Book excerpt: The Joint Review Panel (the Panel) was established by the Alberta Natural Resources Conservation Board (NRCB), the Alberta Utilities Commission (AUC) and the federal government of Canada to conduct a review of the Dunvegan hydroelectric project on the Peace River proposed by Glacier Power Ltd. The project, proposed by Glacier Power, was to construct and operate a 100-megawatt low head, run-of-river hydroelectric project on the Peace River near Dunvegan, Alberta. This report is the result of an assessment of the environmental and socio-economic effects of the project by the Panel. The aspects of the project which were considered include: project need, purpose, viability and benefits; potential alternatives; effects on the Peace river fishery; ice formation and break-up; geotechnical issues (slope stability, sedimentation and channel morphology, seismicity); navigable waters; First Nations and Metis concerns; vegetation and forest resources; wildlife; health and safety; heritage and visual resources; and decommissioning.

It also submitted an application to the Natural Resources Conservation Board to construction & operate a water management project. This document presents the views of Glacier, the Boards, and various intervenors at a hearing held jointly by the two Boards to consider the two applications. Issues discussed include the project need, viability, & benefits; effects of the project on the ice regime of the Peace River (including impacts on flooding & wildlife movements); effects on the Peace River fishery, fish populations, & fish habitat; other project effects (on the Peace-Athabasca Delta, transportation, & downstream communities); and the adequacy of the public consultation process. The final section contains the conclusions of the Boards regarding the socio-economic & environmental impacts of the project and the decision about the applications.

Kirk Lambrecht surveys the law of actual and asserted Aboriginal rights and historical and modern Treaty rights in Canada and discusses the national and international purposes of environmental assessment and regulatory review. He appraises the fundamental principles of Supreme Court of Canada jurisprudence defining aboriginal consultation and accommodation as a constitutional imperative and uses case studies involving the National Energy Board to demonstrate how integrated process has evolved over time. Finally he offers general conclusions on the practical utility, and outstanding challenges, involving an integrated planning paradigm.
