Plus particulièrement, le principe de l'égalité de rémunération entre salariés, quel que soit leur sexe, est clairement posé par notre législation. Cependant, en dépit de l'existence d'un cadre juridique spécifique, de nombreuses discriminations salariales subsistent en pratique, qu'elles soient directes ou indirectes : le salaire annuel net moyen des hommes est encore supérieur de plus de 25 % à celui des femmes, sans que cet écart puisse être entièrement mis sur le compte de facteurs objectifs et justifiables. Ce guide a été élaboré à la demande du Conseil supérieur de l'égalité professionnelle par le ministère de l'Emploi et de la Solidarité, en étroite collaboration avec les partenaires sociaux, des universitaires et chercheurs spécialistes de ces questions. Il a pour vocation de faciliter le travail des négociateurs, tant au niveau de la branche que de l'entreprise, en leur proposant un certain nombre de repères : sur la situation actuelle des écarts de salaires entre les femmes et les hommes, et sur l'ensemble des questions en lien direct avec cette situation ; sur le cadre juridique précisant les sources et les principes de l'égalité de rémunération ; sur les processus pouvant être initiés au service de l'égalité de rémunération dans les négociations collectives ; et, enfin, sur les aides créées par l'Etat pour faciliter la prise en charge de cette question. Ce guide se veut être un outil opérationnel (références de textes juridiques, exemples, fiches pratiques...) afin de disposer de repères pour préparer l'ensemble des négociations et assurer le suivi de celles-ci, tant sur le thème spécifique de l'égalité de rémunération que sur l'ensemble des thèmes de la négociation ayant des incidences directes ou indirectes sur ce sujet. Il appartient aux négociateurs de s'appuyer sur les données de ce guide pour prendre l'initiative de nouvelles pratiques en matière de négociation, intégrant à part entière le réflexe de l'égalité de rémunération entre les femmes et les hommes.
