This is however a fairly recent development. Not long ago the provision of these services was reserved for few national public sector incumbents, who were often also entrusted with regulatory tasks. This development is interesting and notable in itself. However, equally or perhaps even more interesting, is the role played by competition law in the process. Most observers agree that competition law only played a limited role in this transformation due to the limited ability of competition law to address the special problems and complexity of the electricity and telecommunications sectors. These observations are based on perceived shortcomings in regulating these complex sectors of industry. As it will be demonstrated the observations are not only incorrect but also fail to do justice to the very active role played by competition law. Looking back on the process of liberalization that started more than 25 years ago, it is apparent that absent the 'sledgehammer' effect of its competition law tools, the EU Commission would have been significantly worse positioned in extending the internal market concept to the provision of electricity and telecommunication services. Arguably, the whole liberalization process would never have come about or would have taken a different direction. However, in this process competition law has been 'twisted' to a point of giving it a certain regulatory flavour. The purpose of this book is to develop the understanding of the liberalization process in its entirety including the role played by competition law. Moreover, some words of caution will be offered against expanding the application of competition law to these sectors further without careful consideration of the long term ramifications for the sectors and competition law."

On the plus side producers, political bodies, regulatory agencies, courts, consumers, and other players are fully adapted to the idea and practice of independent regulation. Furthermore there is a ready pool of talented professionals to analyze issues and develop solutions as new issues emerge. But these advantages can also be disadvantages during times of change. Complex, well developed systems are often slow to recognize new realities and are costly to change because regulatory policies create interest groups that benefit from the status quo. In some instances new technologies and policies cannot be introduced incrementally, but rather strand investment and challenge investor's willingness to provide funds. In this chapter we examine the development and evolution of utility regulation in the United States, focusing on energy and telecommunications. We begin with the development of these industries, taking as given the traditions, institutions, and legal frameworks created through the regulation of transportation and other industries, even though these laid critical foundations for utility regulation. We begin by describing the economic and political context for regulation. We then examine regulation for each sector. We conclude with a brief review of emerging issues.

The new model has as its core that utility services will be: -provided by a set of commercialised companies; -monopoly (eg network) elements are separated from potentially competitive elements; -competition is actively introduced into the potentially competitive elements; and -private capital is introduced where possible and appropriate, particularly into the competitive elements, typically with privatisation of some or all of the existing assets. Over the last 10-15 years, this new model has largely replaced the traditional model of utility services being supplied by a state-owned vertically and horizontally integrated monopoly, supervised by the national government and typically operating in a non-commercial or semi-commercialised way. This change has been induced across developed and now across developing countries for the following two main reasons: (i) a major reduction in the ability of national governments to finance utility investment from tax revenues ; an (ii) a much greater emphasis on the need to improve efficiency and reduce the costs of infrastructure services (connection as well as service) coupled with (at least in developed countries) the achievement of very widespread if not universal service . To support the newly commercialised and privatised utilities, there have been major developments in the theory and practice of regulation. New utility regulatory institutions have been discussed and introduced in many countries. In addition, it has been realised that the introduction of competition (and, in particular, the development of competition over networks) has demonstrated the need for new and more complex forms of regulation to support the utility reforms.
