Ce principe est mal compris par les juristes chinois. Ils estiment que les agents de l'autorité publique bénéficient la liberté dans la recherche, la production et l'appréciation des preuves en droit français. Ainsi, pour créer les règles des preuves pénales, les pénalistes chinois s'engouent du système de la preuve du droit anglo-saxon et étudient rarement celui du droit romano-germanique qui est l'une des sources du droit chinois moderne. Depuis 2012, la règle d'exclusion des preuves illégales est officiellement introduite dans la Loi de procédure pénale de la Chine. Mais cette nouvelle règle était mal appliquée. Face à l'écart entre la loi et la pratique, les pénalistes chinois s'interrogent sur ses causes et la façon d'amélioration de cette nouvelle règle. L'une des causes consiste à la différence entre la structure de la procédure pénale chinoise et anglo-saxonne. Cela suscite un intérêt d'étude approfondie sur le système de la preuve pénale en droit français, car la procédure pénale chinoise, similaire à celle française, est colorée par la procédure inquisitoriale et adopte le modèle du système mixte. En droit français, l'encadrement de la liberté de la preuve est d'une part manifesté dans la phase de recherche des preuves, par la légalité et la loyauté de la preuve. Ces deux dernières permettent d'encadrer les procédés de recueil des preuves par la loi écrite et la jurisprudence. D'autre part, il est manifesté dans la phase d'appréciation de l'admissibilité des preuves, par les nullités de l'instruction et de l'enquête. Ces dernières permettent de sanctionner ou annulent les preuves recueillies illégalement. En droit chinois, l'encadrement de la liberté de la preuve est réalisé par la règle d'exclusion des preuves illégales dans les deux phases ci-dessus.Dans la première phase précitée, les deux pays sont à la recherche d'un point d'équilibre dans la procédure pénale et attachent de l'importance aux procédés de recueil des aveux. Voici les ressemblances. Par ailleurs, quatre éléments différents sont discernés : la solution, les niveaux impliqués, la qualité des lois et la qualité de la personne. Dans la seconde phase précédente, la naissance de régime de la sanction procédurale dans les deux pays suit la même voie : de la théorie à la pratique et à la législation. De plus, dans la pratique judiciaire chinoise et française, le droit de la demande d'ouverture de la sanction procédurale est réservé dans un premier temps aux agents de l'autorité publique et ouvert ensuite aux parties privées. Le droit chinois et français relatif à la sanction procédurale est à la fois flexible et rigide. Les différences entre les deux pays impliquent les objectifs des régimes de la sanction procédurale et les formalités de leur mise en œuvre - le délai d'exercice du droit de requête, les organes compétents, l'étendue de la sanction, le sort des actes ou des preuves illégales. Les causes de ces ressemblances et différences sont analysées du point de vue de l'histoire, de la culture, des traditions, de la politique et de la société. Pour améliorer la règle d'exclusion des preuves illégales de la Chine, les propositions sont formulées selon les expériences françaises. Certaines idées ayant la valeur universelle sont également explicitées à la fin de cette étude comparée.

Book excerpt: This is the first book to offer an extensive cosmopolitan, cross-cultural insight into the perennial controversy over the use of improperly obtained evidence in criminal trials. It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely.
