Book Synopsis The Macbride Principles by : Kevin McNamara
Download or read book The Macbride Principles written by Kevin McNamara and published by Liverpool University Press. This book was released on 2009-01-01 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Published in November 1984, the MacBride Principles were nine proposals aimed at eliminating religious discrimination in the employment practices of United States corporations with subsidiaries in Northern Ireland. The federal constitution of the United States allowed states and cities to pass their own corporate legislation incorporating the MacBride Principles and to use their pension fund investments to pressurise corporations into adopting the Principles. Using devolved legislation, the MacBride Campaign broke the stranglehold on the discussion of Irish issues maintained by the US, UK and Irish governments in the Congress. Instead, these issues were debated in state legislatures and city councils, and Irish America was given an opportunity to participate in a non-violent campaign to further social justice in Northern Ireland." "Using interviews with key personalities involved and hitherto unpublished and inaccessible archives of the Department of Foreign Affairs, Dublin, as well as papers obtained using the Freedom of Information Acts of the United States and the United Kingdom, Kevin McNamara maps out the evolution and eventual success of the MacBride Campaign." --Book Jacket.

This book was released on 2018-08-30 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1856, the US Supreme Court denied Dred Scott, now free of slavery, his Constitutional rights, solely because he was black. According to the Court, when the Constitution was drafted, some 60 years earlier, its authors would not have intended that ‘a subordinate and inferior class of beings’ qualified as citizens of the United States. Thus, the meaning of language drafted over half a century before was frozen in time. This case, perhaps more than any other, demonstrates that the matter of statutory interpretation is critical, technical, and, sometimes, highly emotive. The case is not a mere nugget from history to indulge our disgust with values of another age, and with it a satisfaction of our progress to today’s higher moral ground. It is the unfortunate case that the senior courts of England continue to produce highly contentious interpretations of our equality and discrimination laws. This book examines these cases from the perspective of statutory interpretation, the judge’s primary function. The scrutiny finds the judgments technically flawed, overcomplicated, excessively long, and often unduly restrictive. As such, this book explains how the cases should have been resolved – using conventional methods of interpretation; this would have produced simpler, technically sound judgments. Rather like the case of Dred Scott, these were easy cases producing bad law.

Book Synopsis Inequality in Northern Ireland by : David John Smith
Download or read book Inequality in Northern Ireland written by David John Smith and published by . This book was released on 1991 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: A common view among members of the ruling group in Belfast and London is that, after the reforms of the 1970s, the public services and the main social and economic institutions in Nothern Ireland are as fair as they can be in a divided society; and that any remaining inequality between Protestants and Catholics is a reflection of historic discrimination which has now been put right. In this benchmark study, David Smith and Gerald Chambers assemble a wide range of statistical material that emphatically contradicts this view of Northern Ireland's fair and equitable society. Examing the extent of inequality between Protestants and Catholics in all areas of daily life, the authors show how far inequalities can be explained by factors other than discrimination. They also show how people perceive inequality and discrimination and how important they think these issues are. This penetrating study will be of interest to teachers and students of politics, sociology, law, social policy, as well as journalists and political commentators.
