Book Synopsis Language, Minorities and Human Rights by : Fernand de Varennes
Download or read book Language, Minorities and Human Rights written by Fernand de Varennes and published by BRILL. This book was released on 2021-09-27 with total page 552 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the most vexing issues in many of the world's so-called ethnic or minority conflicts is the question of language use by the State and its citizens. While international and national law has traditionally viewed language preference to be within a State's prerogative - at least when involving governmental activities and machinery - this position has proved to be a continuous source of acrimony and conflict, and wrong in some respects. Language, Minorities, and Human Rights is the most complete book ever written on the topic, providing for the first time an analysis of every aspect of language and the law. In addition to presenting a theoretical model for language's particular position and relevance in human rights, it constitutes an invaluable reference document by including the provisions of close to 100 international, multilateral and bilateral instruments involving language rights, as well as the constitutional provisions of 140 countries dealing with language. By addressing little explored areas such as the language rights of indigenous peoples, non-citizens and even the use of script, in addition to more traditional topics such as nationalism and language, freedom of expression and non-discrimination, Language, Minorities and Human Rights proposes a complete descriptive picture of language and human rights as well as proposing a number of suggestions on how to address and balance the many problems currently caused by the linguistic demands of various individuals and the interests of states in nation building.

Book Synopsis Multiculturalism and Minority Rights in the Arab World by : Will Kymlicka
Download or read book Multiculturalism and Minority Rights in the Arab World written by Will Kymlicka and published by OUP Oxford. This book was released on 2014-03-20 with total page 308 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the Arab Spring, Arab states have become the new front line in the struggle for democratization and for open societies. As the experience of other regions has shown, one of the most significant challenges facing democratization relates to minority rights. This book explores how minority claims are framed and debated in the region, and in particular, how political actors draw upon, re-interpret, or resist both the new global discourses of minority rights and more local traditions and practices of co-existence. The contributors examine a range of pre-colonial, colonial, and post-colonial factors that shape contemporary minority politics in the Arab world, and that encumber the reception of international norms of multiculturalism. These factors include the contested legacies of Islamic doctrines of the `dhimmi' and the Ottoman millet system, colonial-era divide and rule strategies, and post-colonial Arab nation-building. While these legacies complicate struggles for minority rights, they do not entail an `Arab exceptionalism' to global trends to multiculturalism. This volume explores a number of openings for new more pluralistic conceptions of nationhood and citizenship, and suggests that minority politics at its best can serve as a vehicle for a more general transformative politics, supporting a broader culture of democracy and human rights, and challenging older authoritarian, clientalistic, or patriarchal political tendencies. The chapters include both broad theoretical and historical perspectives as well as more focused case studies (including Western Sahara/Morocco, Algeria, Israel/Palestine; Sudan; United Arab Emirates, and Iraq).

Book Synopsis African Yearbook of International Law/Annuaire Africain De Droit International by : Abdulqawi A. Yusuf
Download or read book African Yearbook of International Law/Annuaire Africain De Droit International written by Abdulqawi A. Yusuf and published by Martinus Nijhoff Publishers. This book was released on 2001-02-01 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: The "African Yearbook of International Law" provides an intellectual forum for the systematic analysis and scientific dissection of issues of international law as they apply to Africa, as well as Africa's contribution to the progressive development of international law. It contributes to the promotion, acceptance of and respect for the principles of international law, as well as to the encouragement of the teaching, study, dissemination and wider appreciations of international law in Africa. A clear articulation of Africa's views on the various aspects of international law based on the present realities of the continent as well as on Africa's civilization, culture, philosophy and history will undoubtedly contribute to a better understanding among nations. The "African Yearbook of International Law" plays an important role in examining the tensions underlying the State in Africa, and by shedding more light on the causes of the fragility of African State institutions so as to facilitate the identification of appropriate remedies. The tension and interrelationships among issues such as territorial integrity, self determination, ethnic diversity and nation-building are constantly addressed. Development, human rights and democratization in Africa are also the subject of continuous attention and examination. The "Special Theme" of this volume is "Regional Economic Integration in Africa II,"

Book Synopsis مرجع اسناد بین المللی حقوق بشر by : Aphrodite Smagadi
Download or read book مرجع اسناد بین المللی حقوق بشر written by Aphrodite Smagadi and published by BIICL. This book was released on 2008 with total page 484 pages. Available in PDF, EPUB and Kindle. Book excerpt: From 2005 to 2008, the British Institute of International and Comparative Law has been conducting a comprehensive project on human rights in the Islamic Republic of Iran. The project's focus was to promote human rights as a central part of the dialogue in which the European Union and Iran have been engaged since 2002. This publication is one of the outputs of that project. It is designed as a practical guide and reference book for lawyers and other human rights defenders, and it describes the international legal framework of human rights. This account of the fundamental principles of treaty law and practice facilitates better understanding of the structure and functioning of the human rights system at the international level. Focus is then placed on selected individual human rights and on the issues encountered by vulnerable groups, on the basis of significance of the topics to both parties to the dialogue. In each section, analysis is accompanied by the relevant provisions of international human rights instruments and case law. The book concludes with a list of bibliographical sources suggested for further reading.
Book Synopsis The Tension Between Group Rights and Human Rights by : Koen De Feyter
Download or read book The Tension Between Group Rights and Human Rights written by Koen De Feyter and published by Bloomsbury Publishing. This book was released on 2008-07-31 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: The discussion of group rights, while always a part of the human rights discourse, has been gaining importance in the past decade. This discussion, which remains fundamental to a full realisation by the international community of its international human rights goals, requires careful analysis and empirical research. The present volume offers a great deal of material for both. It makes a strong case in favour of a multidisciplinary approach to human rights and explores the origins and social, anthropological and legal/political dimensions of human rights and internationally recognised group rights. It explores legal issues such as the reservations to international treaties and methodological questions, including the question of deliberative processes which allow seemingly absolute requirements of human rights to be reconciled with culturally sensitive norms prevailing within various groups. The discussion continues by looking at specific contexts, including the situations of women, school communities, ethnic and linguistic minorities, migrant communities and impoverished groups. The final part of the volume examines the 'state of play' of human rights and group rights in international law, in international relations and in the context of internationally sponsored development policies. Here the authors offer a meticulous and critical presentation of the legal regulation of human rights and group rights and point to numerous weaknesses which continue to exist and which call for additional work by legal thinkers and practitioners.

Available in PDF, EPUB and Kindle. Book excerpt: With EU and NATO membership for the Baltic States now a reality, this volume examines the relationship of the three countries, their constituent peoples and their surrounding region to the wider Europe, both historically and in the period since 1991. In particular, the contributors seek to locate the Baltic area within the manifold debates surrounding the concepts of "new" and "old" Europe, including those occasioned by the current conflict in Iraq.
