Las conductas consistentes en la manipulación y adulteración de los alimentos destinados al consumo humano, que se agrupan en lo que, quizás impropiamente, suele denominarse fraudes alimentarios, aparecen contempladas como delitos en los artículos 363 a 367 del vigente Código penal español, recibiendo en ocasiones la denominación de «delitos alimentarios». Estas figuras penales, junto con la responsabilidad penal por el producto defectuoso o peligroso, expresión con la que se hace referencia a la responsabilidad penal de los productores o distribuidores de bienes de uso o consumo defectuosos o peligrosos respecto de las posibles lesiones o puestas en peligro de bienes jurídicos esenciales de los usuarios o consumidores, fundamentalmente la vida y la integridad personal, vienen a ser exponentes del llamado Derecho penal de la sociedad del riesgo. En la obra, dirigida no sólo a los estudiosos del Derecho sino también, y muy particularmente, a todas aquellas empresas e instituciones relacionadas con el sector alimentario, el autor (Profesor Titular de Derecho Penal y ex Letrado del Tribunal Constitucional) analiza pormenorizadamente dicha normativa penal mediante una profunda exégesis de los tipos, junto con la amplia y diversa legislación administrativa de carácter estatal (y autonómica, en lo esencial) y comunitaria sobre la materia. En ella también encontrará el lector, además del actualizado aparato bibliográfico, una exhaustiva relación de las resoluciones de los Tribunales Constitucional y Supremo, y de las Audiencias Provinciales, citadas en el trabajo, y un detallado índice analítico.
