Book excerpt: GAO evaluated the Department of Commerce's procedures for conducting foreign availability assessments to determine whether militarily significant commercial products are freely available to the Soviet bloc from other countries. GAO found that Commerce: (1) averaged 16 months to complete foreign availability cases, although the Export Administration Act of 1979 had envisioned a 90-day processing period; (2) had incomplete cases that were in process for up to 47 months; (3) had difficulty in obtaining necessary evidence; (4) was reluctant to publish a determination without Department of Defense (DOD) concurrence; (5) needs to improve its information-sharing procedures with DOD and other agencies; and (6) should update its regulations specifying what information it uses in determining foreign availability. GAO also found that Commerce: (1) disagreed with DOD on information-sharing procedures; and (2) has started notifying other agencies of initiated assessments and requesting relevant information.

The Department of State regulates U.S. defense exports and the Department of Commerce regulates dual-use exports that have commercial and military applications. Each agency uses a separate control list of items that may require a license to export. Agencies use compliance activities to prevent the diversion or misuse of exported items against U.S. interests or allies. Misuse can occur through illicit transshipment, the diversion of items from their origin through an intermediary country to an unauthorized destination. In 2010, the President announced reforms to the export control system. This review examines (1) agencies' compliance activities to address transshipment risk and (2) the extent to which U.S. agencies assessed the impact of export control reforms on the resource needs for compliance activities. GAO analyzed U.S. licensing data for 13 transshipment countries and visited Hong Kong, Singapore, and the United Arab Emirates. "

GAO found that the report: (1) complied with the statutory reporting requirements; (2) discussed the availability of controlled items from foreign sources; (3) focused on the countries participating in the control regime as the major suppliers; (4) did not include information on other countries with sophisticated missile capabilities that may be capable of undermining the controls; (5) did not present any information regarding the capability of several countries as suppliers of less sophisticated missile-related equipment and technology; and (6) stated that enforcing the controls would present no new problems, since most of the controlled items were already covered under arms export controls.
