Available in PDF, EPUB and Kindle. Book excerpt: The Endangered Species Act of 1973 (ESA) is one of the most cherished and reviled laws ever passed. It mandates protection and preservation of all the nation’s species and biodiversity, whatever the cost. It has been a lightning rod for controversy and conflicts between industry/business and environmentalists. The year 2023 marks the 50th anniversary of this law, and provides an opportunity for a measured and thorough evaluation thereof. We cannot know today’s challenges and opportunities without understanding their histories. This book is the most comprehensive history of the ESA ever published, and the first to consider the entire history of the law from all angles in a single volume. The history of the ESA has been one of increasing impact, complexity, and controversy. In 1978, the Supreme Court declared that Congress intended for the U.S. government to save all species at any cost, and thereafter application of the ESA became steadily more controversial, as seen in the example of the northern spotted owl and the timber wars in the Pacific Northwest in the late 1980s and early 90s, and then everywhere as the ESA became a political football in the highly partisan environment of the late 1990s and amendments to the law ceased. This book is not only a history, but a call to action. It will take more conservation, more funding, and more innovative solutions if we are to save our wildlife and biodiversity. It will take the engagement to every American to muster the collective will to meet this challenge. The hope of this book is that we will be able to look back and say that we accomplished more in the second 50 years of the ESA than we did in the first.

Book excerpt: Next Generation INDIE Book Awards Grand Prize Winner, Best Non-Fiction Book in 2017; and Winner in the Science/Nature/Environment category Finalist for Foreword INDIES Book of the Year Awards in Ecology and Environment In this book, Lowell E. Baier, one of America’s preeminent experts on environmental litigation, chronicles the century-long story of Americas’ resources management, focusing on litigations, citizen suit provisions, and attorneys’ fees. He provides the first book-length comprehensive examination of the little-known Equal Access to Justice Act (EAJA) and its role in environmental litigation. Originally intended to support veterans, the disabled and small business, EAJA, Baier argues, now paralyzes America’s public land management agencies. Baier introduces readers to the history of EAJA, examines the many beneficiaries of the law, describes in depth 20 of the most prominent litigious environmental groups in America, and recommends carefully tailored amendments to the EAJA to correct environmental abuses of the law while protecting legitimate interests. Inside the Equal Access to Justice Act will be a valuable resource for the environmental legal community, environmentalists, practitioners at all levels of government, and all readers interested in environmental policy and the rise of the administrative state.

Available in PDF, EPUB and Kindle. Book excerpt: In this brilliant, gracefully written, and important new book, former Secretary of the Interior and Governor of Arizona Bruce Babbitt brings fresh thought--and fresh air--to questions of how we can build a future we want to live in. We've all experienced America's changing natural landscape as the integrity of our forests, seacoasts, and river valleys succumbs to strip malls, new roads, and subdivisions. Too often, we assume that when land is developed it is forever lost to the natural world--or hope that a patchwork of local conservation strategies can somehow hold up against further large-scale development. In Cities in the Wilderness, Bruce Babbitt makes the case for why we need a national vision of land use. We may have a space program, he points out, but here at home we don't have an open-space policy that can balance the needs for human settlement and community with those for preservation of the natural world upon which life depends. Yet such a balance, the author demonstrates, is as remarkably achievable as it is necessary. This is no call for developing a new federal bureaucracy; Babbitt shows instead how much can be--and has been--done by making thoughtful and beneficial use of laws and institutions already in place. A hallmark of the book is the author's ability to match imaginative vision with practical understanding. Babbitt draws on his extensive experience to take us behind the scenes negotiating the Florida Everglades restoration project, the largest ever authorized by Congress. In California, we discover how the Endangered Species Act, still one of the most effective laws governing land use, has been employed to restore regional habitat. In the Midwest, we see how new World Trade Organization regulations might be used to help restore Iowa's farmlands and rivers. As a key architect of many environmental success stories, Babbitt reveals how broad restoration projects have thrived through federal- state partnership and how their principles can be extended to other parts of the country. Whether writing of land use as reflected in the Gettysburg battlefield, the movie Chinatown, or in presidential political strategy, Babbitt gives us fresh insight. In this inspiring and informative book, Babbitt sets his lens to panoramic--and offers a vision of land use as grand as the country's natural heritage.

Book excerpt: Encyclopedia of the Anthropocene, Five Volume Set presents a currency-based, global synthesis cataloguing the impact of humanity’s global ecological footprint. Covering a multitude of aspects related to Climate Change, Biodiversity, Contaminants, Geological, Energy and Ethics, leading scientists provide foundational essays that enable researchers to define and scrutinize information, ideas, relationships, meanings and ideas within the Anthropocene concept. Questions widely debated among scientists, humanists, conservationists, politicians and others are included, providing discussion on when the Anthropocene began, what to call it, whether it should be considered an official geological epoch, whether it can be contained in time, and how it will affect future generations. Although the idea that humanity has driven the planet into a new geological epoch has been around since the dawn of the 20th century, the term ‘Anthropocene’ was only first used by ecologist Eugene Stoermer in the 1980s, and hence popularized in its current meaning by atmospheric chemist Paul Crutzen in 2000. Presents comprehensive and systematic coverage of topics related to the Anthropocene, with a focus on the Geosciences and Environmental science Includes point-counterpoint articles debating key aspects of the Anthropocene, giving users an even-handed navigation of this complex area Provides historic, seminal papers and essays from leading scientists and philosophers who demonstrate changes in the Anthropocene concept over time

In this volume, leading Endangered Species Act experts interpret and propose legislative and administrative changes to prepare the ESA for future challenges. They explore regulations on avoiding harm to and producing benefits for species, cooperation between state and federal agencies, scientific analyses, and the necessary politics to enact their ideas. This is a call to action to chart an enlightened future for the Endangered Species Act that embraces the nation’s moral commitment of 50 years ago to address species extinction constructively, mindful of biodiversity, and as a fixture among the nation’s values and needs. The interconnected web of life includes all living species that depend on each other for survival, us among them. The stakes—our very future—are too high to ignore.

Book excerpt: The Endangered Species Act (ESA) is a far-reaching law that has sparked intense controversies over the use of public lands, the rights of property owners, and economic versus environmental benefits. In this volume a distinguished committee focuses on the science underlying the ESA and offers recommendations for making the act more effective. The committee provides an overview of what scientists know about extinctionâ€"and what this understanding means to implementation of the ESA. Habitatâ€"its destruction, conservation, and fundamental importance to the ESAâ€"is explored in detail. The book analyzes: Concepts of speciesâ€"how the term "species" arose and how it has been interpreted for purposes of the ESA. Conflicts between species when individual species are identified for protection, including several case studies. Assessment of extinction risk and decisions under the ESAâ€"how these decisions can be made more effectively. The book concludes with a look beyond the Endangered Species Act and suggests additional means of biological conservation and ways to reduce conflicts. It will be useful to policymakers, regulators, scientists, natural-resource managers, industry and environmental organizations, and those interested in biological conservation.
