The Paris Agreement has a binding commitment of holding the global temperature increase to 2°C while pursuing efforts to limit it to 1.5°C. To cope with the negative effects of climate changes and mitigate greenhouse gas emissions, one of the primary responses has been the deployment of renewable energy sources, transiting from fossil fuels to sustainable electricity production. However, renewable energy sources can also cause significant environmental impacts. Wind energy, for instance, can impact biodiversity, such as birds and bats, killing them when colliding with turbines and affecting their migration and nesting. This results in conflicts in environmental law. This book questions whether, in the energy transition, the generation of electricity from renewable sources to protect the climate is compatible with the protection of the environment, both interests in environmental law. To address this question, this book follows a legal-environmental perspective and assesses the common problem of solving those internal environmental conflicts in Brazilian and German law to understand and compare whether and how both legal systems solve the conflicts by compatibilizing the protection of the climate with other environmental interests. The legal analysis focuses on land-use planning and environmental licensing, assessing similarities and differences, and evaluating the results, identifying what one country can learn from the other.

Book excerpt: In recent decades there has been an exponential increase in large hydroelectric plants in Brazil, especially in the Amazon region. These large hydraulic structures impact the environment and the lives of people living in the places where they settle and require a special type of water governance. The dictatorial regime (1964-1985) created a "standard" for the construction of these great structures, through an institutional and legal framework, which benefited the Brazilian business elite but also, through the creation of a popular imagination, which shows itself lasting progress on the country's progress and development. The suspension of security, the fragility of institutional environmental structures, the disrespect for indigenous reserves, the lack of clarity about the concept of "affected population" and the non-payment of fair compensation were identified as one of the main challenges for a democratic water governance in the country. In the late 1970s, the Dam-Affected Movement (MAB) began its organization and is also studied in this research. The study is an important and insightful academic contribution to the understanding of the main bottlenecks of effective water governance in Brazil.

Unlike other forest commodities, forest carbon offsets do not involve resource extraction; instead, they require keeping carbon in place through forest protection. Maron E. Greenleaf explores forest carbon offsets to understand green capitalism—the use of capitalist logics and practices to mitigate environmental damage. She traces cultural, environmental, governmental, material, and multispecies relations involved in making forest carbon valuable as well as how forest carbon’s commodification in the Amazon turned it into a source of redistributable public environmental wealth. At the same time, Greenleaf shows how making forest carbon monetarily valuable created an unexpected set of uneven, contingent, and contested social and political relations. While forest carbon in the Amazon demonstrates that green capitalism can be socially inclusive, it also shows that green capitalism can reinforce the marginalization it purportedly seeks to combat. By outlining these complex relations and tensions, Greenleaf elucidates broader efforts to create a capitalism suited to the Anthropocene and those efforts’ alluring promises and vexing failures.
