Book excerpt: Fernando examines important aspects of the drafting of 1957 Federation of Malaya constitution related to the system of governance, division of legislative and executive powers, the conceptualisation of citizenship and the roles of the judiciary and election commission. The book sheds new light on the balances that the Reid Commission sought to embed in the constitution and the historical constitutional debates and discussions which greatly shaped the framing of the new federal constitution between 1956 and 1957. Drawing on historical evidence mainly from declassified primary constitutional documents, it analyses the submissions, debates and discussions among the framers and various interest groups during the drafting of the constitution between 1956 and 1957 to discern more clearly the intentions of the framers on many aspects of governance and distribution of powers embedded in the constitutional provisions. This book reveals more deeply the nature and complexity of the constitutional issues faced by the framers and how they attempted to reach compromises between the various interest groups in Malaya. It is a valuable resource for scholars and academics of Malaysian, Asian and Commonwealth constitutional history as well as those interested in history, law, political science and important aspects of governance and distribution of powers in the system of parliamentary democracy.

Available in PDF, EPUB and Kindle. Book excerpt: Malaysia came into existence on 9/16/63 as a federation of Malaya, Singapore, Sabah (North Borneo), and Sarawak; in 1965 Singapore withdrew from the federation. Offers an in-depth and detailed analysis of the political processes that led to formation of the Federation of Malaysia in 1963. It argues that the Malaysia that came into being following the amalgamation of Malaya, Singapore, Sarawak and North Borneo was a political creation whose only rationale was that it served a convergence of political and economic expediency for the departing colonial power, the Malayan leadership and the ruling party of self-governing Singapore. 'Greater Malaysia' was thus an artificial political entity, the outcome of a concatenation of interests and motives of a number of political actors in London and Southeast Asia from the 1950s to the early 1960s. This led to a number of unresolved compromises between Singapore and Kuala Lumpur and did not obviate the possibility of future difficulties, and the seeds of dissension sown by the disagreements between the two governments were to sprout into major crises during Singapore's brief history in the Federation of Malaysia.

Book excerpt: Brunei, officially the State of Brunei Darussalam, is an oil-rich sovereign state in Southeast Asia, with 5th highest GDP per capita in the world. Formerly a British protectorate, in 1963 Brunei defied expectations and declined to join the federation of states which became Malaysia – a pivotal turning point in Brunei's history which set the course for its future development. In this book, Isa Bin Ibrahim – a key player in the Sultan of Brunei's delegation - provides an insider's account of the 1963 negotiations and deliberations. He sheds new light on Sultan Omar Ali Saifuddien III's relations with Tunku Abdul Rahman and explains why the British were so keen for Brunei to become part of the proposed federation, intending to create a counter-balance for Chinese power in the region. Through the author's unique eyewitness perspective, the true story behind Brunei's determination to retain its territorial integrity as a sovereign state is revealed for the first time.

Available in PDF, EPUB and Kindle. Book excerpt: Most Muslim-majority countries have legal systems that enshrine both Islam and liberal rights. While not necessarily at odds, these dual commitments nonetheless provide legal and symbolic resources for activists to advance contending visions for their states and societies. Using the case study of Malaysia, Constituting Religion examines how these legal arrangements enable litigation and feed the construction of a 'rights-versus-rites binary' in law, politics, and the popular imagination. By drawing on extensive primary source material and tracing controversial cases from the court of law to the court of public opinion, this study theorizes the 'judicialization of religion' and the radiating effects of courts on popular legal and religious consciousness. The book documents how legal institutions catalyze ideological struggles, which stand to redefine the nation and its politics. Probing the links between legal pluralism, social movements, secularism, and political Islamism, Constituting Religion sheds new light on the confluence of law, religion, politics, and society. Available in PDF, EPUB and Kindle. Book excerpt: Malaysia's multicultural society supports one of the most dynamic economies in Asia. This completely revised new edition of the standard text, first published twenty years ago, traces the history of the country from early times to the present day. The authors give particular attention to the evolution of Malay polities and their close links with indigenous groups who lived on the oceans and in the deep jungles of the region, from Sumatra to Borneo. This provides the background to the establishment of the Malay port of Melaka, which was conquered by the Portuguese in 1511, foreshadowing the establishment of a British colonial regime in the late nineteenth century. Although the large numbers of Chinese and Indian migrants who arrived to work in the tin and rubber industries contributed to economic expansion, colonial policies did not encourage communal interaction. The authors trace the process by which post-independence leaders in Malaya attempted to counter the legacy of ethnic hostility while answering Malay demands for an affirmation of their rights and a stronger commitment to Islam. The incorporation of the Borneo states of Sarawak and Sabah into the Federation of Malaysia in 1963 rendered the goal of welding a nation from areas that were geographically separated and culturally disparate even more problematic. The intense emotions attached to issues of race were made tragically evident in the racial riots of May 1969, which this book sees as a watershed in modern Malaysian history. As Malaysia enters the twenty-first century, the government is determined to oversee the transition to an economy focused on manufacturing and advanced technology, and to eliminate poverty and the association between occupation and race. While several recent studies deal with the impact of colonial rule and Malaysia's spectacular economic transition, this book is unique because it tracks developments from early times and identifies continuities as well as change. Combining the authors' specialist knowledge of precolonial sources with the most recent contemporary research, this new edition reinforces the position of A History of Malaysia position as a standard reference for all those interested in the historical processes which led to the emergence of this culturally varied and economically energetic country.

Book excerpt: On 16 September 1963 Malaysia came into being with the accession of Sabah, Sarawak and Singapore to the existing Federation of Malaya. This book marks the 50th anniversary of this notable event in South East Asia’s history. The focus of the book will be mainly on the experience of Sabah and Sarawak as subjects of the federation. It looks at the experience of federalism from a number of different perspectives, keeping in mind not just the effects of federalism on Sabah and Sarawak but also the effects on the federation as a whole. Has the bargain of 1963 been adhered to? Has Malaysian federalism been a successful example of this form of government in Asia, or has the bargain been undermined in ways contrary to the original deal in the Malaysia Agreement of 1963? What have been the practical effects on East Malaysia during 50 years?

Book excerpt: An Economic History of Malaysia, c.1800-1990 , provides the first general history of the Malaysian economy over the past two centuries, including a survey of the pre-colonial era. A unique feature is that it integrates the historical experiences of Peninsular Malaysia, Sabah and Sarawak as a case study in the onset of modern economic growth. Particular attention is paid to explaining Malaysia's signal success in achieving a relatively smooth shift away from the primary commodity export economy of the colonial period to near-NIC status by 1990.

Book excerpt: Compilation Series: A Brief History of Malaysia: Texts and Materials is a solid, application-oriented text for students taking law subjects. Many new features make this edition a richer and stronger learning resource for students. Several factors motivated the authors to write this book. After having the experience in legal field and teaching for more than 17 years, it became clear that there was a definite need for more detail materials in this area. In addition, there was need for a book which would give full recognition to an easier method and the authors felt it was time for a text which would develop the ideas and methods with this in mind. This book covers a thorough discussion of the development of law in Malaysia; beginning from the establishment of the Melaka Empire until the recent issues. A major audience for the book will be students studying the law subjects. The order of topics, however, provides a degree of flexibility, so that the book can be of interest to different readers through basic concepts until the advanced concepts (i.e. the discussion of the cases). The purpose of this book is to take the readers on an introduction to Malaysian legal history journey, by which, the meaning of such subject at basic level is better understood. Hopefully, this book can be benefited by the readers in their journey to success.
