The author catalogs the Supreme Courtand’s involvement in shaping patent law, from its first cases to the most recent cases, shedding important light on the evolving course of this rapidly-changing practice area. By stressing trends and explaining dicta for what it may portend, Kiklis provides an invaluable chart for navigating shifting seas.andquot; and– Paul Michel, former Chief Judge, United States Court of Appeals for the Federal Circuit and“In this one volume, Michael Kiklis has filled in a critical gap in our understanding of modern American patent law. Book excerpt: The Patent Law Digest began in 1991 and appeared annually as a single volume in paper-bound form until 2008. In 2008, a three-volume hardbound edition appeared as the 25th Federal Circuit Anniversary Edition. The 2009 edition resumed the pattern of an annual paper-bound edition. The Patent Law Digest functions in part to supplement with recent cases the 25th Anniversary Edition and to supplement the Federal Circuit Guide and Supreme Court Guide, which appear as volumes at the end of the treatise, Chisum on Patents. In addition, there are (1) cross-references to the pertinent section of Chisum on Patents, and (2) the text of the statute pertinent to that topic. Thus, for example, in Section 2300 on the "Best Mode" requirement, there is a quotation of 35 U.S.C. Section 112 (first paragraph) and an entry: "Treatise Cross Reference: Chisum on Patents § 7.05." This alerts the user in search of further case law and background on the "best mode" requirement to consult Section 2300 in the Federal Circuit Guide (or in the 25th Anniversary Edition) and to consult Section 7.05 of the Treatise. In this instance, there is a notation to an important change in the best mode requirement by the America Invents Act.

Although the book focuses on the Federal Circuit, other appellate courts are also covered (with particular focus on the Ninth Circuit and Second Circuit). The structure of this book follows the organizational requirements for an appellate brief with an emphasis on informal expectations and special challenges presented by a patent appeal. Each chapter contains general advice on how to prepare the section, a sample or two (principally from briefs filed by the author), and comments on the section designed to reinforce the general advice. Similar chapters address issues distinctive to the answering and reply briefs. The balance of the book addresses post-briefing issues, including effective oral argument presentation; petitions for panel rehearing and rehearing en banc; a chapter on cert. petitions; and the pros and cons of hiring appellate co-counsel. Throughout, the focus is on applying general appellate advice to the unique context of patent appeals.
