Book excerpt: This book assesses the everyday use of petitions in administrative and judicial settings and contrasts these with more assertive forms of political petitioning addressed to assemblies or rulers. A petition used to be a humble means of asking a favour, but in the early modern period, petitioning became more assertive and participative. This book shows how this contrasted to ordinary petitioning, often to the consternation of authorities. By evaluating petitioning practices in Scotland, England and Denmark, the book traces the boundaries between ordinary and adversarial petitioning and shows how non-elites could become involved in politics through petitioning. Also observed are the responses of authorities to participative petitions, including the suppression or forgetting of unwelcome petitions and consequent struggles to establish petitioning as a right rather than a privilege. Together the chapters in this book indicate the significance of collective petitioning in articulating early modern public opinion and shaping contemporary ideas about opinion at large. The chapters in this book were originally published in the journal Parliaments, Estates & Representation.

The gathering duly receives a paragraph or so in surveys of that dispute, and it usually is included—and properly so—in lists of the important sources for twelfth- and thirteenth-century canon law. But the meeting has been accorded no integrated study of all its political and legislative facets, nor have all of the sources, even all of those available in print, ever been utilized together. That means uncovering the conciliar events as well as pondering their relation to the great issues of the time, especially Alexander’s struggle with Frederick. The changes of the intervening years – most of them gradual and imperceptible – were barely visible but their cumulative impact was profound. Charles I inherited a social revolution; he found a society already transformed and a power structure still in the process of transformation. Scotland was inherently unstable, and the unending conflict between king, baron and churchman was therefore accentuated. The failure of the Canterburian solution left magnate to struggle with minister for control of the Church and thus for the substance of power in Scotland. The struggle was often obscured by war: the feudal magnates, bold in defence of the ancient liberties of the kingdom, patched up an uneasy alliance with the radical ministers pursuing a new order. The end of the First Civil War was merely the prelude to a new conflict, which left the Kirk triumphant for the time being and the state, albeit temporarily, its impotent servant. This poses vital questions. Who were the ministers and elders who ruled the Church of Scotland? What was the nature of the Scottish Revolution? This book draws on many sources to answer these questions.
