This text, which affirms the role of communities as the first level For The exercise of democracy, has become the benchmark international treaty in this area. The European Charter of Local Self-Government was drawn up within the Council of Europe on the basis of a draft proposed by the Standing Conference of Local and Regional Authorities of Europe (CLRAE), predecessor of the Congress of Local and Regional Authorities. it was opened for signature as a convention by the Council of Europe member states on 15 October 1985, and entered into force on 1 September 1988. As at 1 January 2010, The Charter has been ratified by 44 out of the 44 Council of Europe member states. The counties which have ratified the Charter are bound by its provisions. The Charter requires compliance with a minimum number of principles that form a European foundation of local democracy. The Congress of Local and Regional Authorities makes sure that these principles are observed.

The Congress, a consultative body of the Council of Europe, is made up of two chambers: one representing local authorities, the other the regions. Its aim is to reinforce democratic structures at local and regional level, and in particular to help the newly-emerging democracies in central and eastern Europe. The Congress adopts three different types of texts: recommendations, opinions and resolutions. Recommendations are proposals to the Committee of Ministers, and their application is left up to each member government. Sometimes they are also addressed to other international organisations. Opinions usually refer to questions to the Congress from the Committee of Ministers or the Parliamentary Assembly. The Committee of Ministers and the Parliamentary Assembly consult the Congress on questions which are likely to affect the competence and the basic interests of the local and regional authorities which the Congress represents. Resolutions reflect the decisions that the Congress is authorised to take, or make recommendations to local and/or regional authorities and their associations.

These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.
