La presente monografía persigue aclarar los elementos definitorios del crimen contra la humanidad para evitar la ambigüedad en su aplicación, y para ello realiza un estudio de la figura criminal, remontándose a sus orígenes y acompañándola durante todo su periodo evolutivo –Tribunales Militares de Núremberg y Tokio, Ley de Control Aliado nº.10 y jurisprudencia de los tribunales post Núremberg, distintas tipificaciones en los proyectos de Códigos de crímenes contra la paz y seguridad de la humanidad de la Comisión de Derecho Internacional– hasta la concreción de sus características actuales en la jurisprudencia de los Tribunales Penales Internacionales ad-hoc de la Ex Yugoslavia y Ruanda y su consagración en el artículo 7 del Estatuto de Roma. Durante este viaje se analizan los elementos generales o contextuales del crimen, su aplicación jurisprudencial y su interpretación doctrinal. En la última parte de la obra se analiza la transmutación de la figura del crimen contra la humanidad al delito de lesa humanidad en el Código Penal español, y el estudio del mismo así como de los distintos tipos específicos en función del delito subyacente que se haya cometido. Alfredo Liñán es Doctor en Derecho y Profesor Asociado de Derecho Penal en la Universidad Complutense de Madrid y en la Universidad Pontificia Comillas. Se especializó en el campo del Derecho penal internacional con investigaciones desarrolladas en el Instituto Max Planck de Derecho penal internacional y extranjero de Friburgo (Alemania). Su tesis doctoral versó sobre el crimen contra la humanidad de persecución. Abogado especializado en el ámbito del Derecho penal internacional y del Derecho penal económico, cuenta con varias publicaciones sobre diversas materias. Imparte docencia sobre Derecho penal en el IE University. Colabora en la especialización de Derecho penal internacional con el Instituto de Altos Estudios Universitarios, el Instituto Universitario Gutiérrez Mellado (UNED) y con la Universidad de El Salvador.
