Available in PDF, EPUB and Kindle. Book excerpt: The explosive rise in the U.S. incarceration rate in the second half of the twentieth century, and the racial transformation of the prison population from mostly white at mid-century to sixty-five percent black and Latino in the present day, is a trend that cannot easily be ignored. Many believe that this shift began with the "tough on crime" policies advocated by Republicans and southern Democrats beginning in the late 1960s, which sought longer prison sentences, more frequent use of the death penalty, and the explicit or implicit targeting of politically marginalized people. In The First Civil Right, Naomi Murakawa inverts the conventional wisdom by arguing that the expansion of the federal carceral state-a system that disproportionately imprisons blacks and Latinos-was, in fact, rooted in the civil-rights liberalism of the 1940s and early 1960s, not in the period after. Murakawa traces the development of the modern American prison system through several presidencies, both Republican and Democrat. Responding to calls to end the lawlessness and violence against blacks at the state and local levels, the Truman administration expanded the scope of what was previously a weak federal system. Later administrations from Johnson to Clinton expanded the federal presence even more. Ironically, these steps laid the groundwork for the creation of the vast penal archipelago that now exists in the United States. What began as a liberal initiative to curb the mob violence and police brutality that had deprived racial minorities of their 'first civil right-physical safety-eventually evolved into the federal correctional system that now deprives them, in unjustly large numbers, of another important right: freedom. The First Civil Right is a groundbreaking analysis of root of the conflicts that lie at the intersection of race and the legal system in America.

Book Synopsis The Perils of Federalism by : Lisa L. Miller
Download or read book The Perils of Federalism written by Lisa L. Miller and published by Oxford University Press. This book was released on 2008-09-29 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: Much of the existing research on race and crime focuses on the manipulation of crime by political elites or the racially biased nature of crime policy. In contrast, Lisa L. Miller here specifically focuses on political and socio-legal institutions and actors that drive these developments and their relationship to the politics of race and poverty; in particular, the degree to which citizens at most risk of victimization--primarily racial minorities and the poor--play a role in the development of political responses to crime and violence. Miller begins her study by providing a detailed analysis of the narrow and often parochial nature of national and state crime politics, drawing a sharp contrast to the active and intense local political mobilization on crime by racial minorities and the urban poor. In doing so, The Perils of Federalism illustrates the ways in which the structure of U.S. federalism has contributed to the absence of black and poor victims of violence from national policy responses to crime and how highly organized but narrowly focused interest groups, such as the National Rifle Association, have a disproportionate influence in crime politics. Moreover, it illustrates how the absence of these groups from the policy process at other levels promotes policy frames that are highly skewed in favor of police, prosecutors, and narrow citizen interests, whose policy preferences often converge on increasing punishments for offenders. Ultimately, The Perils of Federalism challenges the conventional wisdom about the advantages of federalization and explains the key disadvantages that local communities face in trying to change policy.

Book Synopsis Congress and Crime by : Joseph F. Zimmerman
Download or read book Congress and Crime written by Joseph F. Zimmerman and published by Lexington Books. This book was released on 2014-08-06 with total page 177 pages. Available in PDF, EPUB and Kindle. Book excerpt: Congress in the latter part of the nineteenth century decided to enact a series of statutes facilitating state enforcement of their respective criminal laws. Subsequently, Congress enacted statutes federalizing what had been solely state crimes, thereby establishing federal court and state court concurrent jurisdiction over these crimes. Federalization of state crimes has been criticized by numerous scholars, U.S. Supreme Court justices, and national organizations. Such federalization has congested the calendars of the U.S. District Court and the U.S. Court of Appeals leading to delays in civil cases because of the Speedy TrialAct that vacates a criminal indictment if a trial is not commenced within a specific number of days, resulted in over-crowded U.S. penitentiaries, and raises the issue of double jeopardy that is prohibited by the Fifth Amendment to the U.S. Constitution and the constitution of each state. This book examines the impact of federalization of state crime and draws conclusions regarding its desirability. It also offers recommendations directed to Congress and the President, one recommendation direct to state legislatures for remedial actions to reduce the undesirable effects of federalized state crimes, and one recommendation that Congress and all states enter into a federal-interstate criminal suppression compact.

Book Synopsis Towards a Federal Europe by : Alexander H. Trechsel
Download or read book Towards a Federal Europe written by Alexander H. Trechsel and published by Routledge. This book was released on 2013-09-13 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: An excellent new analysis of federalism and the EU that investigates their mutual impact. It shows how scholars of comparative politics increasingly include the EU among their cases when investigating the impact of federalism on key issues such as policy making. The last decade saw a new wave of scholarly publications hit the shores as research on federalism and on the EU came together. These emerging strands of research genuinely enrich our understanding of the EU and its politics. Despite this recent wave, the topic of federalism and the EU is still extremely fruitful. This volume contributes to the continuing debate at a moment in time when the EU is undergoing profound changes. It is structured around four interrelated dimensions: the constitutional/theoretical dimension the institutional vision the party/citizens dimension the policy dimension. This structure allows the reader to consecutively "funnel down" from the more theoretical and abstract levels to the more concrete policy oriented level.

Book Synopsis In The Name of Justice by : Timothy Lynch
Download or read book In The Name of Justice written by Timothy Lynch and published by Cato Institute. This book was released on 2009-02-24 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: America’s criminal codes are so voluminous that they now bewilder not only the average citizen but also the average lawyer. Our courthouses are so clogged that there is no longer adequate time for trials. And our penitentiaries are overflowing with prisoners. In fact, America now has the highest per capita prison population in the world. This situation has many people wondering whether the American criminal justice system has become dysfunctional. A generation ago Harvard Law Professor Henry Hart Jr. published his classic article, “The Aims of the Criminal Law,” which set forth certain fundamental principles concerning criminal justice. In this book, leading scholars, lawyers, and judges critically examine Hart’s ideas, current legal trends, and whether the “first principles” of American criminal law are falling by the wayside. Policymakers, academics, and citizens alike will enjoy this lively discussion on the nature of crime and punishment, and how the choices we make in formulating criminal laws can impact liberty, security, and justice.
