Book excerpt: The Revised European Convention on the" Adoption of Children (RECAC) was introduced by the Council of Europe in 2008, in an effort to provide a modern framework for the adoption of children. It represents an international consensus on acceptable child adoption, reflecting the different views, legal diversity and common heritage of member states. This book provides an in-depth analysis and commentary on each of the 30 articles of the revised convention. It is a comprehensive work which explores the changes and developments that have taken place since the 1967 Convention on the Adoption of Children first emerged. It is a detailed, one-stop source for judges, social workers, legislatures and adoption practitioners on all aspects of the RECAC. This clear and incisive text is divided into three parts, commencing with an overview of the convention, followed by an examination of the general principles and concluding with the final clauses.
Book Synopsis The Global ‘Orphan’ Adoption System by : Lee Kyung-eun
Download or read book The Global ‘Orphan’ Adoption System written by Lee Kyung-eun and published by 펜립. This book was released on 2021-12-01 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: S. Korea is one of the major sending countries in the “transnational experiment of child care”, invented by the human community after World War II. Among all sending countries of adoptees, S. Korea is actually the country where the practice of inter-country adoption had its genesis. The fundamental source of power which sustains inter-country adoption practices is, as Dr. Nigel Cantwell mentions in his endorsement, the pervasive “glowing image” of adoption. In other words, the dominant perception of adoption as salvation is a key obstacle which prevents a more accurate mapping of the reality of inter-country adoption. In her new book, Dr. Kyung-eun Lee wields international laws as her surgical blade in order to dissect the practice of inter-country adoption from S. Korea. She uncovers the fact that the S. Korean government and private adoption agencies as partners have made “orphans” systematically, widely, but ironically within legal boundaries. As a result, adoptees’ human rights have been violated on a massive scale. Dr. Lee points out the negligence of the international society which was aware of Korea’s failure in complying with the international legal system. She reminds the international community, especially those of the receiving countries, of their responsibility to demand that sending countries such as S. Korea enhance their legal systems in order to protect child rights. Growing requests from adult international adoptees to find their identities and information on their adoption reveals much evidence that adoptees’ rights were violated by the inter-country adoption system. Many countries have begun to investigate past abuses and malpractices within the adoption system, and are finding a way to recover adoptees’ rights from the unethical and illegal practices which have taken place in the past, and which are still inherent within the system. This book should serve as invaluable guidance to government officials, legal experts, researchers and adoption-related stakeholders who wish to transform the current global “orphan” adoption system into the alternative care system for the best interests of the child.

Book excerpt: The aim of the Convention is to take account of social and legal developments while keeping to the European Convention on Human Rights and bearing in mind that the child's best interests must always take precedence over any other considerations.New provisions introduced by the Convention:- The father's consent is required in all cases, even when the child was born out of wedlock.- The child's consent is necessary if the child has sufficient understanding to give it.- It extends to heterosexual unmarried couples who have entered into a registered partnership in States which recognise that institution. It also leaves States free to extend adoptions to homosexual couples and same sex-couples living together in a stable relationship.- The new convention strikes a better balance between adopted children's right to know their identity and the right of the biological parents to remain anonymous.- The minimum age of the adopter must be between 18 and 30, and the age difference between adopter and child should preferably be at least 16 years.

Download or read book Muslims in Motion written by Nazli Kibria and published by Rutgers University Press. This book was released on 2011 with total page 189 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Muslims in Motion, Nazli Kibria provides a comparative look at Bangladeshi Muslims in different global contexts--including Britain, the U.S., the Middle East, and Malaysia. Kibria examines international migrant flows from Bangladesh, and considers how such migrations continue to shape Islamization in these areas. Having conducted more than 200 in-depth interviews, she explores how, in societies as different as these, migrant Muslims, in their everyday lives, strive to achieve economic gains, sustain community and family life, and realize a sense of dignity and honor. Muslims in Motion offers fresh insights into the prominence of Islam in these communities, especially an Islam defined by fundamentalist movements and ideologies. Kibria also focuses on the complex significance of nationality--with rich analyses of the diaspora, the role of gender and class, and the multiple identities of the migrants, she shows how nationality can be both a critical source of support and also of difficulty for many in their efforts to attain lives of dignity. By bringing to life a vast range of experiences, this book challenges prevailing stereotypes of Muslims.
Book Synopsis Orphans of Islam by : Jamila Bargach
Download or read book Orphans of Islam written by Jamila Bargach and published by Rowman & Littlefield Publishers. This book was released on 2002-02-26 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: Orphans of Islam portrays the abject lives and 'excluded body' of abandoned and bastard children in contemporary Morocco, while critiquing the concept and practice of 'adoption,' which too often is considered a panacea. Through a close and historically grounded reading of legal, social, and cultural mechanisms of one predominantly Islamic country, Jamila Bargach shows how 'the surplus bastard body' is created by mainstream society. Written in part from the perspectives of the children and single mothers, intermittently from the view of 'adopting' families, and employing bastardy as a haunting and empowering motif with a potentially subversive edge, this ethnography is composed as an intricate, open-ended, and arabesque-like evocation of Moroccan society and its state institutions. It equally challenges received sociological and anthropological tropes and understandings of the Arab world.

Download or read book Islamic Law and Finance written by Frank E. Vogel and published by BRILL. This book was released on 1998-01-01 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mirroring the expansion of wealth in the Middle East and Asia and a surge in Islamic self-identity, Islamic banking practices have either become the law of the land or coexist and compete with Western practices in at least six countries. A growing number of institutions and mutual funds (akin to Western ''socially responsible'' funds) have established Islamic investment and other practices to cater to this burgeoning market. Because of its prevalence, practitioners in every banking-related area must familiarize themselves with current Islamic finance practices in order to do business with Muslim clients and to engage in cross-border financing. Injunctions from the "Qur'an and the sayings of Prophet Muhammed have generated a web of interrelated norms which prohibit Islamic financiers from engaging in transactions that involve interest "(riba) and speculation "(gharar). "Islamic Law and Finance describes the dynamic set of Islamically-sanctioned ways financiers can transacat business.
