En el derecho de los contratos y de las garantías reales y mobiliarias, en efecto, en razón de operaciones financieras cada vez más complejas y articuladas, de la creciente variedad y multiplicidad de las situaciones a regular, se exige una mayor elasticidad en la definición y configuración de la misma noción de “garantía real”. La complejidad, la variedad y la ductilidad de los intereses – que con la función de garantía real se expresan en una determinada estructura formal en cada modelo de garantía – plantean la necesidad de técnicas de actuación de aquella función que trasciendan el aparente carácter estático de los intereses representados, mediante la abstracción de la técnica respecto de una rígida identificación con los intereses tutelados. La reestructuración de las calificaciones formales de las garantías reales – en razón de la unicidad de la función de garantía real perseguida – debe, por lo tanto, operar mediante el reconocimiento de valor de la cualidad de los intereses implicados en cada operación económica particular. El libro – que retoma y desarrolla precedentes estudios sobre el tema, a través del análisis estructuralista y de la comparación jurídica con algunos modelos de garantías reales – tiene como objetivo ofrecer una nueva calificación del concepto y del sistema de las garantías reales, que tiene en cuenta de la unicidad de su causa contractual concreta incluso en la variedad de las estructuras formales a través de las cuales el concepto de garantía real se expresa". In a surge of publications on the subject, few focus on regions beyond Europe and the Anglophone world. Decolonizing Science in Latin American Art assembles a new corpus of art-science projects by Latin American artists, ranging from big-budget collaborations with NASA and MIT to homegrown experiments in artists’ kitchens. While they draw on recent scientific research, these art projects also ‘decolonize’ science. If increasing knowledge of the natural world has often gone hand-in-hand with our objectification and exploitation of it, the artists studied here emphasize the subjectivity and intelligence of other species, staging new forms of collaboration and co-creativity beyond the human. They design technologies that work with organic processes to promote the health of ecosystems, and seek alternatives to the logics of extractivism and monoculture farming that have caused extensive ecological damage in Latin America. They develop do-it-yourself, open-source, commons-based practices for sharing creative and intellectual property. They establish critical dialogues between Western science and indigenous thought, reconnecting a disembedded, abstracted form of knowledge with the cultural, social, spiritual, and ethical spheres of experience from which it has often been excluded. Decolonizing Science in Latin American Art interrogates how artistic practices may communicate, extend, supplement, and challenge scientific ideas. At the same time, it explores broader questions in the field of art, including the relationship between knowledge, care, and curation; nonhuman agency; art and utility; and changing approaches to participation. Book excerpt: This book examines two types of transnational money laundering: the use of offshores and wire transfers to “invest” in real estate; and agribusiness, a nebulous activity that is difficult to regulate. The author also examines current international mechanisms to combat money-laundering; whether these efforts have been successful or unsuccessful; and whether multilateral instruments are an effective tool in the war against international organized crime. As national borders have opened and trade barriers have fallen, transnational crime has grown at unprecedented levels. The current situation, better revealed by the so-called “Panama Papers,” is a result of a lack of local cooperation in the investigations, prosecution, and/or extradition of criminals. Governments profit from ill-gotten wealth hosting international criminal enterprises in their own territories, thus providing a fertile ground for illicit practices, closing their eyes to the nexus among false or inappropriate identification, fraudulent records, corruption, and money laundering. If these types of transnational money-laundering are allowed to remain as they are currently treated, the shift in the financial paradigm, from centralized and regulated to decentralized and “unregulated,” would allow for the continuation of some of the most dangerous criminal activity. In this timely book, the author presents arguments that by “following the money,” capital movements involved in transnational money laundering through real estate and agribusiness can be examined, revealed, and understood.
