Book excerpt: Essential Readings in Canadian Constitutional Politics introduces students, scholars, and practitioners to classic authors and writings on the principles of the Canadian Constitution as well as to select contemporary material. To complement rather than duplicate the state of the field, it deals with the Canadian Charter of Rights and Freedoms and with Canadian mega-constitutional politics in passing only, focusing instead on institutions, federalism, intergovernmental relations, bilingualism and binationalism, the judiciary, minority rights, and constitutional renewal. Many of the selections reverberate well beyond Canada's borders, making this volume an unrivalled resource for anyone interested in constitutional governance and democratic politics in diverse societies.
Book Synopsis Constitutional Politics in Canada and the United States by : Stephen L. Newman
Download or read book Constitutional Politics in Canada and the United States written by Stephen L. Newman and published by State University of New York Press. This book was released on 2012-02-01 with total page 291 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Canadian constitutional reforms of 1982, which included a Charter of Rights and Freedoms analogous to the American Bill of Rights, brought about a convergence with American constitutional law. As in the U.S., Canadian courts have shown themselves highly protective of individual rights, and they have not been shy about assuming a leading and sometimes controversial political role in striking down legislation. In clear and easy-to-understand language, the contributors not only chart, but also explore, the reasons for areas of similarity and difference in the constitutional politics of Canada and the United States.
Book Synopsis Constitutional Politics in Canada after the Charter by : Patrick James
Download or read book Constitutional Politics in Canada after the Charter written by Patrick James and published by UBC Press. This book was released on 2011-01-01 with total page 203 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the Charter of Rights and Freedoms was introduced, Canada has experienced more than twenty-five years of constitutional politics and countless debates about the future of Canada. There has, however, been no systematic attempt to identify general theories about Canada's constitutional evolution. Patrick James corrects this oversight. By adding clarity to familiar debates, this succinct assessment of major writings on constitutional politics sharpens our vision of the past and the future of the Canadian federation.

CANADIAN CONSTITUTIONAL LAW. Constitutional Law is that department of jurisprudence which relates to the system of government of a country, and Canadian Constitutional Law is that particular division of Constitutional Law which relates to the system of government prevailing in the Dominion and the Provinces of Canada. Constitutional Law is an important part of law in Canada, because it facilitates the inquiry into what Imperial laws are in force in Canada, and enables one to fix the definite limitations of the various authorities that have power to enact legislation operative in Canada. There are three great authorities which have power to enact such legislation, and they are the following: --1. The Imperial Parliament, 2. The Canadian Parliament, and 3. The Provincial Legislatures, including the lawenacting bodies of the Canadian Territories and the other organized parts of Canada. The first of these authorities has unlimited powers;1 while from it the others derive their entire jurisdiction. Within their limits these other authorities are supreme; and are also entirely independent of one another; and any one of them cannot, with certain exceptions (to be hereinafter specified--e.g., Insolvency and Agriculture), infringe upon the jurisdiction of any other. 1 Re Goodhue, 19 Gr. 366 at pp. 382 et seq. (1872) The great function of Canadian Constitutional Law is twofold: --First; to aid in the inquiry into what Imperial enactments are in force in Canada, and Second; to aid in determining whether a statute passed by any legislative body in Canada is or is not within the power of that body to enact. Where a statute is within the legislative competence of the law-making body which enacts it, it is constitutional, or as is technically.
