Book excerpt: In Constitutional Principles of Local Self-Government in Europe Giovanni Boggero offers a meticulous account of the defining features of European constitutional local government law using both an international and comparative law perspective. The book argues that differences between local government systems in Europe, typical examples of internal affairs of a State, can be smoothed away by construing a consistent system of constitutional principles to be coherently applied at domestic level across the whole European legal space. This system can be best grasped by looking at the European Charter of Local Self-Government, which embodies a concept of self-government rooted in common legal traditions, and at its subsequent practice within the Council of Europe.

The recognition of local democracy by the Council of Europe member states led To The elaboration of the European Charter of Local Self-Government - the first international binding treaty that guarantees the rights of communities and their elected authorities. This text, which affirms the role of communities as the first level For The exercise of democracy, has become the benchmark international treaty in this area. The European Charter of Local Self-Government was drawn up within the Council of Europe on the basis of a draft proposed by the Standing Conference of Local and Regional Authorities of Europe (CLRAE), predecessor of the Congress of Local and Regional Authorities. it was opened for signature as a convention by the Council of Europe member states on 15 October 1985, and entered into force on 1 September 1988. As at 1 January 2010, The Charter has been ratified by 44 out of the 44 Council of Europe member states. The counties which have ratified the Charter are bound by its provisions. It offers a theoretically saturated concept to measure local autonomy and applies it to 39 countries, including all 28 EU member states together with Albania, Georgia, Iceland, Liechtenstein, Macedonia, Moldova, Norway, Serbia, Switzerland Turkey and Ukraine, over a period of 25 years (1990-2014).

Available in PDF, EPUB and Kindle. Book excerpt: The European Yearbook of Constitutional Law (EYCL) is an annual publication devoted to the study of constitutional law. It aims to provide a forum for in-depth analysis and discussion of new developments in the field, both in Europe and beyond. This second volume examines the constitutional positioning of cities across space and time. Unrelenting urbanisation means that most people are, or soon will be, living in cities and that city administrations become, in many respects, their quintessential governing units. Cities are places where State power is operationalised and concretised; where laws and government policies transform from parchment objectives to practical realities. In a similar vein, cities are also places for the realisation of the constitutional rights and liberties enjoyed by individuals. The book is organised around three sets of relations that await further unpacking in theory as well as practice: that between cities and other institutions in the national constitutional architecture; that between cities and their inhabitants; and that between cities and international organisations. The contributions to this book show the marked diversity in the role and powers available to cities in Europe and beyond, and identify principles and approaches to help stipulate new ways of thinking about the legal role and relevance of cities going forward. Ernst Hirsch Ballin is distinguished university professor at Tilburg University and vice-dean for research of Tilburg Law School. Gerhard van der Schyff is associate professor at Tilburg Law School, Department of Public Law and Governance. Maarten Stremler is lecturer at Maastricht University, Faculty of Law, Department of Public Law. Maartje De Visser is associate professor at SMU School of Law, Singapore.

Featuring an impressive range of contributors from both eastern and western Europe, the book addresses three main topics: territorial reforms, democratic empowerment of citizens and the role of local leadership, as well as new trends in local finances. Acknowledging their inherent diversity, the book examines the ways that local governments have responded to shared challenges, such as climate change, increasing populism and democratic deficit in order to identify both the variety and communalities between the country-specific features. In doing so, it provides a rich picture of the latest trends in local government, as well as pointing the way for future developments.

Book excerpt: The Council of Europe, of which all European States are members, plays a pivotal role in the promotion and protection of human rights, democracy, and the rule of law in Europe. Bringing together specialist scholars and practitioners, The Council of Europe: Its Laws and Policies offers profound insights into the functioning of the organization. The organization's primary and secondary law, its institutional structure, and its far-reaching fields of activities are comprehensively and systematically analysed. This volume investigates the impact of the Council's activities within the national legal systems of the Member States and the dense web of relationships between the Council of Europe and other international organisations. An important reference work on one of the most influential organizations in Europe, the book concludes that the Council of Europe has played a considerable role in the constitutionalization process of regional public international law.
