jobs, and reduce poverty provided that developing countries implement deeper reforms to promote GVC participation; industrial countries pursue open, predictable policies; and all countries revive multilateral cooperation.

Book excerpt: Global value chains are currently experiencing a 'perfect storm' triggered by the coincidence of various random events, including the COVID-19 pandemic, the temporary blocking of the Suez Canal by the stranded giant container ship 'Ever Given', the congestion of major ports, and the outbreak of the war in Ukraine. All these events have laid bare the degree to which our economies rely on integrated and often vulnerable supply chains that form the neural system of our globalised market economies. Empty supermarket shelves, steep increases in energy prices and the bleak prospect of a global food crisis have led to a widespread awareness of the interdependence and fragility of tightly-knit networks of integrated just-in-time value chains. Against this backcloth, there are mounting calls for a general rethinking of how various economic policies and regulations could foster the resilience of integrated supply chains against exogenous shocks. This paper follows this invitation by exploring whether and how competition law - i.e., the prohibition of anti-competitive agreements, the abuse of monopoly power and anticompetitive mergers - could contribute to greater supply chain resilience. It thereby makes three contributions. First, the paper seeks to clarify the notion of value chain resilience and its relationship with competition. It thus addresses the fundamental question of whether competition is conducive or detrimental to supply chain resilience. Second, the paper maps four avenues through which competition policy can promote the shoring up of international supply chains. Third, the paper identifies a number of filters to incorporate concerns about supply chain resilience into competition law analysis. The paper thus lays down the conceptual foundations and pathways for a nascent research agenda on competition (law) and resilience.

This book examines an array of different issues and distortions that are causing food supply chain dysfunction in many countries, particularly for staple non-perishable foods such as grains, oilseeds, pulses and sugar. It outlines the underlying changes that are currently occurring, which will have an influence on the direction of future food supply chains, and provides some solutions to current food security problems. Based on an analysis of total regulation in the 1950s-60s through to deregulation during the 1980-90s, as well as post-deregulation, it focuses on liberal trade and deregulation as a more successful solution to creating efficiencies in food supply chains and distribution. The author highlights a common thread of either farmers using government for vested-interest intervention, or autocratic governments seeking market and supply-chain power. The book examines the role of government after 70 years of food supply chain intervention. It discusses the role of commercial ‘trade’ markets and cluster industries and how these can quickly disintegrate when price distortions occur. The author studies both food importing and exporting countries and concludes that comingled commoditization of food has led to increased hoarding, corruption, and dependence on food aid. He argues that a competitive food supply chain that has minimum intervention is more likely to provide future food security. In conclusion the book emphasizes that adequate rewards, competition, and striving for supply chain efficiencies are the essences of sustainable food security.
