Book excerpt: El presente libro forma parte de una colección total que pretende recoger, de modo completo, coherente y armonizado, el conjunto de novedades introducidas por la nueva normativa en materia de protección de datos, emanada, a nivel europeo, del Reglamento general de protección de datos (RGPD) y, a nivel interno, complementando y desarrollando aquel, por la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD). Más específicamente, en estas páginas se diseccionan, de forma ciertamente pormenorizada, los derechos que corresponden al interesado en cuanto titular de los datos personales objeto de tratamiento por parte de terceros (fundamentalmente, responsables del tratamiento y encargados del tratamiento). Y se hace atendiendo a una triple clasificación: En primer lugar, se analiza el nuevo enfoque proporcionado a los derechos que ya se venían atribuyendo al interesado, como son los tradicionales derechos ARCO: derechos de acceso, de rectificación, de cancelación (ahora conocido como derecho de supresión, cuya manifestación más singular se encuentra en el derecho al olvido) y de oposición. En segundo lugar, se diseccionan aquellos otros derechos que, en el afán de la nueva normativa por reforzar la posición del afectado, se incluyen por primera vez, atendiendo a la rápida evolución de la tecnología y a la necesidad de adaptarse a ella. Son los derechos a la limitación del tratamiento, a la portabilidad de los datos y a no ser objeto de decisiones individuales automatizadas, incluida la elaboración de perfiles. Este análisis se ve acompañado por el estudio de las singularidades propias de las Administraciones Públicas. Por último, se procede a investigar el verdadero alcance de los conocidos como “derechos digitales”, recientemente incorporados por la normativa nacional en materia de protección de datos (LOPDGDD) que complementa y desarrolla los postulados del RGPD. Se trata, en muchos casos, de principios, pero, en todos ellos, de directrices de necesario estudio y reflexión.
