Book excerpt: This is the ninth report on training for justice professionals (judges, prosecutors, court staff, lawyers, notaries and bailiffs) on EU law or the national law of another Member State. It is based on the results of a questionnaire sent in 2020 to Member States' authorities, European networks of legal professionals and their national members, and the main EU-level providers of training for legal practitioners. For the last time, this report charts the progress towards the target set by the Commission (in its 2011 Communication 'Building trust in EU-wide justice - a new dimension to judicial training') of ensuring that half (around 800 000) of all justice professionals in the EU are trained on EU law or the law of another Member State by 2020. On 2 December 2020, together with this report, the Commission adopted a new Communication 'Ensuring justice in the EU - a European judicial training strategy for 2021-2024' with new qualitative and quantitative objectives. This report includes for the last time the graph on European judicial training's progression for the EU28. All other data and graphs relate to the EU27 as no UK stakeholder provided data for 2019.

Book excerpt: EU law only serves citizens if properly implemented. Training of justice professionals on EU law is essential to ensure the correct and coherent application of EU law across the EU, to improve mutual trust and to foster a common judicial European culture, including on the rule of law. This report measures the participation of legal practitioners in judicial training on EU law in the EU. At the same time, it supports the overall strategy on European judicial training by keeping the topic high on the political agenda. The report complements the Evaluation of the European judicial training strategy published in October 2019 and shows excellent results in terms of participation. In 2018, more than 190 000 legal practitioners took part in training on EU law or the law of another Member State. The yearly number of participants increased by 148 % between 2011 and 2018. In total, more than 1 million legal practitioners attended training on EU law since 2011. There has been an ever-increasing growth in the number of participants and training activities since 2011. The strategy led to an almost doubling of EU funds available for training legal practitioners and significant improvements in the capacity of networks and training providers such as the European Judicial Training Network (EJTN). The strategy's lasting effects are visible in improved knowledge of EU law, strengthened mutual trust and an increased level of cooperation among justice professionals in the EU Member States. Training providers and networks also consolidated their capacity for delivering training on EU law. In 2018, judicial training continued to respond to new training needs in particular by addressing rule of law challenges. A landmark-training programme for justice professionals on key issues of fundamental rights and rule of law was implemented starting from 2018, as part of the European Commission's strategy for the effective implementation of the EU Charter of Fundamental Rights. The aim was the strengthening a rule of law culture, by increasing the knowledge of the rule of law standards. The positive results achieved so far are an encouragement for going further and taking up new challenges. Both the evaluation and the current report confirm the need to reach better some categories of justice professionals, notably lawyers, court staff, and to further focus training on topics such as the rule of law and fundamental rights.

The objective was backed by the Justice and Home Affairs Council in 2011 and again in 2014, when the Member States underlined the importance of training for legal practitioners. The European Parliament has also been a constant supporter of European judicial training, as expressed in its 14 March 2012 resolution on judicial training.

The event was jointly organised by the Portuguese Presidency of the Council of EU, the Centro de Estudos Judiciários (CEJ) of Portugal and the European Commission, and was an important milestone in the dissemination and implementation of the new European judicial training strategy for 2021-2024. The conference brought together national- and European-level training providers and associations of judges, prosecutors, court staff, prosecution office staff, lawyers, notaries, bailiffs, probation officers, prison staff, legal interpreters and translators, and mediators. Over 200 professionals from across Europe participated in the event, which included 10 working groups and around 60 speakers, moderators and rapporteurs. The starting point was a discussion of the quantitative and qualitative objectives of the new European judicial training strategy for 2021-2024 adopted on 2 December 2020, as well as the Council Conclusions on 'Boosting training of justice professionals'.

Book excerpt: The Study on the state of play of court staff training in EU law and promotion of cooperation between court staff training providers at EU level is a one-year project commissioned by the Directorate General (DG) JUSTICE of the European Commission in order to: Map out the different categories of court staff in each EU Member State, with a specific attention to their roles in implementing various aspects of EU law, as well as cross-border judicial cooperation; Describe the general organisation of court staff training at national level, and contact the main training providers; Pay specific attention to their training in EU law, organisation of other European judicial and legal systems and knowledge of legal terminologies in all EU Member States; Collect and analyse data (description and statistics) on existing training activities specifically on EU law aspects, be they organised at European, national, regional or local level; Work with training providers to assess needs regarding training in EU law aspects and develop recommendations; Provide a framework for direct initial contacts between training providers and promote their cooperation. The current Final Report describes the findings of the project, on the basis of the analysis of statistical data received as well as the input from the representatives of the training providers regarding training needs and ideas for future cooperation between training providers. Factsheets describing the various court staff categories have been established. A list of training providers and of participants in the project's meetings is a starting point for future involvement of court staff training providers at European level. Recommendations for actions at regional, national or European level to improve training of court staff in EU law as well as cooperation between national training providers stem from input from questionnaires as well as discussions in meetings and workshops.
