Research on implementation in the EU typically focuses on legal compliance with EU policy. However, this focus gives us an incomplete picture of EU implementation, its diversity and practice. The contributions of this collection represent a shift toward a more performance-oriented perspective on EU implementation as problem-solving. They approach implementation fundamentally as a process of interpretation of superordinate law by actors who are embedded within multiple contexts arising from the coexistence of dynamics of Europeanization, on the one hand, and what has been termed ‘domestication’, on the other. Moving beyond legal compliance, the contributions provide new evidence on the diversity of domestic responses to EU policy, the roles and motivations of actors implementing EU policy, and the ‘black box’ of EU law in action and its enforcement. By reassessing the relative importance of EU policy and domestic factors and actors for the outcomes of EU implementation, the results give insight into on the nuanced interplay between Europeanization and domestication forces, useful for both EU researchers and practitioners. Currently there are 36 of them and they have been operating under very diverse conditions. In 2012, the European Parliament, the Council of the European Union and the European Commission sought to rectify this by adopting a ‘Joint Statement’ and a comprehensive set of guiding principles – a ‘Common Approach’ – to make the agencies more coherent, effective and accountable. In the light of an expected revision of these guiding principles, the European Parliament’s Committee on Constitutional Affairs (AFCO) will produce an implementation report on the functioning of decentralised European agencies. The letter to the Conference of Committee Chairs (CCC) was sent on 11 April and the Conference of Presidents endorsed the request on 31 May 2018. In this framework, the Ex-Post Evaluation Unit (EVAL) provides expertise on the implementation of the agreed guidelines in the form of a European implementation assessment (EIA). This EIA was drawn up by Professor Ellen Vos of Maastricht University, at the request of the Ex-post Evaluation Unit of EPRS. It provides an overview of the different decentralised EU agencies according to a number of criteria; including their functions, legal bases, sources of financing, respective roles of Parliament, Council, Commission and Member States, stakeholder involvement and transparency. In particular, it examines how parliamentary scrutiny over decentralised agencies is undertaken and suggests possible improvements to those mechanisms, in order to reach a more coherent, efficient and transparent institutional set-up for parliamentary scrutiny of agencies’ activities.

The article reviews studies on EU agencies' organization, tasks, proliferation and location in the political-administrative space. Whether the advent of EU agencies tends to underpin a basically intergovernmental, transnational or supranational order has potentially huge consequences for the distribution of power across levels of government, for the degree of policy uniformity and pooling of administrative resources across countries, for the role of genuinely European perspectives in the policy process, and for accountability relations. Although the jury is still partly out on most topics, we see the contours of a more direct multilevel administration in which EU agencies not only constitute nodes within transnational agency networks, but in addition, in governance terms, relate more closely to the European Commission than to any other institution.
