De tal modo que obedecer al derecho significaría en definitiva obedecer al poder: por de pronto a quien tiene el poder para crear el derecho. De estas cuestiones (también con el testimonio de sabios amigos) es de lo que se trata en este libro desde una perspectiva que en la actual filosofía jurídico-política puede calificarse como “realismo crítico”. Pero precisamente por reconocerse aquella identidad se hace necesario, del todo imprescindible, advertir en ella que hay poderes y poderes y, por tanto, derechos y derechos. Unos –siempre vistos en gradualidad- que son más democráticos, más legítimos y más justos, con poderes sociales y sistemas de legalidad que se fundamentan en la autonomía moral individual (en el derecho de todos a decidir) y hacen más efectiva la protección de la libertad y la igualdad. Otros, del todo ilegítimos, donde se imponen sin control alguno la arbitrariedad y el abuso del poder, así como la negación más absoluta de los derechos humanos. Los primeros siguen aportando, también hoy, las bases más sólidas y las mejores vías para una sociedad democrática avanzada que, a pesar de todas las dificultades y corrupciones, pretende hacer realidad el Estado social y democrático de derecho. Elías Díaz es catedrático emérito de la Universidad Autónoma de Madrid. Doctor Honoris Causa por la Universidad Carlos III (Madrid), Granada, Milán y Alicante. Su último libro, publicado en 2009, ha sido De la Institución a la Constitución. Política y cultura en la España del siglo XX. El primero de una posterior y amplia lista de títulos lo fue (en 1966) Estado de Derecho y sociedad democrática. De buena parte de ellos, situados en coherente línea argumental, se hace ahora frecuente referencia en las páginas del presente libro.
