Book Synopsis Government Procurement in the WTO by : Sue Arrowsmith
Download or read book Government Procurement in the WTO written by Sue Arrowsmith and published by Springer. This book was released on 2003-01-14 with total page 520 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the World Trade Organization regime, government procurement is largely excluded from the multilateral agreements. The 'plurilateral' WTO Agreement on Government Procurement, with its challenging accession procedures and limited number of signatories, cannot be said to succeed in its efforts to liberalize this area of trade activity–more than 10 percent of gross domestic product in most countries. This insightful and thoroughly researched study investigates the special sensitivities of government procurement that have left major trade barriers intact despite the WTO mandate that has proven so effective in other areas. Professor Arrowsmith examines the following crucial factors in depth: why and how procurement practices create barriers to trade the institutional structure for dealing with government procurement in the GATT/WTO system the impact of relevant WTO law on national legal systems the types of contracts and entities covered in the Agreement on Government Procurement how the National Treatment principle and the Most Favored Nation obligation affect government procurement rules of WTO contract award procedure and the controversy over their interpretation and revision the free trade vs. social and environmental issues question in the context of government procurement and the monitoring and enforcement of WTO procurement rules Throughout the presentation the author focuses on specific issues to illuminate the overall pattern of her legal analysis. For example, practical questions stemming from such activities as multi-phase tendering and electronic procurement are raised for special scrutiny. The legal literature of the WTO and its jurisprudence are frequently brought into Professor Arrowsmith's arguments. The result is a new work of major significance-a work that government procurement officials in every country, whatever their field, cannot afford to ignore. The value of Government Procurement in the WTO to lawyers and scholars in the field goes without saying. Review' Beneath its somewhat ordinary title is a work of extraordiary depth and quality. Although written by a law professor, this book is far more than a traditional legal textbook. In exceptionally lucid writing, the aithor sets forth a comprehensive study of the World Trade Organization (WTO) regulations ('Articles') on public procurement and their omplications.'

Book Synopsis Reluctant European by : Stephen Wall
Download or read book Reluctant European written by Stephen Wall and published by . This book was released on 2020 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 2016, the voters of the United Kingdom decided to leave the European Union. The majority for 'Leave' was small. Yet, in more than 40 years of EU membership, the British had never been wholeheartedly content. In the 1950s, governments preferred the Commonwealth to the Common Market. In the 1960s, successive Conservative and Labour administrations applied to join the European Community because it was a surprising success, whilst the UK's post-war policies had failed. But the British were turned down by the French. When the UK did join, more than 10 years after first asking, it joined a club whose rules had been made by others and which it did not much like. At one time or another, Labour and Conservative were at war with each other and internally. In 1975, the Labour government held a referendum on whether the UK should stay in. Two thirds of voters decided to do so. But the wounds did not heal. Europe remained 'them', 'not 'us'. The UK was on the front foot in proposing reform and modernisation and on the back foot as other EU members wanted to advance to 'ever closer union'. As a British diplomat from 1968, Stephen Wall observed and participated in these unfolding events and negotiations. He worked for many of the British politicians who wrestled to reconcile the UK's national interest in making a success of our membership with the sceptical, even hostile, strands of opinion in parliament, the press and public opinion. This book tells the story of a relationship rooted in a thousand years of British history, and of our sense of national identity in conflict with our political and economic need for partnership with continental Europe.

Available in PDF, EPUB and Kindle. Book excerpt: The Trade & Cooperation Agreement (TCA) is the treaty which regulates free trade and economic arrangements between the European Union (EU) and the United Kingdom (UK) post-Brexit. The treaty entered into force provisionally on 1 January 2021 and officially on 1 May 2021, and has governed trade relations between the parties since. This book brings together contributions by leading scholars in EU and international trade law, economics and political science to provide a comprehensive, interdisciplinary analysis of the TCA. It contextualizes the treaty and identifies several emerging political, economic, and security challenges, which serve as the background to evolving EU-UK relations. The book also unpacks the treaty's complex provisions on customs and rules of origin, investments, services and procurement, subsidies, fisheries, aviation, cooperation on energy, environment, health, social security, and on UK participation in EU programs. Furthermore, it provides an updated assessment of EU-UK disagreement on the implementation of the Protocol on Ireland/NI, and considers the positive impact of the Windsor Framework in rebuilding trust between the parties, and the possibilities to further expand EU-UK cooperation within the TCA and beyond. Book Synopsis European Economic Legal Order After Brexit by : Enzo Cardi
Download or read book European Economic Legal Order After Brexit written by Enzo Cardi and published by Routledge. This book was released on 2021-07-29 with total page 173 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes an innovative approach to provide a mirror perspective of the legal systems of the UK and the EU in contemporary institutional scenarios. At the beginning of the second decade of the 21st century, the legal systems of the EU and the UK are facing challenges of epic proportions. Never before have the two legal orders been confronted with the simultaneous impact of a series of events. First, the effect of the “divorce” between the two regulatory systems caused by the UK’s withdrawal from the EU. The Negotiating Documents and the Draft Texts being discussed and aimed at leading to a `New Partnership’ are examined in the book. Second, the book discusses the impact of the coronavirus shock in all European economies leading to a substantial change of political perspective in the EU legal order implying innovative debt instruments. Third, it explores the consequences of the judicial activism of the German Constitutional Court undermining the strategic role of the European Central Bank and the primacy of the European Union Court of Justice. The book questions the effects deriving from the legacy, i.e. the foundations of the two legal systems, on handling the issues of our time, the impact on market regulation of the striking contemporary events and the unsettled consequences on policy of the current convulsing political and financial landscape. The book will be essential reading for those working in the areas of European public regulatory law.
