Book excerpt: In recent decades there has been an exponential increase in large hydroelectric plants in Brazil, especially in the Amazon region. These large hydraulic structures impact the environment and the lives of people living in the places where they settle and require a special type of water governance. The dictatorial regime (1964-1985) created a "standard" for the construction of these great structures, through an institutional and legal framework, which benefited the Brazilian business elite but also, through the creation of a popular imagination, which shows itself lasting progress on the country's progress and development. The suspension of security, the fragility of institutional environmental structures, the disrespect for indigenous reserves, the lack of clarity about the concept of "affected population" and the non-payment of fair compensation were identified as one of the main challenges for a democratic water governance in the country. In the late 1970s, the Dam-Affected Movement (MAB) began its organization and is also studied in this research. The study is an important and insightful academic contribution to the understanding of the main bottlenecks of effective water governance in Brazil.

Book excerpt: In response to climate change, and unsustainable energy consumption, the European Parliament launched a climate and energy package in 2009. This included the 20:20:20 Energy Strategy whose aim was to decrease the effects of climate change, in particular by lowering greenhouse gas (GHG) emissions by 2020. This 10-year action plan proposes measures to increase the current efficiency levels of energy use, and raises the share of renewable energies within the energy mix for all 27 EU Member States. As a result, the increased use of biofuels, particularly in the transport sector, will be an important part of a more complex framework. Although, biofuels represent only two per cent of total transport fuels used, political incentives, technology, and efficiency improvements could increase this by eight per cent in Europe by 2020. In line with the 20:20:20 Strategy, the Renewable Energy Directive (RED) was introduced to regulate the overall biofuel market, amongst others. Based on the RED's definition of sustainability, different certification schemes emerged, aimed at creating a uniform biofuel standard within Europe. At present, the overall scale and scope of environmental and social impacts associated with the biofuel supply chain are not well defined, and this will be evaluated within this work. Furthermore, close ties between the biofuel supply chain, and other sectors, including food and crude oil industries lead to associations with issues such as deforestation, pollution and food supply shortages. Thus, this book will analyse whether RED actually supports such a low-carbon pathway or it mainly supports the local industry.

All of these problems are related to social and economic pressure. The challenge for most ecological systems is not only to establish the baseline for current ecosystem conditions, but also to explore options for recovery and sustainability. The latter involves ecological restoration where ecosystem and environmental services are maintained and enhanced. These services are essential to social integration and economic development. This book not only introduces a theoretical and conceptual framework for the topic, but also analyses the uncertainty for sustainability because of dwindling natural resources. It includes contributions providing a basis for public policies, case studies integrating concepts and tools for solutions, and a set of position papers addressing new agenda topics that will shape the 21st century. The Paris Agreement has a binding commitment of holding the global temperature increase to 2°C while pursuing efforts to limit it to 1.5°C. To cope with the negative effects of climate changes and mitigate greenhouse gas emissions, one of the primary responses has been the deployment of renewable energy sources, transiting from fossil fuels to sustainable electricity production. However, renewable energy sources can also cause significant environmental impacts. Wind energy, for instance, can impact biodiversity, such as birds and bats, killing them when colliding with turbines and affecting their migration and nesting. This results in conflicts in environmental law. This book questions whether, in the energy transition, the generation of electricity from renewable sources to protect the climate is compatible with the protection of the environment, both interests in environmental law. To address this question, this book follows a legal-environmental perspective and assesses the common problem of solving those internal environmental conflicts in Brazilian and German law to understand and compare whether and how both legal systems solve the conflicts by compatibilizing the protection of the climate with other environmental interests. The legal analysis focuses on land-use planning and environmental licensing, assessing similarities and differences, and evaluating the results, identifying what one country can learn from the other.
