Book excerpt: This book shall be an introduction into the European Free Trade Association (EFTA) as an international organization and, inter alia, as a platform for its member states' relations with the EU and for jointly negotiated Free Trade Agreements. EFTA - originally set up by the UK - is an example of how countries that do not want to be members of the EU can still have close links with it. EFTA is a loose intragovernmental association of some economically highly specialised, small and wealthy Western European small states which have, until now, decided not to join the European Union (EU). Essentially it is the platform for Iceland, Liechtenstein, Norway and Switzerland to coordinate their free trade policies as far as possible. Iceland, Liechtenstein and Norway also use EFTA, in particular its Secretariat, to manage their membership of the European Economic Area (EEA) and to adopt relevant legislation into the Agreement. Particularly in the context of Brexit it should also be noted that there are elements of the relations between the four EFTA States and the EU which are not necessarily based on either the EEA Agreement or the EU-Swiss Agreements. Until recently, EFTA was considered an outdated model. However, since Brexit interest in EFTA has increased. Where the subject was covered in the press, but also in relevant statements by politicians, there was hardly any distinction made between 'EFTA' and the 'EEA'. This book is not about Brexit, rather it will correct certain misconceptions about EFTA and provide a clear overview on what EFTA is: a platform for the economic relations between its member states; a platform for its member states' free trade policy and a platform for its member states' relations with the EU. There will be food for thought on the UK's future outside the EU.

Book excerpt: The EEA Agreement extends the four freedoms (persons, goods, services and capital) to Iceland, Liechtenstein and Norway. It provides for equal conditions of competition and abolishes discrimination on grounds of nationality. The EFTA Court, celebrating its 30th anniversary in 2024, has jurisdiction over parties to the Agreement. This jurisdiction corresponds to that of the Court of Justice of the European Union over EU Member States in matters of EEA law. This collection of essays, written by members of the Court and external experts, reviews the successes and shortcomings of the Court, its interface with EU law, and its future development.

Book excerpt: On the occasion of its tenth anniversary, the EFTA Court held a conference at which speakers were asked to reflect on the case law of the Court and its role in the European Economic Area (EEA). In the course of its work, the Court has acted as a driving force of integration under the EEA Agreement, by establishing general principles such as state liability and giving landmark judgments in several areas of European law. The essays in this volume, by leading experts and high-ranking representatives of national and European courts, cover areas such as the relationship between the principle of free movement and national or collective preferences on the EU/EEA and WTO levels, the relationship between the European courts and the Member States in European integration, homogeneity as a general principle of European integration, and the importance of judicial dialogue. In this regard, the sentence from President Skouris of the Court of Justice of the European Communities, who called the dialogue between the EFTA Court and the EC Court 'a shining example of judicial cooperation', could also serve as a motto for the present book.

Book excerpt: The Routledge Handbook of Differentiation in the European Union offers an essential collection of groundbreaking chapters reflecting on the causes and consequences of this complex phenomenon. With contributions from key experts in this subfield of European Studies, it will become a key volume used for those interested in learning the nuts and bolts of differentiation as a mechanism of (dis)integration in the European Union, especially in the light of Brexit. Organised around five key themes, it offers an authoritative "encyclopaedia" of differentiation and addresses questions such as: How can one define differentiation in the European Union in the light of the most recent events? Does differentiation create more challenges or opportunities for the European Union? Is Europe moving away from an "ever closer Union" and heading towards an "ever more differentiated Union", especially as leading political figures across Europe favour the use of differentiation to reconcile divergences between member states? This handbook is essential reading and an authoritative reference for scholars, students, researchers and practitioners involved in, and actively concerned about, research in the study of European integration. As European differentiation is multifaceted and involves a wide range of actors and policies, it will be of further interest to those working on countries and/or in policy areas where differentiation is an increasingly relevant feature. Available in PDF, EPUB and Kindle. Book excerpt: The EEA Agreement extends the free movement of persons, goods, services and capital to the EEA/EFTA States: Iceland, Liechtenstein and Norway. It provides for equal conditions of competition and abolishes discrimination on grounds of nationality in all 31 EEA States. The successful operation of the EEA depends upon a two-pillar system of supervision involving the European Commission and the EFTA Surveillance Authority. A two-pillar structure has also been established in respect of judicial control with the EFTA Court operating in parallel to the Court of Justice of the European Union. The EFTA Court, which celebrates its 20th anniversary in 2014, has jurisdiction with regard to EFTA States which are parties to the EEA Agreement. The jurisdiction of the EFTA Court accordingly corresponds to the jurisdiction of the Court of Justice of the European Union over EU Member States in matters of EEA law. The essays in this collection, assembled to celebrate the 20 year landmark, and written by members of the Court and external experts, review the successes and shortcomings of the Court, its interface with EU law, and the prospects for its future development.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines Europeanization in the European Economic Area (EEA), exploring whether non-member states can have an input into EU decision-making and whether the EU can successfully export its policies within the framework of the EEA. Iceland, Norway and Liechtenstein, while not EU member states, are members of the European Free Trade Association (EFTA) and signatories of the EEA Agreement. The Agreement allows participation in the EU’s internal market but also requires extensive and continuous adaptation to EU rules. Whilst existing literature is limited mainly to the EU’s impact on its own member states or neighbours to the east, this book extends the study of Europeanization to the EEA, exploring whether Iceland, as a non-member state, can have an input into EU decision-making and, conversely, whether the EU can ensure that its policies are adhered to outside of its borders. The author argues that, although the EEA Agreement is not without its challenges, it has proved considerably more resilient than originally expected. This raises the question of whether the EEA provides a realistic alternative to EU membership for other states with close ties to the EU. Delving into the largely unknown intersection between the EU and the EEA and providing important new insights into the Europeanization process, Europeanization and the European Economic Area will be of strong interest to students and scholars of European Union politics and policy-making, European Union Enlargement, Nordic politics and comparative politics.

This book was released on 2023-04-25 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union (EU) and the World Trade Organization (WTO) are becoming ever more important players on the international legal scene, as well as points of reference for the development and functioning of similar institutions elsewhere. Both institutions initially had a relatively small trade-focused mandate, which has been significantly expanded over the past decades so that there are few legal issues today that are not, in some way, affected by EU or, perhaps to a lesser extent, WTO law. Today, the EU and the WTO interact on a global scale as rule-makers and – enforcers, with repercussions for the entire world’s population. Nevertheless, they are currently experiencing a backlash. Both institutions are likely to undergo major reform in the next years: the book scrutinizes current proposals and makes an educated attempt at predicting upcoming changes in the EU and the WTO format. For this reason, the book takes a macro-approach looking at the EU and the WTO in a broader context as well as a micro-approach analysing specific high-profile issues, including: the EU, the WTO and Brexit; environmental sustainability in EU competition law and free trade agreements; the EU’s proposed Carbon Border Adjustment Mechanism (CBAM); WTO safeguards and rules of origin in services; reform of WTO dispute settlement procedures and the Appellate Body; the WTO, the EU Green Deal and renewable energy investment; EU external relations with Mercosur, the EEA and Switzerland; EU human rights law and the freedom of artistic expression; and international trade law’s contribution to combatting pandemics. Contributors to the book are experts active in legal academia, international legal practice, or both, who wish to honour Marco Bronckers, upon his retirement from the Chair of WTO and EU Law at the University of Leiden. A variety of audiences stands to benefit from the book’s discussion and proposed solutions: legal practitioners, scholars and students of international and European law; as well as related disciplines, such as political science and economic theory.
