Book Synopsis European Traditions in Civil Procedure by : C. H. van Rhee
Download or read book European Traditions in Civil Procedure written by C. H. van Rhee and published by Intersentia nv. This book was released on 2005 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: European co-operation has resulted in many new and challenging opportunities for legal scholars who, since the so-called 'codification period', have become used to operating in a purely national context. This applies also to scholars in the field of civil procedure, who, for a considerable period of time, have resisted leaving the purely national domain. These scholars have devoted a great deal of attention to the question whether or not harmonisation of civil procedural law is a feasible option, and, if so, in what manner harmonisation should be achieved. The contributors to this book seek to further the harmonisation debate by exploring some of the main trends in the development of civil procedural law during the last two centuries in several European countries (Germany, Austria, Switzerland, France, England and Wales, The Netherlands and Belgium). Two of the central issues that are addressed by the contributors are the extent to which the various procedural models have influenced each other and the extent to which common traditions in civil procedural law may be distinguished in Europe. Each general chapter in this book is supplemented by three chapters devoted to specific procedural topics: Conciliation, Party Interrogation as Evidence and the Role of the Judge. In addition, extensive bibliographical references are included.

Book Synopsis The Oxford Handbook of Criminal Process by : Darryl K. Brown
Download or read book The Oxford Handbook of Criminal Process written by Darryl K. Brown and published by Oxford University Press. This book was released on 2019-02-22 with total page 952 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Criminal Process surveys the topics and issues in the field of criminal process, including the laws, institutions, and practices of the criminal justice administration. The process begins with arrests or with crime investigation such as searches for evidence. It continues through trial or some alternative form of adjudication such as plea bargaining that may lead to conviction and punishment, and it includes post-conviction events such as appeals and various procedures for addressing miscarriages of justice. Across more than 40 chapters, this Handbook provides a descriptive overview of the subject sufficient to serve as a durable reference source, and more importantly to offer contemporary critical or analytical perspectives on those subjects by leading scholars in the field. Topics covered include history, procedure, investigation, prosecution, evidence, adjudication, and appeal.
Book Synopsis The Oxford Handbook of Criminal Law by : Markus D Dubber
Download or read book The Oxford Handbook of Criminal Law written by Markus D Dubber and published by OUP Oxford. This book was released on 2014-11-27 with total page 1294 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Criminal Law reflects the continued transformation of criminal law into a global discipline, providing scholars with a comprehensive international resource, a common point of entry into cutting edge contemporary research and a snapshot of the state and scope of the field. To this end, the Handbook takes a broad approach to its subject matter, disciplinarily, geographically, and systematically. Its contributors include current and future research leaders representing a variety of legal systems, methodologies, areas of expertise, and research agendas. The Handbook is divided into four parts: Approaches & Methods (I), Systems & Methods (II), Aspects & Issues (III), and Contexts & Comparisons (IV). Part I includes essays exploring various methodological approaches to criminal law (such as criminology, feminist studies, and history). Part II provides an overview of systems or models of criminal law, laying the foundation for further inquiry into specific conceptions of criminal law as well as for comparative analysis (such as Islamic, Marxist, and military law). Part III covers the three aspects of the penal process: the definition of norms and principles of liability (substantive criminal law), along with a less detailed treatment of the imposition of norms (criminal procedure) and the infliction of sanctions (prison law). Contributors consider the basic topics traditionally addressed in scholarship on the general and special parts of the substantive criminal law (such as jurisdiction, mens rea, justifications, and excuses). Part IV places criminal law in context, both domestically and transnationally, by exploring the contrasts between criminal law and other species of law and state power and by investigating criminal law's place in the projects of comparative law, transnational, and international law.
Book Synopsis Ethics and Law for the Health Professions by : Ian Kerridge
Download or read book Ethics and Law for the Health Professions written by Ian Kerridge and published by . This book was released on 2013 with total page 1208 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ethics and Law for the Health Professions is a cross-disciplinary medico-legal book, the first edition of which was widely used in the medical world. We believe it is also of immense use to the legal world when grappling with medico-legal issues. Its special features are its focus on a clinically-relevant approach and its recognition that health care professionals are often confronted with legal and ethical issues simultaneously. Health professionals have to satisfy both, and their legal advisers need to be aware of the dilemmas this can present. This book is careful to distinguish between ethics and law. Its chapters take account of all the health professions and their differing responsibilities, and the book covers a very wide range of the issues they face.

Download or read book Rechtsmittel in Der Europäischen Union written by J. Jolowicz and published by Springer. This book was released on 1999-09-02 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law relating to recourse is always changing, but the present period is notable for the number of countries whose law has recently undergone, is now undergoing, or is about to undergo extensive reform. This makes the comparison of differing systems particularly difficult. Recourse against Judgments in the European Union is the second volume in the series 'Civil Procedure in Europe'. This volume gives a comparative overview of the systems of recourse against civil judgments actually in operation in 14 countries of the European Union. The reports were written against the background of a document originally circulated in July 1995, but each of them remains the original work of its individual author. The contributions are written by national expects distinguished in the field of civil procedural law. The main reports are written in English, French, German and in one case Spanish, and are followed by summaries in the remaining languages. Extensive bibliographies have been included, to enable the reader to find material for further study. The national reports systematically address the following: a description of the right of appeal in each country; the nature and scope of the appeal against First and Second Instance Judgments; enforceability of Judgment subject to recourse; default Judgments. This volume covers the following countries: Austria, Belgium, Denmark, England and Wales, Finland, France, Germany, Greece, Ireland, Italy, The Netherlands, Portugal, Spain and Sweden.
