Applying traditional legal approaches to protection raises particular challenges during the transition from conflict to peace. In the jus post bellum context, protection of the environment and natural resources needs to be considered in tandem with a broad range of simultaneously applicable normative frameworks, such as human rights, transitional justice, arms control/disarmament, UN law and practice, development, and domestic law. While certain multilateral environment agreements, such as the Convention Concerning the Protection of the World Cultural and Natural Heritage protect the environment; international humanitarian law and international criminal law continue to treat environmental protection largely from an anthropocentric perspective. This book is the first targeted work in the legal literature that investigates environmental challenges in the aftermath of conflict. Addressing these challenges, it brings together academics, policy-makers, and practitioners from different disciplines to clarify policies and practices of environmental protection and key normative frameworks.0It draws on experiences and practices in post-conflict settings to specify substantive principles and techniques to remedy and prevent harm.

The Scientific and Environmental Affairs Divi sion of NATO has moved with the times and has defined environmental security as one of its priority areas for cooperation with Central and Eastern Europe and countries of the former Soviet Union. This book is the main output of an Advanced Research Workshop (ARW), held in Bolkesjl/l, Norway, 12-16 June 1996. I would like to acknowledge the personal support of L. Book excerpt: This book argues that a set of persuasive narratives about the links between natural resource, armed conflict and peacebuilding have strongly influenced the natural resource interventions pursued by international peacebuilders. The author shows how international peacebuilders active in Liberia and Sierra Leone pursued a collective strategy to transform "conflict resources" into "peace resources" vis-à-vis a policy agenda that promoted "securitization" and "marketization" of natural resources. However, the exclusive focus on securitization and marketization have been counterproductive for peacebuilding since these interventions render invisible issues connected to land ownership, environmental protection and sustainable livelihoods and mirror pre-war governing arrangements in which corruption, exclusion and exploitation took root. Natural resource governance and peacebuilding must go beyond narrow debates about securitization and marketization, and instead be a catalyst for trust-building and cooperation that has a local focus, and pursues an inclusive agenda that not only serves the cause of peace, but the cause of people. Book excerpt: Environmentalists and advocates of environmental cooperation in conflict frequently discuss certain environmental cooperation project proposals such as the establishment of the Peace Park in the demilitarized zone on the North-South Korean border, the Indo-Pakistani Peace Park on the Siachen Glacier, the joint system of trans-boundary environmental protection between Thailand and Cambodia, and the joint management of Palestinian and Israeli water resources. These proposals, however, are by no means isolated. The idea that the development of environmental cooperation in conflict areas can create a bridge between conflict communities and help conflict transformation and resolution is almost two decades old. Declarations of cooperation between conflict communities and bringing the potential for peaceful relationships into conflict areas through joint environmental projects appear in the agendas of several international governmental and non-governmental organizations. However, our knowledge of the “real” workings of environmental cooperation in conflict zones does not correspond with the popularity of these thoughts and actions. Although environmental cooperation has been initiated in many conflict areas, the differences in individual cases are so large that, so far, there is neither accurate data nor any idea of the workings of environmental cooperation as a tool for conflict transformation. This book addresses some of these issues and offers several new findings. Specifically, it examines the emergence of environmental cooperation and its function in political conflicts. It concludes that not all environmental cooperation is real cooperation and not all real cooperation is favorable. The scope, form, and content of cooperation are important to the peacebuilding potential of environmental cooperation, and there are multiple intervening factors such as motivation of actors, their value preferences, and duration of the support of external actors.
