Available in PDF, EPUB and Kindle. Book excerpt: 'Reorganization and Resistance' analyses the ways in which the legal professions of nine countries (England,France, the Netherlands, Germany, Canada, the US, Mexico, Australia and Korea) and one continent (South America) have confronted the internal and external political, economic and social upheavals of the past twenty years. It documents how change and resistance are inextricably tied together in an oppositional tension where the greater weight shifts gradually from one to the other, even shifts backwards at times, but in the long view runs in the direction of change. The most obvious instance almost everywhere is the struggle of women in legal professions where improvement is undeniable even as resistance is varied and stiff. The book charts the way demographic shifts have changed the work of lawyers, the way that the revenue from law practice has been re-distributed, and the extent to which barriers based on race, class, religion and gender have shrunk or shifted. It describes how some professions have been forced by government or co-regulation with government to reorganize. It also documents how others have not kept pace with transformations in the economy and changes and challenges to legal education take center stage while demographic shifts and institutional reorganization are of much less importance.

Available in PDF, EPUB and Kindle. Book excerpt: This study explores the socio-legal context of economic rationality in the legal and judicial systems. It examines the meaning and relevance of the concept of efficiency for the operation of courts and court systems, seeking to answer questions such as: in what sense can we say that the adjudicative process works efficiently? What are the relevant criteria for the measurement and assessment of court efficiency? Should the courts try to operate efficiently and to what extent is this viable? What is the proper relationship between 'efficiency' and 'justice' considerations in a judicial proceeding? To answer these questions, a conceptual framework is developed on the basis of empirical studies and surveys carried out mainly in the United States, Western Europe and Latin America. Two basic ideas emerge from it. First, economic rationality has penetrated the legal and judicial systems at all levels and dimensions, from the level of society as a whole to the day-to-day operation of the courts, from the institutional dimension of adjudication to the organizational context of judicial decisions. Far from being an alien value in the judicial process, efficiency has become an inseparable part of the structure of expectations we place on the legal system. Second, economic rationality is not the prevalent value in legal decision-making, as it is subject to all kinds of constraints, local conditions and concrete negotiations with other values and interests.

Available in PDF, EPUB and Kindle. Book excerpt: This volume of essays examines how the legal systems of the chief countries of Latin America and Mediterranean Europe—Argentina, Brazil, Chile, Colombia, Mexico, Puerto Rico, Venezuela, France, Italy, and Spain—changed in the last quarter of the 20th century. Through essays that provide a wealth of data on the courts and the legal profession in these countries, the book attempts to relate changes in the operation of the legal systems to changes in the political and social history of the societies in which they are embedded. The details vary, in accordance with the particular history and structure of the countries, but there are also key commonalities that run through all of the stories: democratization, globalization, and changes in the legal order that seem to be worldwide; more power to courts; a growing legal profession; and the entry of women into what was once a masculine club.

Available in PDF, EPUB and Kindle. Book excerpt: This book is one of the few comprehensive works focusing on the sub-regional institutions in the Latin American and Caribbean region. These organisations and institutions enrich the co-operation at sub-regional level, but, in most cases, are neglected in legal literature. They have mainly economic purposes but they also contribute to new forms of institutional co-operation in other areas, including financial, political and social matters. The volume addresses some of the most representative of these institutions, such as the Mercosur, the Andean Community and sub-regional financial organisations (e.g. Central American Bank for Economic Integration and Andean Development Corporation) as well as new developments including the UNASUR and the Alliance for the Pacific. It provides updated information on the structure and changes of the institutions, and constitutes a valuable resource for those wishing to keep pace with legal developments in the fast-moving world of international institutional law. The book will appeal to a wide audience including researchers and practitioners specialising in international law and international organisations and related disciplines. Marco Odello, JD (Rome), LLM (Nottingham), PhD (Madrid) is a Reader in Law at Aberystwyth University, Wales, UK. Francesco Seatzu, JD (Cagliari), PhD (Nottingham) is Professor of International and European Law at the University of Cagliari, Sardinia, Italy.

This book was released on 1968-12-15 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fruits of a unique cultural exchange are brought together in this unusual book. Twenty-eight of the most eminent men and women of our generation – philosophers, historians, and scientists from nineteen countries – here discuss what they consider the most vital issues of our day. Paul-Henri Spaak, Barbara Ward, Gunnar Mydral, Linus Pauling, and many others participated in the Noranda lecture series at Expo 67 in Montreal, and each is concerned here with a special aspect of Expo's theme: Man and His World. The approaches to the theme are as varied as the backgrounds of the speakers. Some of the essays give a revealing and optimistic description of the national and international efforts to ensure a future for mankind; others, less optimistic, stress the increasing insanity of the world and draw attention to the poverty, starvation, hatred, waste, and war which destroy what creative men have built. One group of papers deals with the idea of progress. André Leroi Gourhan offers a panoramic description of man's cultural evolution and sketches the vast possibilities of future development; Karl Löwith questions the very notion of progress and observes that much "progressive" development has resulted in nothing but destruction; Félix Houphouët-Boigny, president of the Ivory Coast Republic, describes progress in one section of the world – Africa, and the Ivory Coast in particular. Other lectures deal with such diverse topics as the proper role of government, the modern scientist, formal and informal aspects of education, the history of architecture, recent biological contributions of chemistry, the population explosion, new advances in physics, and the world as a separate entity from man. "The world as universe is not made by man," Professor Löwith reminds us. "It is there, even without us, existing for and by itself." Originally sponsored by Noranda Mines Ltd., the lectures attracted wide attention at the time of their delivery and again later when some of them were broadcast on radio and television. Collected in this book, they offer a distillation of some of the most significant thinking of today – clear and cogent presentations of ideas that have won Nobel prizes for some of their creators and international recognition for all. In her Introduction, Helen Hogg writes, "It is a book to be sipped and savoured, to be dipped into again and again. Such an approach will enable the reader best to appreciate the penetrating commentaries of some of the world's greatest figures."
