In der heutigen Zeit ist die Transplantation von Spenderorganen eine gängige und erfolgreiche Methode um Menschenleben zu retten. Organe wie Niere, Leber, Herz, Lunge, Pankreas und Dünndarm können vom verstorbenen Spender auf einen Empfänger übertragen werden, um diesem ein neues Leben zu schenken. Laut Transplantationsgesetz (TPG) sind zur Entnahme von Organen zwei Voraussetzungen erforderlich. Zum einen die Zustimmung des Spenders oder der Angehörigen, die im Sinne des Verstorbenen befugt sind zu entscheiden. Zum anderen das Vorliegen des Hirntods eines potentiellen Spenders. Ob allein mit dem Ausfall des Gehirns schon von Tod gesprochen werden kann, hängt davon ab was unter Leben oder Tod verstanden und wahrgenommen wird. Die Transplantationsmedizin, der viele Menschen ein neues Leben verdanken wirft eine Reihe ethischer Fragen auf. Wann ist ein Mensch tot? Ob und unter welchen Umständen sind Eingriffe in den menschlichen Körper zum Zwecke der Organentnahme ethisch vertretbar? Die Transplantationsmedizin ist ein Thema der Ethik, weil die körperliche Unversehrtheit des Menschen angetastet wird und es um Leben und Tod geht – von Seiten des Spenders wie auch auf Seiten des Organ – Empfängers.

Allgemein ist die Ethik der Philosophie, also die Moralphilosophie, in zwei große Teile einzuteilen. Zum einen die allgemeine Ethik, in welcher die Grundlegung der Ethik in Form von generellen Prinzipien und Theorien anzusiedeln ist, zum anderen die angewandte Ethik, in der es um spezielle Probleme und ihre versuchte Klärung geht. Es wird nach dem, was moralisch gesollt, erlaubt oder zulässig ist, gefragt. Die philosophische Ethik bietet uns Orientierungshilfen. Dem Bereich der angewandten Ethik wird unter anderem die Medizinethik zugeordnet, die zum Oberbegriff Bioethik gehört. Heute wird die Medizinethik im Bereich aller Eingriffe und deren Möglichkeiten in Prozessen des Lebens, Sterbens, wie auch der Zeugung angesiedelt. Die Problemstellungen unterliegen dem Wandel der Gesellschaft. Schöne-Seifert teilt die Problematik in Fragen der ersten und zweiten Ordnung auf. Bei denen der ersten Ordnung handelt es sich um (umstrittene) Grundpositionen zu Medizinthemen, wie die Patientenautonomie. Die Fragen zweiter Ordnung betrachten das Verhältnis zwischen Einzelfallurteil und Theorie. Dabei treten drei Modellvorstellungen auf. Zum ersten das deduktive Anwendungsmodell, in dem simple Anleitungen zu bestimmten Konflikten aufzufinden sind. Zum zweiten das der pure Einzelfallerkenntnis, auch Kasuistik genannt, welches anhand von ähnlichen Fällen, Argumenten der Ähnlichkeit sowie Verschiedenheit, konkrete Probleme in Augenschein nimmt. Als letztes tritt die partielle Kasuistik auf, welche den Prinzipienansatz von Beauchamp und Childress enthält. Dieser besteht aus vier Prinzipien der Rechtfertigung: der Autonomie und Respekt dieser, der Schadensvermeidung, der positiven Fürsorge und die Gerechtigkeit.

Book excerpt: CHRISTOPH REHMANN-SUTTER, MARCUS DÜWELL, DIETMAR MIETH When we placed “finitude”, “limits of human existence” as a motto over a round of discussion on biomedicine and bioethics (which led to this collection of essays) we did not know how far this would lead us into methodological quandaries. However, we felt intuitively that an interdisciplinary approach including social and cultural sciences would have an advantage over a solely disciplinary (philosophical or theological) analysis. Bioethics, if it is to have adequate discriminatory power, should include sensitivity to the cultural contexts of biomedicine, and also to the cultural contexts of bioethics itself. Context awareness, of course, is not foreign to philosophical or theological bioethics, for the simple reason that the issues tackled in the debates (as in other fields of ethics) could not be adequately understood outside their contexts. Moral issues are always accompanied by contexts. When we try to unpack them – which is necessary to make them accessible to ethical discussion – we are regularly confronted with the fact that in removing too much of the context we do not clarify an issue, but make it less comprehensible. The context – at least some essential parts of it – is intrinsic to the issue. Unpacking in ethics is therefore a different procedure. It does not mean peeling the context off, but rather identifying which contextual elements are essential for an understanding of the key moral aspects of the issue, and explaining how they establish its particular character.

The important question is not whether xenotransplantation will succeed, but rather how and under what circumstances xenografts will provide predictable enough results to warrant clinical application. The fact that the best results to date in clinical xenografting were achieved over three decades ago should not be a matter of discouragement, but rather a stimulus to apply new approaches to this area of work. The shortage of human organs for transplantation is cited frequently as the driving force behind the increased interest in xenotransplantation. This shortage is an undeniable fact, but there are additional potential advantages of xenotrans plantation, such as the ability to schedule replacement surgery on an elective basis and the modification of animals, organs, and tissues to improve acceptabil ity in the human host. The advances in the basic science ofxenotransplantation outlined in this book give hope that the immunologic barriers to xenotransplantation will be overcome and that transplanted organs and tissues will succeed consistently in humans. However, if our experience with human allografts provides an analogy, we may anticipate that clinical progress in xenografts will be plagued by failures and rewarded by successes, often without a complete understanding of the mechan isms involved.
