Book excerpt: This book looks at regulation, policy and implementation of framework agreements, supplier lists and other similar public procurement tools, with a strategic and pragmatic perspective. Whilst procurements of huge volumes and value are performed worldwide through such tools on a daily basis, and despite their complexity and diversity, this topic has rarely been studied in a systematic way. The book fills this major gap. It examines a series of public procurement systems or legal instruments selected to ensure wide coverage – the UNCITRAL Model Law on Public Procurement, the World Bank, the US federal procurement system, EU law, France, Romania, and the UK pre- and post-Brexit. By deconstructing over 20 'clusters' of tools into their key features along a pattern for analysis, the book reconstructs a conceptual framework for purchasing uncertain or indefinite requirements through a transversal perspective across public procurement systems. In this way, the book provides valuable orientation to law and policy makers for improving or reforming this area, to procurement officers in interpreting existing regulation and identifying innovative practical solutions, and to lawyers and the judiciary for a balanced application of the regulation. The book delivers essential material for procurement of uncertain or indefinite requirements.

It is used by the multilateral development banks as a tool for procurement reform and as part of the country systems approach to procurement. The Model Law contains procedures to implement its objectives, whether procurement is conducted electronically or on paper; and reflects the professionalization of the procurement function (which has characterized recent developments in procurement).

Available in PDF, EPUB and Kindle. Book excerpt: Political corruption has traditionally been presented as a phenomenon characteristic of developing countries, authoritarian regimes, or societies in which the value system favored tacit patrimony and clientelism. Recently, however, the thesis of an inverse correlation between corruption and economic and political development (and therefore democratic "maturity") has been frequently and convincingly challenged. Countries with a long democratic tradition, such as the United States, Belgium, Britain, and Italy, have all experienced a combination of headline-grabbing scandals and smaller-scale cases of misappropriation. In "Corrupt Exchanges," primary research on Italian cases (judicial proceedings, in-depth interviews, parliamentary documents, and press databases), combined with a cross-national comparison based on a secondary analysis of corruption in democratic systems, is used to develop a model to analyze corruption as a network of illegal exchanges. The authors explore in great detail the structure of that network, by examining both the characteristics of the actors who directly engage in the corruption and the resources they exchange. These processes of degeneration have caused a crisis in the dominant paradigm in both academic and political considerations of corruption. The book is organized around the analysis of the resources that are exchanged and of the different actors who take part. Politicians in business, illegal brokers, Mafia members, protected entrepreneurs, and party-appointed bureaucrats exchange resources on the illegal market, altering the institutional system of interactions between the state and the market. In this complex web of exchanges, bonds of trust are established that allow the corrupt exchange to thrive. The book will serve both as a theoretical approach to a political problem of large bearing on democratic institutions and a descriptive warning of a system in peril.

Available in PDF, EPUB and Kindle. Book excerpt: The approach used on a given spend item should largely depend on the balance between supply power and demand power. That is the logic behind the bestselling Purchasing Chessboard®, used by hundreds of corporations worldwide to reduce costs and increase value with suppliers. The 64 squares in the Purchasing Chessboard provide a rich reservoir of methods that can be applied either individually or combined. And because many of these methods are not customarily used by procurement, the Purchasing Chessboard is also the perfect tool for helping buyers to think and act outside the box and find new solutions. A well-proven concept that works across all industries and all categories in any given situation, it is little wonder that business leaders and procurement professionals alike are excited by, and enjoy strategizing around, the Purchasing Chessboard. This second edition of The Purchasing Chessboard addresses the new realities of a highly volatile economic environment and describes the many—sometimes surprising—ways in which the Purchasing Chessboard is being used in today's business world. Yet despite all of the great achievements of procurement executives and their teams, they do not always receive the recognition they deserve. In response, the authors have developed and outlined within the book an unequivocal approach to measure procurement’s impact on a company’s performance—Return on Supply Management Assets (ROSMA®).

It explains how joint-bids could be considered as agreements aimed at distorting competition, the practice commonly referred to as bid rigging. The book demonstrates how the conclusion of joint-bid agreements could constitute grounds for exclusion from public procurement proceedings under Article 57(4)(d) of Directive 2014/24/EU.

Book excerpt: This insightful book provides readers with a practical and theoretical explanation of the ways in which the new, tailor-made Innovation Partnership Procedure can be used throughout all Member States in the European Union. With a focus on the Procurement Directive for the public sector (Directive 2014/24/EU), Pedro Cerqueira Gomes argues that innovation is a crucial policy of the EU that must be extended to public procurement – implying interesting harmonisation challenges, mostly regarding the use of the Innovation Partnership Procedure and the national administrative law traditions of the Member States.
