Book excerpt: Since the economic crisis unfolded in 2008, the European Union economic governance framework has been profoundly transformed from a legal perspective. The EU has adopted new tools, institutions and rules to tackle the changes and is arguably better prepared to combat any future crises. This book analyses the basic legal framework of EU economic governance and considers the economic underpinnings which underlie legal institutions in this area. It uses analytical dialectics as a method of analysis and the paradigm of 'law as credibility' as the main model through which the substantive parts of EU economic governance are accounted for. Important issues such as access, exit and expulsion from the euro, the independence of the European Central Bank, the Stability and Growth Pact, bail-outs to member states, and the EU's economic strategy are addressed in a clear, critical and innovative way.

This volume evaluates the prospects for major change to expenditure and the structure of the budget for the period starting in 2014.

Book excerpt: The Committee warn that the European Council and Member States cannot afford to ignore the enlargement agenda. The report considers the impact of EU enlargement on both economic growth and the stability and security of the EU's neighbourhood. The Committee also consider the increasing 'nationalisation' of the enlargement process and how the EU and the Commission should tackle bilateral issues, such as the 'name issue' between Greece and the Former Yugoslav Republic of Macedonia. EU enlargement provides benefits for both existing and new Member States. However, with the current economic difficulties in Europe, it has become less of a priority. It is important the EU does not lose sight of the benefits enlargement can bring. The UK, for example, aims to export its way out of recession and a larger single market can only help that effort. It is also vital that the EU abides by its own rules when taking in new members. The Committee believes the Copenhagen criteria set the bar at the right level and they must be properly applied to any future candidates for EU membership. Failure to do this in the case of Bulgaria and Romania led to a scramble to bring those countries up to speed after accession. That cannot be allowed to happen again.

Book excerpt: Proposals for reforms for the EU as a whole are likely to find a more favourable reception than possible requests for further 'special treatment' for the UK. The Committee is sceptical that other Member States would be willing to renegotiate existing EU law so as to allow the UK on its own to reduce its degree of integration, especially where this could be seen as undermining the integrity of the Single Market. Other Member States appear to want the UK to remain an EU Member. Closer Eurozone integration is a potential risk to the position of the UK and other non-Eurozone states in the EU. However, the December 2012 agreement on the Single Supervisory Mechanism for banking regulation shows what the UK can achieve to protect its position. The Eurozone is in any case far from a homogenous bloc and the expansion and closer integration of the Eurozone does not therefore necessarily render the UK's position in the EU impossible or worthless. This report does not examine whether the UK should remain in the EU or withdraw. However, it agrees with the Government that, if the UK were to leave the EU, the current arrangements for relations with the EU which are maintained by Norway or Switzerland would not be appropriate for the UK. If it is in the UK's interest to remain in the Single Market, the UK should either remain in the EU, or launch an effort for radical institutional change in Europe to give decision-making rights in the Single Market to all its participating states

Book excerpt: This book looks at Italy and Germany as prototypes of the peripheral and core countries in the European Monetary Union (EMU) and examines their respective faults. It also analyses the context of the European Union (EU) institutions, their origin, the forces that drove away from a more balanced or federalist one, and shortcomings. This offers the opportunity to suggest some changes to EU structures, particularly in the light of the COVID-19 pandemic and its aftermath. Both Germany, Italy, and other EU countries have violated European rules. However, despite this, the negative performance of the EMU has to be connected to its deflationary and unbalanced institutions. These were driven away from the federalist route that they seemed to be initially following by a Franco-German axis and by a decisive German switch towards a tough monetary regime.

Available in PDF, EPUB and Kindle. Book excerpt: An Introduction to European Intergovernmental Organizations provides an up-to-date and accessible reference to European intergovernmental organizations other than the European Union. The EU is so dominant that people often overlook the multitude of older and newer, smaller and larger intergovernmental organizations rooted in the history of contemporary Europe which continue to help shape its future. The specialized character of these organizations adds value to cooperation in Europe as a whole, creates permanent channels of communication regardless of EU membership and allows the possibility for non-European involvement through organizations such as the European Bank for Reconstruction and Development and NATO. It also allows sub regional groups of states, such as the Nordic countries or the Benelux countries to exist and express their own identity via their own organizations. This book looks at the history of Non-EU organizations, their decision-making characteristics, membership policies, legal powers actions and interactions with each other and the European Union. A uniform scheme of analysis is used to make European intergovernmental organizations comparable and by studying them we gain a deeper understanding and insight into European affairs.

Available in PDF, EPUB and Kindle. Book excerpt: CHOICE OUTSTANDING ACADEMIC TITLE 2015 Many of us think of European countries as discreet entities—their own languages, cultures, food, and economies squarely contained within their national boundaries. But in fact Europe is at once a unified place and a sophisticatedly fragmented one, and national boundaries rarely reflect its social and economic realities. The social atlas of Europe is the first atlas to map Europe according to these realities, from the perspective of human geography rather than simply a political one. Using innovative full-color visualization methods, it reconsiders European identity through its many different facets: economy, culture, history, and human and physical geography, visualizing Europe and its people in a more fluid way, in some cases using maps without artificial national boundaries. It utilizes the latest available demographic, social, and economic data through state-of-the-art geographical information systems and new cartography techniques. Through these new visualizations, this highly illustrated book offers fresh perspectives on a range of topics, including social values, culture, education, employment, environmental footprints, health and well-being, and social inequalities and cohesion. It is a bold rethinking of Europe as we know it and will be of interest to anyone who wants to understand the continent in its truest form.

Book excerpt: The UK spends approximately £1.23 billion each year on aid through the European Union, approximately 16% of the UK's total aid budget. Only 46% of this aid, however, goes to low income countries - a figure that MPs say is 'unacceptable'. Instead middle income countries bordering Europe are benefiting. Turkey has consistently been in the top five recipients of European Commission aid (223 million euros in 2010) as has Serbia (euros 218 million in 2010). The Committee is calling on the UK Government to press for funding to be diverted, away from higher middle income countries bordering Europe, to give greater help to the poorest people in the world. In order to make this happen, the MPs say Ministers must challenge and change the definition of Official Development Assistance (ODA). It appears to be being used as a way of fudging the figures to help other European countries meet the target for 0.7% of GDP to be given as aid. The Committee recognises that there are a number of advantages to giving aid through the EU but identifies a number of problems with the way EU Development Assistance works. Overall, the European Commission has improved its performance over the last decade and has recently proposed further improvements to development policy in An Agenda for Change. The Committee supports a number of these proposed changes, but it does have concerns that conditionality should not hurt the poor for the sins of their governments

Available in PDF, EPUB and Kindle. Book excerpt: Should the European Neighbourhood Policy stop at the borders of the European Union’s immediate neighbouring countries? This book is the first full length study of the ’neighbours of the EU’s neighbours’, a concept originally introduced by the European Commission with reference to Saharan Africa, the Middle East and Central Asia. These regions in the EU’s broader neighbourhood are often perceived as an ’arc of crisis’ from which manifold challenges emanate for Europe. This timely book takes stock of the state of the EU’s cooperation with the neighbours of its neighbours and explores how the concept might help promote security, stability and prosperity beyond the countries which are formally part of the European Neighbourhood Policy. How can the EU create bridges between these regions? What instruments does the EU have at its disposal and how can it link them in order to respond to the challenges and overcome the current fragmentation? One of the conclusions is the suggestion to consider a pragmatic ’EU Strategy for the Neighbours of its Neighbours’ which addresses the needs of the broader EU neighbourhood in a more systematic and consistent manner and helps transform in the long run the ’arc of crisis’ into another ’ring of friends’.

Book excerpt: The Common Foreign and Security Policy (CFSP) of the European Union is a highly exceptional component of the EU legal order. This constitutionalised foreign policy regime, with legal, diplomatic, and political DNA woven throughout its fabric, is a distinct sub-system of law on the outermost sphere of European supranationalism. When contrasted against other Union policies, it is immediately clear that EU foreign policy has a special decision-making mechanism, making it highly exceptional. In the now depillarised framework of the EU treaties, issues of institutional division arise from the legacy of the former pillar system. This is due to the reality that of prime concern in EU external relations is the question of 'who decides?' By engaging a number of legal themes that cut across foreign affairs exceptionalism, executive prerogatives, parliamentary accountability, judicial review, and the constitutionalisation of European integration, the book lays bare how EU foreign affairs have become highly legalised, leading to ever-greater coherence in how Europe exerts itself on the global stage. In this first monograph dedicated exclusively to the law of the EU's Common Foreign and Security Policy in modern times, the author argues that the legal framework for EU foreign affairs must adapt in a changing world so as to ensure the EU treaties can cater for a more assertive Europe in the wider world. Available in PDF, EPUB and Kindle. Book excerpt: The Sovereign debt crisis pushed the EU to take a new step to the common financial rules. After some years of ‘soft budgetary carefreeness’, the European Budgetary Treaty boosted the movement of budgetary convergence in the EU. The ‘Six Pack’ and the ‘Two Pack’ consolidated the effectiveness of a new European budgetary order founded by the Maastricht Treaty and the Stability and Growth Pact. Even if mechanisms adopted by the Member States are formally different in law, conditions of European budgetary orthodoxy have been definitively hardened. This new rigor has a great impact on all the public administrations, as defined by the European Accounts System and Eurostat. The EU is a key-player of the budgetary game. This great power makes the EU accountable to the general economic situation within Europe and amongst all Member States. Budgetary regulation must be conciliated with preservation of some investment means to develop potential growth on the continent. ‘Giant in law’, the EU has to be responsible from an economic point of view. The problem is that, from a budgetary standpoint, the EU remains a ‘dwarf’. The European general budget is about 1% of the EU gross national income. The budgetary power of the EU is less than one twentieth of the USA federal financial power. Balance between ‘budgetary dwarf ’ and ‘giant in law’ is characteristic of ‘adolescence’ of the EU finances. Natural consequence of this situation, the EU capacities for redistributing and stabilization are still relatively limited. To overtake this powerlessness, the EU has used no budgetary tools by appealing to the European Investment Bank and the European Investment Fund. However, the ability of the EU to support public investment is not sufficient today to promote an authentic economic relaunching policy and to support the global competition, especially with the USA and China. With a ‘powerful brake’ and a ‘poor accelerator’, the risk is the European public investments continue to stand by. This is the investment paradox of the European budgetary order. Will the next negotiation on the multiyear financial framework post 2020 be able to change the point ? It is not sure, especially in the Brexit context. Negotiating an European financial agenda is always long and difficult. But, the exit of the United Kingdom could makes the game more disputed than ever. A thing is clear : beyond the technical and financial sizes of the new roadmap proposals established by the Commission, the democratic control of the European Parliament is still limited. The EU budgetary framework and timetable are too inert, not enough reactive, far from European citizens actually. In the historical moments we live, it is certainly a strategic mistake to not involve much more citizens and their representatives in the crucial negotiation on the long-term finances of the EU. This is the technocratic risk of the new European budgetary order.
