Book Synopsis Transformative Constitutionalism in Latin America by : Armin von Bogdandy
Download or read book Transformative Constitutionalism in Latin America written by Armin von Bogdandy and published by Oxford University Press. This book was released on 2017-07-21 with total page 513 pages. Available in PDF, EPUB and Kindle. Book excerpt: This ground-breaking collection of essays outlines and explains the unique development of Latin American jurisprudence. It introduces the idea of the Ius Constitutionale Commune en América Latina (ICCAL), an original Latin American path of transformative constitutionalism, to an Anglophone audience for the first time. It charts the key developments that have transformed the region and assesses the success of the constitutional projects that followed a period of authoritarian regimes in Latin America. Coined by scholars who have been documenting, conceptualizing, and comparing the development of Latin American public law for more than a decade, the term ICCAL encompasses themes that cross national borders and legal fields, taking in constitutional law, administrative law, general public international law, regional integration law, human rights, and investment law. Not only does this volume map the legal landscape, it also suggests measures to improve society via due legal process and a rights-based, supranational and regionally rooted constitutionalism. The editors contend that with the strengthening of democracy, the rule of law, and human rights, common problems such as the exclusion of wide sectors of the population from having a say in government, as well as corruption, hyper-presidentialism, and the weak normativity of the law can be combatted more effectively in future.

Book Synopsis Nicaragua Before the International Court of Justice by : Edgardo Sobenes Obregon
Download or read book Nicaragua Before the International Court of Justice written by Edgardo Sobenes Obregon and published by Springer. This book was released on 2017-11-21 with total page 438 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses Nicaragua's role in the development of international law, through its participation in cases that have come before the International Court of Justice. Nicaragua has appeared before the ICJ in fourteen cases, either as an applicant, respondent or intervening State, thus setting an important example of committment to the peaceful judicial settlement of disputes. The “Nicaraguan” cases have enabled the ICJ to take positions on and clarify a whole range of important procedural, jurisdictional and substantive legal issues, which have inspired the jurisprudence of international and regional courts and tribunals and influenced the development of international law. The book focuses on reviewing Nicaragua's cases before the ICJ, using a thematic approach to identify their impact on international law. Each chapter includes a discussion of the relevant cases on a particular theme and their impact over time on general as well as specific branches of international law, notably through their use as precedent by other international and regional courts and tribunals.

Book Synopsis The Bush Leadership, the Power of Ideas, and the War on Terror by : Dirk Nabers
Download or read book The Bush Leadership, the Power of Ideas, and the War on Terror written by Dirk Nabers and published by Routledge. This book was released on 2016-04-01 with total page 220 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foreign policy success or failure is often attributed to the role of leadership. This volume explores the relationship between President George W. Bush's leadership, the administration's stated belief in the power of ideas (and the ideas of power) and its approach to the war on terror. Drawing on the international expertise of ten American foreign policy and security specialists, this incisive and timely book combines theoretical perspectives on political leadership with rigorous empirical analysis of selected aspects of the Bush administration's post 9/11 foreign policy. As a result, this book sheds considerable light not just on the limited impact of President Bush's war on terror strategy, but also, more importantly, on why key ideas underpinning the strategy, such as US global primacy and pre-emptive war, largely failed to gel in a globalizing world.
Download or read book Good-Bye Hegemony! written by Simon Reich and published by Princeton University Press. This book was released on 2014-03-23 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many policymakers, journalists, and scholars insist that U.S. hegemony is essential for warding off global chaos. Good-Bye Hegemony! argues that hegemony is a fiction propagated to support a large defense establishment, justify American claims to world leadership, and buttress the self-esteem of voters. It is also contrary to American interests and the global order. Simon Reich and Richard Ned Lebow argue that hegemony should instead find expression in agenda setting, economic custodianship, and the sponsorship of global initiatives. Today, these functions are diffused through the system, with European countries, China, and lesser powers making important contributions. In contrast, the United States has often been a source of political and economic instability. Rejecting the focus on power common to American realists and liberals, the authors offer a novel analysis of influence. In the process, they differentiate influence from power and power from material resources. Their analysis shows why the United States, the greatest power the world has ever seen, is increasingly incapable of translating its power into influence. Reich and Lebow use their analysis to formulate a more realistic place for America in world affairs.
