Book excerpt: Las nuevas tecnologías han irrumpido en nuestra sociedad y han facilitado, a través de la creación de plataformas virtuales, el acercamiento de las personas y portanto la celebración de contratos internacionales a través de estos medios electrónicos.Por tanto, la dimensión de consumidor se ha internacionalizado, y es necesaria la intervención legislativa a nivel internacional de los Estados para ofrecer mayor protección a la parte débil en la relación contractual. En este trabajo se recogen algunos de los desafíos jurídicos que plantea la protección del consumidor en el comercio electrónico, analizando las normas de Derecho internacional privado que regulan los contratos internacionales con los consumidores, abordándose las normas de competencia judicial internacional que se recogen en el Reglamento (UE) 1215/2012junto con el Reglamento (CE) 593/2008 sobre la ley aplicable a las obligaciones contractuales. Analizando así los mecanismos que establecen estas normas europeas para salvaguardar los intereses de los consumidores a la hora de realizar operaciones de consumo a través de Internet.Todo ello se analiza con apoyo en la jurisprudencia del Tribunal de Justicia de laUnión Europea, además de la doctrina especializada en este sector. La UE es consciente del enorme potencial que tiene Internet para la economía europea, y ha apostado poreste sistema de comercio electrónico, fomentando un mercado interior, que constituyeun marco ideal para realizar estas operaciones. Por consiguiente el legislador comunitario ha desarrollado mecanismos de protección hacia los consumidores a través de sus Reglamentos y Directivas.

While some businesses are relaying on their corporate website to make the sale, both traditional brick-and-mortar and new disruptive business models are increasingly using online marketplaces to offer their products online. European Union law has been gradually updated to reflect this new reality, with Intellectual Property Rights legislation and Consumer Law leading the way toward a suitable regulatory framework in the Platform Economy. However, the EU has not devised a comprehensive strategy for tackling the challenges posed by the online sale of physical consumer goods, such as effective public enforcement in online environments. In fact, sector-specific legislation, including Food Law, largely ignores online transactions. In this context, the book evaluates the impact that online marketplaces are having on European Union sector-specific legislation and its e-nforcement. The goal is to assess whether the existing regulatory and policy framework are sufficient for promoting compliance and bridging the enforcement gap in the digital single market. Focusing on the e-food market, the book presents a state-of-the-art overview of how online marketplaces are altering EU law and its enforcement by public authorities.
