Available in PDF, EPUB and Kindle. Book excerpt: During the past few decades, industrialized countries have witnessed a progressive crisis of the regulatory framework sustaining the binary model of the employment relationship based on the subordinate employment/autonomous self-employment dichotomy. New atypical and hybrid working arrangements have emerged, challenging the traditional notions of, and divisions between, autonomy and subordination. This in turn has strained labour law systems across industrialized countries that were previously based on the notion of dependent and subordinate employment to cast their personal scope of application. Nicola Countouris advances ideas for a new dynamic equilibrium in employment law to accommodate this evolution, providing a comparative account of the development of the employment relationship in four key European countries - the UK, Germany, France and Italy.

Book excerpt: Available online: http://urn.kb.se/resolve?urn=urn:nbn:se:norden:org:diva-6158 Is labour law in the Nordic countries prepared to meet future challenges, or is there a need for adjustments and renewal? These questions form the backdrop for the analysis in this report. The Nordic systems of labour law are built on a binary divide between employees and the self-employed. As a main rule, employees are protected by labour law, while self-employed are not, and the employer is responsible for complying with the legal framework. If future labour relations make it harder to assess whether a worker is an employee or self-employed, and to decide who is the employer, this might undermine the efficiency of labour law regulations. The report analyzes the adaptability of the legal framework, and points at strengths and weaknesses. Furthermore, the study discusses how the identified challenges can be addressed, by suggesting avenues for legal development and reform. The report is the concluding analysis of Pillar VI in the project Future of Work: Opportunities and Challenges for the Nordic Models (NFoW), funded by the Nordic Council of Ministers.

Book excerpt: This note explores the interactions between new technologies with key areas of commercial law and potential legal changes to respond to new developments in technology and businesses. Inspired by the Bali Fintech Agenda, this note argues that country authorities need to closely examine the adequacy of their legal frameworks to accommodate the use of new technologies and implement necessary legal reform so as to reap the benefits of fintech while mitigating risks. Given the cross-border nature of new technologies, international cooperation among all relevant stakeholders is critical. The note is structured as follows: Section II describes the relations between technology, business, and law, Section III discusses the nature and functions of commercial law; Section IV provides a brief overview of developments in fintech; Section V examines the interaction between technology and commercial law; and Section VI concludes with a preliminary agenda for legal reform to accommodate the use of new technologies.

Available in PDF, EPUB and Kindle. Book excerpt: This collection brings together perspectives from industrial relations, political economy, political theory, labour history, sociology, gender studies and regulatory theory to build a more inclusive theory of labour law. That is, a theory of labour law that is more inclusive of non-traditional workers (including those in atypical work, or from non-traditional backgrounds); more inclusive of a variety of collective approaches to work regulation that foster solidarity between workers; and more inclusive of interdisciplinary and complex explanations of labour law and its regulatory spaces. The individual chapters speak to this theme of inclusivity in different ways and offer different suggestions for how it might be achieved. They break down the barriers between legal research and other fields, to promote fruitful and integrative conversations across disciplines. In the spirit of inclusivity and intergenerational dialogue, the book blends contributions from early career and emerging scholars with those from leading scholars in the field, featuring critical commentary from senior labour law figures alongside theoretically and empirically informed work.

Book excerpt: Headlines frequently appear that purport to highlight the differences among workers of different generations and explain how employers can manage the wants and needs of each generation. But is each new generation really that different from previous ones? Are there fundamental differences among generations that impact how they act and interact in the workplace? Or are the perceived differences among generations simply an indicator of age-related differences between older and younger workers or a reflection of all people adapting to a changing workplace? Are Generational Categories Meaningful Distinctions for Workforce Management? reviews the state and rigor of the empirical work related to generations and assesses whether generational categories are meaningful in tackling workforce management problems. This report makes recommendations for directions for future research and improvements to employment practices.

Book excerpt: Environmental principles – from the polluter pays and precautionary principles to the principles of integration and sustainability – proliferate in domestic and international legal and policy discourse, reflecting key goals of environmental protection and sustainable development on which there is apparent political consensus. Environmental principles also have a high profile in environmental law, beyond their popularity as policy and political concepts, as ideas that might unify the subject and provide it with conceptual foundations or boost its delivery of environmental outcomes. However, environmental principles are elusive legal concepts. This book deepens the legal understanding of environmental principles in light of recent legal developments. It analyses the increasing legal effects of environmental principles in different jurisdictions and demonstrates how they are shaping and revealing innovative and evolving bodies of environmental law. This analysis is a step forward in understanding a key feature of modern environmental law and presents a robust methodology for dealing with novel legal concepts in the subject. It also makes a contribution to environmental policy debates and discussions internationally that rely heavily on environmental principles, including their supposed legal effects.

Book excerpt: This is an open access book.Changes in law either from the meaning of normative substance, institutional, and legal culture are inevitably in line with the dynamics within various sectors of life society. Therefore, it is necessary to thoroughly discuss and analyze which sectors may have a significant impact on the business world and society today. By discussing comprehensively, comparatively and collaboratively, it is hoped that legal issues can be seen from various perspectives in the legal and social fields by finding fundamental problems in depth related to several topics of discussion, including in the telematics legal sector, natural resource management law, business legal culture, as well as the tourism sector. For this reason, APPTHI held a series of conferences in 3 cities to discuss and make it a meeting place for world law experts with law lecturers throughout Indonesia and invited lecturers from various countries, such as South Korea, India, Malaysia and Europe to take a part in this conference. The 1st APPTHI International Conference on Changing of Law (the series) is the first international conference series held in Indonesia by the Association of Indonesian Law College Leaders (APPTHI), inviting several legal experts from countries such as the USA, the Netherlands, Korea, Malaysia, India, as well as South Korea. This activity has 3 major themes each held in several cities, namely: in Jakarta which will be held at Trisakti University on 22 July 2023 with the theme Changing of Law in the digital era, while in Makassar it will take place at the Indonesian Muslim University/UMI) on July 24 2023 with the theme Changing of Law in the Energy sector and Natural Resources Management, as well as the last series of conferences in Bali on July 26 2023 at Warmadewa University, becoming a series of academic activities that have a broad spectrum and dimension of legal knowledge with various legal perspectives such as business law, corporate law, civil law, criminal law, intellectual property law, telematics law, agrarian law, environmental law, HTN/HAN etc. This event was carried out within the framework of the first round of the APPTHI international program which will continue to be held regularly every year. This program is also a form of implementation of various forms of international cooperation in several countries such as New York University, Utrecht University, National University of Malaysia, Hankuk University, and Jawaharlal Nehru University. In this event APPTHI collaborated with the international program organizer, PASQAPRO. For the activities of The First APPTHI International Conference on Changing Law, The Series, involving campuses as co-hosts in Jakarta (hosted by Trisakti University), including: Jakarta Islamic University, Universitas Suryakancana, cianjur, Lampung Mitra University, Palembang Law School STIHPADA, Islamic University Jakarta, Muhamadiyah University Jakarta, YARSI University, National University, Borobudur University, while co-hosted in Makassar (Host Indonesian Muslim University): Panca Bakti University, West Kalimantan, Sawerigading University, Christian University of Paulus, Makasar, Universitas Juanda, Bogor and Seventeen August University (UNTAG) Semarang, for Bali with the host university Warmadewa, assisted by co-hosts including: Caritas College of Law, Papua. Hopefully this conference will not only be a scientific forum for APPTHI members and various foreign partner universities by providing outputs in the form of indexed proceedings and journals, but also an event that will contribute thoughts in the field of law for the Indonesian government in conducting studies on legal changes positively as well as being a think tank for the formation of state laws and policies.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers a radical challenge to accounts of the common law's development. Contrary to received jurisprudential wisdom, it maintains there is no grand theory which will explain satisfactorily the dynamic interactions of change and stability in the common law's history. Offering original readings of Charles Darwin's and Hans-Georg Gadamer's works, the book shows that law is a rhetorical activity that can only be properly appreciated in its historical and political context; tradition and transformation are locked in a mutually reinforcing but thoroughly contingent embrace. In contrast to the dewy-eyed offerings of much contemporary work, it demonstrates that, like life, law is an organic process (i.e., events are the products of functional and localized causes) rather than a miraculous one (i.e., events are the result of some grand plan or intervention). In short, common law is a perpetual work-in-progress - evanescent, dynamic, messy, productive, tantalising, and bottom-up.

Available in PDF, EPUB and Kindle. Book excerpt: Family Law in a Changing America highlights law and family patterns as they are now, not as they were decades ago. By focusing on key changes in family life, the casebook attends to rising equality and inequality within and among families. The law, formally at least, accords more equality and autonomy than ever before; yet, as our society has grown more economically unequal, so too have family patterns diverged, with marriage and marital child-rearing becoming a mark of privilege. A number of developments--mass incarceration, the privatization of care, and reproductive technologies--have also contributed to disparities based on race, class, and gender. The casebook reflects the law's continuing emphasis on marriage, but also treats nonmarital families as central. Rather than privilege the marital heterosexual family, the casebook organizes the presentation of the law around (1) adult relationships and (2) parent-child relationships. New to the Second Edition: Updated coverage on reproductive justice and abortion access Expanded and updated and coverage of the Indian Child Welfare Act Updated coverage on the child welfare system and a focus on debates over abolition Professors and students will benefit from: Text that includes dramatic changes in family patterns, including declining marriage rates, with differential rates based on race and class; increasing rates of nonmarital cohabitation and nonmarital parenting; tensions between women's increasing education and employment and the perseverance of the gendered division of labor in families An approach that decenters the marital heterosexual family and instead is structured around the general topics of adult relationships and parent-child relationships Focus on the scope of family law, including extensive coverage of crucial sites of family regulation that are traditionally given short shrift Emphasis on multiple modes of legal interpretation (common law, constitutional, statutory) and multiple actors in the legal system (judges, legislators, lawyers, experts, social workers) Practical problems and exercises that illuminate the gaps, tensions, and implications of existing doctrine; some of the problems include postscripts explaining how the issue was resolved by a court or legislature An approach that draws on more recent cases and cutting-edge issues and that includes extensive coverage of the rights of unmarried partners, reproductive justice, assisted reproduction; parentage (including intentional parenthood, functional parenthood, and multi-parent arrangements), adoption (including open adoption, transracial adoption, and the Indian Child Welfare Act), the child welfare system, and family support

Book excerpt: According to a famous Talmudic story (Babylonian Talmud, Tractate Shabbat: 31a), a gentile once approached Rabbi Hillel and asked to be taught the entire Torah while standing on one foot. Hillel replied, ‘Love your neighbour as yourself. That is the entire Torah. The rest is simply an explanation. Go and learn it!’ In much the same way, Jewish law can be described in one word—Torah. All the rest is simply an explanation. The Torah, also known as the Bible, the five books of Moses, and the Pentateuch, was written over 3,000 years ago. Since then, Jewish law has developed various interpretations and applications of the Torah, interpretations of those interpre- tions, and so on. Jewish law contains civil dictates as well as religious protocol. Problems that arose in the framework of religious life and problems surrounding civil relationships both found solutions in the same legal source—the Torah and the Halacha, the Jewish legal interpretations and rulings. This chapter on water law in the Jewish tradition provides insight into Jewish law and custom in general, and rules related to the protection of water sources in particular. One should not look, however, to find a written code of Jewish law, as there is none.

Book excerpt: "Excellent balance of case excerpts and author explanation, highly appropriate for undergraduate students." —Dr. Wendy Brame, Briar Cliff University Political factors influence judicial decisions. Arguments and input from lawyers and interest groups, the ebb and flow of public opinion, and especially the ideological and behavioral inclinations of the justices all combine to shape the development of constitutional doctrine. Drawing from political science as much as from legal studies, Constitutional Law for a Changing America: A Short Course helps students realize that Supreme Court cases are more than just legal names and citations. With meticulous revising, the authors streamline material while accounting for recent landmark cases and new scholarship. Ideal for a one semester course, the Ninth Edition of A Short Course offers all the hallmarks of the Rights and Powers volumes (also included in the Constitutional Law for a Changing America series) in a more condensed format.
