Tanto es así que la proliferación de convenios, decisiones marco y ahora también directivas forma parte del día a día de organizaciones internacionales y supranacionales tales como la UE. Esta proliferación de normas repercute en la práctica legislativa nacional y exige, por tanto, una reflexión sobre la legitimidad de las instituciones internacionales y supranacionales y de las decisiones que de ellas emanan. A ello se dedica principalmente este libro con tres partes bien diferenciadas. En una primera parte, se examinan los modelos de integración y sus respectivas ventajas e inconvenientes para después estudiar los costos políticos y jurídicos, así como la metodología de la armonización. Con la finalidad de aprender de las prácticas realizadas en otros países e identificar las diferencias y semejanzas con el entorno europeo, la exposición se complementa con un análisis de Derecho comparado de la situación acontecida en otros Estados de corte federal. La segunda parte examina, por un lado, las distintas bases jurídicas de los Tratados constitutivos de las que se sirve el legislador europeo en la implantación y desarrollo de sus políticas criminales y, por otro lado, analiza la noción del bien jurídico como herramienta útil para el legislador europeo, en aras a su racionalidad y a un mejor cumplimiento de los principios de proporcionalidad y de subsidiariedad. La tercera y última parte afronta el estudio de la reserva de ley tradicional, su fundamento y sus déficits. En definitiva, analiza los problemas de legitimación de una intervención penal más allá del Estado-nación a través de la UE y propone las bases teóricas de un nuevo modelo de legalidad penal que finalmente se aplica a UE.

Este tema, sin embargo, no ha sido atendido con el suficiente énfasis por la doctrina penal, que suele mantenerse todavía anclada en el plano nacional. Esta obra pretende hacer un detallado estudio de las principales líneas y características de la política criminal que viene desarrollándose en la Unión. Se trata de un análisis con carácter crítico, especialmente respecto a aquellas tendencias observadas a nivel europeo que pueden contribuir, posteriormente y a veces sin pretenderlo, a un mayor rigorismo e irracionalidad en la legislación penal en los diferentes Estados miembros. Además, se realiza un detenido estudio sobre la actitud cambiante del legislador español a la hora de proceder a la adaptación de nuestro Código penal a las disposiciones europeas, en particular en los últimos años. Este trabajo ha obtenido una Mención Especial en el XIV Premio Andaluz de Investigación sobre Integración Europea. Noelia Corral Maraver es Doctora en Derecho y profesora de Derecho penal en la Universidad de Málaga. Durante su carrera académica ha obtenidos diversas becas de investigación predoctorales y postdoctorales de prestigio (JAE-Intro, FPU, Juan de la Cierva-Formación). Ha realizado estancias en varios centros de investigación: Willem Pompe Institute for Criminal Law and Criminology, Utrecht (Países Bajos); Juristische Fakultät de la Ludwig-Maximilians Universität München (Alemania); Max-Planck-Institut für ausländisches und internationales Strafrecht, Freiburg im Br. (Alemania); Universidad EAFIT, Medellín (Colombia); Queen Mary University, Londres (Reino Unido). Cuenta con numerosas publicaciones en editoriales y revistas de impacto y participa con frecuencia en eventos de difusión científica de ámbito nacional e internacional. Desde 2014 ha participado en diversos proyectos de investigación de I+D+i. The book is organized into three parts. The first comprises a sample of ‘ways and models of legislation’, ranging from classic legislative ideals to contemporary forms of regulation. The essays in this part, variances of focus notwithstanding, revolve around the notions of legislative rationality, quality, effectiveness, and legitimacy, which may be regarded as the cornerstones of legisprudence. Interwoven with these notions is another core legisprudential concern: the justification of laws. Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.
