Book Synopsis Law in Northern Ireland by : Brice Dickson
Download or read book Law in Northern Ireland written by Brice Dickson and published by Bloomsbury Publishing. This book was released on 2023-06-30 with total page 531 pages. Available in PDF, EPUB and Kindle. Book excerpt: This textbook presents an engaging and thorough examination of the law in Northern Ireland. It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law. It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. This edition has been updated following recent legal developments in Northern Ireland including the 'New Decade, New Approach' agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of 'retained EU law' and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement. Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

Book Synopsis Equality and Public Policy by : Paul Chaney
Download or read book Equality and Public Policy written by Paul Chaney and published by University of Wales Press. This book was released on 2011-01-31 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: Equality of opportunity is a contested concept. It evokes strong emotions from proponents and opponents alike. Enduring issues of inequality and discrimination mean that it remains at the forefront of political priorities in the twenty-first century. Traditional analyses tend to focus on developments at the level of the unitary state or European Union. In contrast, this book underlines the salience of multi-level governance and offers the first detailed comparative analysis of contemporary efforts to promote equality of opportunity in the wake of constitutional reform in the UK. It presents a summary of social theory on equalities in relation to gender, and a full range of social groups and identities - such as disability, ethnicity, sexual orientation and age. It outlines the contemporary evidence base relating to patterns and processes of inequality in the 'devolved' nations. A 'governance perspective' is also advanced; one that details how constitutional law establishing the devolved legislatures contains equality clauses that enable and empower government to promote equality in public policy and law. Analysis reveals the development of distinctive regulatory structures and equalities policy lobbies in each territory. Overall, this volume charts the development of divergent legal rights and public policy on the promotion of equality in the wake of constitutional reform in the UK. Notwithstanding ongoing challenges, it is argued that the move to quasi-federalism is significant for it marks a shift from the predominant, centralised administration of social policy witnessed throughout the twentieth century, to divergent approaches designed to address contrasting socio-economic patterns and processes in Wales, Scotland and Northern Ireland.
Download or read book Equality written by Bob Hepple and published by Bloomsbury Publishing. This book was released on 2011-01-28 with total page 189 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Equality Act 2010 is a major landmark in the long struggle for equal rights. This book tells the story of how and why it came to be enacted, what it means, what changes it can bring about in British society, and - no less important - what the Act will not do. The Act is the outcome of over 13 years of research, public debate and campaigning, starting with the publication of Equality: A New Framework. Report of the Independent Review of the Enforcement of UK Anti-Discrimination Legislation by Bob Hepple, Mary Coussey and Tufyal Choudhury (Hart Publishing, 2000). The aim of this book is to examine the aims and structure of the new legal framework and to assess the Act against goals of reform set by the earlier review: harmonising and extending the law on status equality; widening the areas of unlawful conduct; changing organisational policy and behaviour including positive duties to advance equality; and improving enforcement of the law. The book will be essential reading for anyone who wants to understand the Act and the wider context of equality law, including students of law and social sciences, human rights activists and lawyers, as well as the general reader.
Book Synopsis Judicial Review in Northern Ireland by : Gordon Anthony
Download or read book Judicial Review in Northern Ireland written by Gordon Anthony and published by Bloomsbury Publishing. This book was released on 2024-02-22 with total page 405 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 3rd edition of this leading text provides a detailed account of the purposes of judicial review; the nature of the public-private divide in Northern Ireland law; the judicial review procedure; the grounds for review; and remedies. As with the previous editions, the focus is on case law that is unique to Northern Ireland, and the book identifies some important differences between principle and practice in Northern Ireland and England and Wales. These now include differences resulting from the Ireland-Northern Ireland Protocol (as amended by the Windsor Framework), and this edition explains how and when EU law continues to apply in Northern Ireland. It also considers the leading Human Rights Act decisions of the Northern Ireland courts and the House of Lords and UK Supreme Court. The new edition refers to case law from the courts in England and Wales and Scotland; the Court of Justice of the European Union; and the European Court of Human Rights. There is a particular focus on recent rulings of the High Court and Court of Appeal in Northern Ireland and of rulings of the Supreme Court in cases heard on appeal from Northern Ireland. It considers the main points of the Judicial Review Practice Direction 03-2018 and surveys the European Union (Withdrawal) Act 2018 and its implications for Northern Ireland (including the incorporation of the Ireland-Northern Ireland Protocol, as amended by the Windsor Framework). The book will be of use to practitioners in Northern Ireland and the rest of the UK, and also to those involved in the study of judicial reasoning in different jurisdictions (both within the UK and elsewhere).

Book Synopsis Religion or Belief, Discrimination and Equality by : Paul Weller
Download or read book Religion or Belief, Discrimination and Equality written by Paul Weller and published by A&C Black. This book was released on 2013-11-07 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, controversial issues related to religion or belief, discrimination, equality and human rights have come to the fore, especially in the context of public debates around multiculturalism following the 'social policy shock' created by the impact of violent religious extremism. For example should there be restrictions on what people can wear in the work place based on their religious identity? Should religious organizations be exempt from aspects of equalities legislation which are not in line with their beliefs and values? How should non-religious identities be recognized? In the context of increasing cultural and religion or belief diversity, it is vitally important for the future to understand the nature and extent of discrimination and unfair treatment on the grounds of religion or belief, and to assess the adequacy of policies, practices and laws designed to tackle this. This includes the overlap of religion or belief identities with other aspects of people's identity including characteristics such as age, disability, race, sex and sexual orientation which can also be legally protected. This volume is a benchmark publication on religion, discrimination and equality. It includes data and insights derived from the fieldwork, focus groups and questionnaire survey of a recent national research project in Britain. Its analysis presents a unique insight into continuity and change in people's reported experience over a decade of equalities legislation and political and social change of unfair treatment on the basis of religion or belief. Grounded in empirical and contextualized data, its findings are placed in the context of European and international human rights law. Its findings will be of special interest to both scholars and practitioners working in the specific fields of education, employment, the media, criminal justice and immigration, housing, health care, social services, and funding, as well as in the broader fields of religion or belief, the law and public policy.
