Book excerpt: In 1971, the Institute for the Development of American Indian Law was organized to develop a program which would begin to sort out the inconsistencies and contradictory doctrines blocking any final settlement of the rights of American Indians. The field of taxation is one in which conflicts have continually arisen. This text is intended to give tribal councils, individuals, tribal lawyers, and administrators working with Indian people a source document to aid them in understanding the complexity of the subject matter. The subject of Indian taxation involves tribal self-government, treaty rights, Congressional powers over individual Indians and tribes, and the relationship of tribal governments to state governments and agencies. The text outlines the problems which are encountered in the following topic areas: treaties, statutes and "attributes of sovereignty"; tax exempt Indians and the courts; tax exempt status of Indians in Washington State; and Washington and Public Law 280: The Tonasket Case. The text examines the current state of Indian rights and explains to Indian people the basis of their claims to certain legal rights. The book is designed to give a historical overview to the theories of taxation which affect Indian income derived from trust lands covering the major cases in the Federal court system which have tried to define the tax status of Indian people as regards their property. Book excerpt: The poor quality of life and material impoverishment that is the situation for the majority of tribal citizens within the United States is unacceptable, especially in light of the U.S. policies that have created the poverty conditions faced by generations of Native Americans. This Article will examine the tribal quality of life and what laws, policies, and values have led to the contemporary situation. Part II will discuss the prosperity enjoyed by tribal peoples prior to the European invasion of mid-North America. In Part III, the historic causes of poverty will be examined as the British colonies gave way to the formation of the United States. By reviewing the historical factors that condemned tribal citizens to such intergenerational poverty, the contemporary circumstances facing tribal governments and their citizens will be brought into sharp focus. Part IV will examine the U.S. Indian policy of holding tribal lands in trust status and this policy's devastating consequences on tribal peoples. Part IV will also provide that returning full tribal jurisdiction over tribal lands without federal or state interference would remedy those consequences. To help readers understand fully the consequences of the federal trustee model over tribal resources, Part V will explore the abject intergenerational poverty experienced by Native Americans. Material poverty is not the only standard upon which to assess the quality of life for tribal citizens. In Part VI, the cultural wealth of tribal citizens will be examined to explain the tenacity and endurance that has allowed tribes to endure through the imposition of material impoverishment by the United States as trustee of tribal resources. This Article provides that within the Tribalist Economic framework tribal governments and citizens must continue to draw upon cultural wealth, tribal leadership values, and bicultural education to regain prosperous material quality of life. In conclusion, Part VII calls for realignment of the treaty partnership between tribal governments and the United States along with a return to the values embodied in Tribalist Economics for a return to cultural and material prosperity in Indian Country.

Book excerpt: American Indian literature is replete with language that refers to broken or hollow promises the US government has made to American Indians, one of the most prominent being that the US government has not kept its promises regarding health services for American Indians/Alaska Natives (AI/AN). Some commenters refer to treaties between tribes and the US government as the origin of the promise for health services to AI/AN. Others point to the trust relationship between the sovereign nations of American Indian tribes and the US government, while still others assert that the Snyder Act of 1921 or the Indian Health Care Improvement Act (IHCIA) contained the promise for health care. While the US has provided some form of health care for AI/AN since the country was in its infancy, and continues to do so through the Indian Health Service, the promise of health services for AI/AN is not explicit. Philosophers have articulated that a promise contains a moral obligation to fulfill it because of others expectations created by that promise. As the US government made its first promises in early treaties with AI/AN tribes and subsequently made promises in the years since, it is morally obligated to fulfill those promises, be they lying promises or not, because of resulting expectations. Yet, the US government has historically acted to restrict the rights of AI/ANrights that include access to health servicesthrough assimilation, separation, or termination policies. Further, the policies of the US government have kept the AI/AN populations socioeconomically impoverished, dependent on the US government for basic needs, and susceptible to health-compromising conditions.Using case studies, this dissertation looks not only at the policies and events that directly affected health services and health status, but also at how those policies and events contributed to health outcomes and the expectations of AI/AN. Given the history of the US government in fulfilling (or not fulfilling) its promises, this dissertation examines the expectations of AI/AN for their own future health outcomes under the policy of self-governance.
