The purpose of this grant proposal is to design a program that includes subsidized housing, educational support, vocational training, and mental health services to help former foster youth, ages 21 to 25. The proposed program intends to help foster youth to become fully functioning adults, mitigating some of the adverse outcomes faced by former foster youth.

Book excerpt: Across the country, far too many young people age out of foster care into appalling circumstances. “Aging out” occurs when youth under the state’s custody are still in the foster care system when they reach either the age of majority or the end of extended foster care. Aging out refers to the moment in time when child welfare is no longer legally responsible for the youth, and the system abruptly stops providing services–usually when the youth turns either 18 or 21. Each year, thousands of youth age out of foster care, essentially legal orphans with no legal connection to family or a supportive network. Unfortunately, foster youth who go through the experience of aging out of foster care have statistically poor life prospects. Longitudinal studies across the country show very high rates of homelessness, incarceration, unemployment, and lack of access to health care among youth who aged out of foster care. These outcomes are disproportionately worse for Black, Native, and Brown youth, as well as queer and trans youth. This study is designed to understand the experiences of transition-age youth in their transition out of foster care and investigate: Why do poor outcomes for youth who age out of care persist? What are the current lived experiences of youth who age out of care? In what ways does child welfare continue to fall short for youth who age out of care?

Perhaps the most pressing implementation issue concerning P.L. 110-351 is the challenges states may face in extending foster care to older youth. As of FY2011, states may extend care after age 18 by authorizing partial reimbursement for the cost of that continued support.3 One possible challenge in implementing this provision is that even with assistance from the federal government, states may be hesitant to extend care because of the cost. In addition, states are required to assist youth in developing a transition plan within 90 days of exiting care that identifies the supports and services available when they transition from care. In carrying out the plan, states can take a variety of approaches, such as beginning the transition planning process well before the 90-day requirement and engaging adults who can have meaningful connections to the youth when they emancipate from care. One of the most significant changes that occurred in the child welfare system in California was the implementation of a policy to extend the age for foster youth from 18 to 21 allowing them to stay in the system and receive foster care services as they transition to independent living. This policy is known as the California Fostering Connections to Success Act, also known as Assembly Bill (AB) 12 (AB12, 2010). Under the AB 12 policy, the implementation of the Extended Foster Care (EFC) Program allowed foster youth to participate in support services that would allow them to stay until the age of 21 (California Department of Social Services, n.d.). The purpose of this graduate project was to conduct a policy analysis on the California Assembly Bill 12 (Extended Foster Care, 2021) to determine if the provisions of the policy have helped older foster youth to have a successful and resourceful transition into adulthood. Using the Critical Race Theory framework, the analysis will determine if the overall outcomes for older foster youth exiting the foster care system differs based on age, gender, race. Findings from the project will help to determine how policy AB 12 has benefited older foster youth exiting the system.

Book excerpt: Nearly half of states have laws that explicitly permit the state child welfare system to continue providing foster care for children beyond the age of majority (usually no later than 19). However, the number of states that actually facilitate youth remaining in care beyond their 18th or 19th birthdays is significantly smaller. Over 20,000 young people have been emancipated from foster care annually from FY2002 through FY2006. While most young people have access to emotional and financial support systems throughout their early adult years, older youth in care and those who age out of care often face obstacles to developing independent living skills and building supports that ease the transition to adulthood. Older foster youth who return to their parents or guardians may continue to experience poor family dynamics or a lack of emotional and financial supports, and studies have shown that recently emancipated foster youth fare poorly relative to their counterparts in the general population on several outcome measures. Recognising the difficulties faced by older youth in care and youth emancipating from foster care, Congress created a new Independent Living initiative (P.L. 99-272)in 1986 to assist certain older foster youth as they enter adulthood. The legislation authorised mandatory funding to states under a new Section 477 of the Social Security Act. In 1999, the John H. Chafee Foster Care Independence Act (P.L. 106-169) replaced the Independent Living Program with the Chafee Foster Care Independence Program (CFCIP) and doubled the total annual funds available to states from $70 million to $140 million. The law also expanded the population of youth eligible to receive independent living services - with no lower age limit - and gave states greater flexibility in designing independent living programs. Independent living services can refer to assistance in obtaining a high school diploma, training in daily living skills, and training in financial management, among other services. Amendments to the CFCIP in FY2002 (P.L. 107-133) authorised discretionary funding for states to provide education and training vouchers to eligible youth. Along with the CFCIP, federal child welfare law and other federal programs are intended to help older current youth in care and foster care alumni make the transition to adulthood. The federal foster care program has protections in place to ensure that older youth in care have a written case plan that addresses the programs and services that will assist in this transition, among other supports. Further, federal law authorises funding for states to provide workforce assistance and housing to older foster youth. Despite these efforts and the resilience displayed by current and former foster youth, policymakers and child welfare practitioners have suggested that at a minimum, young people need better support to build stronger connections with caring adults before leaving foster care and should have the option to remain in care upon reaching their 18th or 19th birthdays.

Book excerpt: The Preventing Sex Trafficking and Strengthening Families Act (H.R. 4980), an omnibus bill that includes both child welfare and child support provisions, was signed into law on September 29, 2014, as P.L. 113-183. The bill received broad congressional support, passing the House by voice vote (under suspension of the rules) on July 23, 2014, and the Senate by unanimous consent on September 18, 2014. P.L. 113-183 amends the federal foster care program to require state child welfare agencies to develop and implement procedures for identifying, documenting in agency records, and determining appropriate services for certain children or youth who are victims of sex trafficking, or at risk of victimization. State child welfare agencies must also report to law enforcement and the U.S Department of Health and Human Services (HHS), which administers child welfare programs, about such victims. In addition, HHS must establish a national advisory committee on child sex trafficking that must, among other responsibilities, develop policies on improving the nation's response to domestic sex trafficking. P.L. 113-183 also includes provisions to direct child welfare agencies to develop protocols on locating children missing from care. The law also seeks to ensure children in foster care have the opportunity to participate in activities that are appropriate to their age and stage of development. It requires changes in state foster home licensing law to enable foster caregivers to apply a "reasonable and prudent parenting" standard when determining whether a child in foster care may participate in activities; and directs state child welfare agencies to provide training to caregivers on using this standard. Other provisions in the law seek to ensure permanent adult connections for older children and better aid their transition to successful adulthood. Under the new law, states are not permitted to assign a permanency plan of "another planned permanent living arrangement" (APPLA) to any child under the age of 16, and must take additional steps to support permanency for children age 16 or older who are assigned that permanency plan. Further, children in foster care who are age 14 or older must be consulted in the development of, and about any revisions to, their case and permanency plans. They must also be made aware of their rights while in care, including the right to receive critical documents (e.g., birth certificate, Social Security card) when they "age out" of care. P.L. 113-183 separately extends funding authority for Adoption Incentive Payments for three years (FY2014-FY2016). It phases in a revised incentive structure that allows states to earn incentive payments for both adoptions and exits from foster care to legal guardianship, places additional focus on finding permanent homes for older children, and strengthens the way state performance is gauged under the program. The law requires 30% of any state savings (resulting from broadening federal eligibility for adoption assistance) to be used for family strengthening services, including post-adoption services. It also includes provisions to ensure continued federal assistance under the Title IV-E program for eligible children who, following the death or incapacitation of their legal guardian, are placed with previously named successor guardians. Separately, the law appropriates $15 million to continue Family Connection Grants for one year. These grants are intended to strengthen children's connections to their parents and other relatives.

Although it has long been a critical service for millions of children in the United States, the increased attention given to this service in the last two decades has focused more on its inability to achieve its intended outcomes than on its successes. However, as social and political trends and new legislation reshape child welfare, policymakers and service providers continue to offer innovative policy and practice options for this child welfare service. Though use of the service has changed, family foster care remains important. Responding to a widespread sense of the "drifting" of children in care, Congress passed the Adoption Assistance and Child Welfare Act of 1980. This legislation became a key factor shaping the current status of family foster care. Its goal was to reduce reliance on out-of-home care and encourage use of preventive and reunification services; it also mandated that agencies engage in planning efforts for permanent solutions for foster children. Yet, despite federal mandates and funding, the child welfare system has continued to struggle to provide the level of services needed for children to reduce the amount of time children remain in temporary foster care. The latest response to these problems, the Adoption and Safe Families Act of 1997, established unequivocally that safety, permanency, and well-being were national goals for children in the child welfare system. To comply with the law, public and private agencies are required to initiate significant program and practice changes in the coming years to improve permanency outcomes and child well-being in family foster care. The central theme of the volume is accountability for outcomes, certainly a current driving force in child welfare as well as in other public and private service fields. This volume will be of interest to all concerned with the social welfare of children and families at the end of the twentieth century.
