Collègues à l’École Pratique des Hautes Études, Hubert étudiait la magie dans l’Antiquité grecque et romaine, tandis que Mauss en décrivait les formes en Australie, en Malaisie, en Inde, au Mexique ou dans le judaïsme ancien. Pourtant, si l’analyse de la magie résultait logiquement à leurs yeux de celle du sacrifice, ce lien s’est ensuite dissous dans les rééditions des textes de Marcel Mauss. Cette édition permet de réinterroger les liens entre les trois piliers de sa réflexion que sont le sacrifice, la magie et le don. L'approche d'Hubert et Mauss se ressent également du contexte politique très particulier de l'affaire Dreyfus, qui se déroule pendant la rédaction de leurs articles. Cette séquence historique révéle alors des phénomènes irrationnels au cœur de l’État républicain, et oblige les universitaires à utiliser la preuve scientifique pour les combattre. C’est dans cet espace entre l’individualisme et la raison d’État, alors au cœur des débats politiques, que prennent sens les analyses de la magie et du sacrifice entre l’officieux et l’officiel, entre l’individuel et le collectif.

La magie comprenant des agents, des actes et des représentations : nous appelons magicien l'individu qui accomplit des actes magiques, même quand il n'est pas un professionnel ; nous appelons représentations magiques les idées et les croyances qui correspondent aux actes magiques ; quand aux actes, par rapport auxquels nous définissons les autres éléments de la magie, nous les appelons rites magiques. Il importe dès maintenant de distinguer ces actes des pratiques sociales avec lesquelles ils pourraient être confondus. Les rites magiques et la magie tout entière sont, en premier lieu, des faits de tradition. Des actes qui ne se répètent pas ne sont pas magiques. Des actes à l'efficacité desquels tout un groupe ne croit pas, ne sont pas magiques. La forme des rites est éminemment transmissible et elle est sanctionnée par l'opinion. D'où il suit que des actes strictement individuels, comme les pratiques superstitieuses particulières des joueurs, ne peuvent être appelés magiques. Les pratiques traditionnelles avec lesquelles les actes magiques peuvent être confondus sont : les actes juridiques, les techniques, les rites religieux. On a rattaché à la magie le système de l'obligation juridique, pour la raison que, de part et d'autre, il y a des mots et des gestes qui obligent et qui lient, des formes solennelles. Mais si, souvent, les actes juridiques ont un caractère rituel, si le contrat, les serments, l'ordalie, sont par certains côtés sacramentaires, c'est qu'ils sont mélangés à des rites, sans être tels par eux-mêmes. Dans la mesure où ils ont une efficacité particulière, où ils font plus que d'établir des relations contractuelles entre des êtres, ils ne sont pas juridiques, mais magiques ou religieux. Les actes rituels, au contraire, sont, par essence, capables de produire autre chose que des conventions ; ils sont éminemment efficaces ; ils sont créateurs ; ils font. Les rites magiques sont même plus particulièrement conçus comme tels ; à tel point qu'ils ont souvent tiré leur nom de ce caractère effectif : dans l'Inde, le mot qui correspond le mieux au mot rite est celui de karman, acte ; l'envoûtement est même le factum, krlyâ par excellence ; le mot allemand de Zauber a le même sens étymologique ; d'autres langues encore emploient pour désigner la magie des mots dont la racine signifie faire...
