Book excerpt: The United States (US) and the European Union (EU) are federal systems in which the responsibility for environmental policy-making is divided or shared between the central government and the (member) states. The attribution of decision-making power has important policy implications. This chapter compares the role of central and local authorities in the US and the EU in formulating environmental regulations in three areas: automotive emissions for health related (criteria) pollutants, packaging waste, and global climate change. Automotive emissions are relatively centralised in both political systems. In the cases of packaging waste and global climate change, regulatory policy-making is shared in the EU, but is primarily the responsibility of local governments in the US. Thus, in some important areas, regulatory policy-making is more centralised in the EU. The most important role local governments play in the regulatory process is to help diffuse stringent local standards through more centralised regulations, a dynamic which has become recently become more important in the EU than in the US.

Contrary to the proposition of an economic "trading up" of standards, the positive theory of environmental federalism which is developed allows for an examination of political mechanisms and the effects of regulation. Empirical results of the study of European and national decisions in EU vehicle emission legislation allow for the conclusion that the adoption of strict rules is viable, even in extreme sectoral cases where the industry concerned is economically and politically powerful. The distribution of costs across the industry and EU member states is the central mechanism which provokes strict and lax rules. In vehicle emission legislation, systematic differences between the regulation of CO2 and air pollutant emissions exist. Diesel particulate filters were introduced comparatively late as a result of a "Baptist-bootlegger" coalition of environmental associations and parts of the automotive industry.

Book excerpt: This article describes the evolution and key features of the centralized environmental regulatory systems that emerged in the United States and Europe during the latter half of the twentieth century. It applies insights from the positive economic analysis of regulatory centralization in an attempt to explain a striking paradox found in both the European and American centralized environmental regulatory regimes: the fact that in both systems, centralized environmental regulation has been adopted not as a solution for transboundary pollution (interjursidictional externalities), but rather for pollution that is primarily local. The paper develops a positive account that explains the tendency of centralized environmental regulation to focus so paradoxically on localized pollution as due to inherent pressures for regional protectionism and redistribution within a (federalized) political system. Normatively, we provide an up-to-date survey of the theoretical and empirical work on the race-to-the-bottom story, and then apply normative economics to develop insight into the relative normative desirability of environmental regulatory centralization in the U.S. versus Europe. We believe that the relatively less centralized European system may have economic justification. On the other hand, the enlargement and increased economic integration of Europe raise some interesting questions, both normative questions regarding the desirability of centralized European environmental regulation, and positive questions regarding the future of European environmental law.
