Book excerpt: In 1900, German legislators passed the Civil Code, a controversial law that designated women as second-class citizens with regard to marriage, parental rights, and marital property. Despite the upheavals in early twentieth-century Germany – the fall of the German Empire after the First World War, the tumultuous Weimar Republic, and the destructive Third Reich – the Civil Code remained the law of the land. After Nazi Germany’s defeat in 1945 and the founding of East and West Germany, legislators in both states finally replaced the old law with new versions that expanded women’s rights in marriage and the family. Entangled Emancipation reveals how the complex relationship between the divided Germanys in the early Cold War catalysed but sometimes blocked efforts to reshape legal understandings of gender and the family after decades of inequality. Using methods drawn from gender history and discourse analysis, the book restores the history of the women’s movements in East and West Germany. Entangled Emancipation ultimately explores the parallel processes through which East and West Germany reimagined, negotiated, and created new civil laws governing women’s rights after the Second World War.

The impacts of feminist political and legal theories, as well as critical legal studies, have been embedded in all the papers in different ways and degrees. Differences among feminist political and legal ideas are visible in the different approaches. The ongoing issue of defining gender, for example, is a recurring theme in the texts. Some papers question the binary basis of the gender issue and the notion of gender as such, while others start from the binary dichotomy and attempt to expand the consideration towards a multi-dimensional understanding of gender identities. The main focus is on a feminist reconsideration of all relevant fields of legal knowledge. The primary aim is to demystify the seemingly neutral character of legal norms and legal knowledge and highlight the power relations at different layers, beginning with male and female legal subjects of Western heredity (in terms of culture, ethnicity, and race), then moving on to different needs and power relations among female persons of different races and classes, and finally addressing differentiating gender relations and identities beyond the framework of the women-men binary codification, i.e., also taking into consideration the multiple options of intersex, transgender, queering, etc. Taking seriously the issue of the “maleness” of political and legal theories is indeed a challenging and relevant endeavor for legal scholars. The male bias is present not only throughout history but also in the present, given that our “universal” categories of political and legal thought are still overburdened by unequal power relations. It is also important to open our minds and knowledge production for a gender-sensitive and gender-competent intersectional approach, which would also include various queer-, race- and class-based considerations. These tasks should be of interest not only to critical legal scholars but also all those belonging to mainstream legal and political thought.

Moeller is the first historian of modern German women to use social policy as a lens to focus on society's conceptions of gender difference and "woman's place." He investigates the social, economic, and political status of women in West Germany after World War II to reveal how the West Germans, emerging from the rubble of the Third Reich, viewed a reconsideration of gender relations as an essential part of social reconstruction. The debate over "woman's place" in the fifties was part of West Germany's confrontation with the ideological legacy of National Socialism. At the same time, the presence of the Cold War influenced all debates about women and the family. In response to the "woman question," West Germans defined the boundaries not only between women and men, but also between East and West. Moeller's study shows that public policy is a crucial arena where women's needs, capacities, and possibilities are discussed, identified, defined, and reinforced. The sheer size of the available correspondence (approximately 6000 letters from and to Lorentz) preclude a full publication. The letters included in this volume have been selected according to various criteria, the most important of which is scientific importance. A second criterion has been the availability of letters both from and to Lorentz, so that the reader can follow the exchange between Lorentz and his correspondent. Within such correspondences a few unimportant items, dealing with routine administrative or organizational matters, have been omitted. An exception to the scientific criterion is the exchange of letters between Lorentz and Albert Einstein, Max Planck, Woldemar Voigt, and Wilhelm Wien during World War I: these letters have been included because they shed important light on the disruption of the scientific relations during the war and on the political views of these correspondents as well as of Lorentz. similar reasons the letters exchanged with Einstein and Planck on post-war political issues have been included.
