Book excerpt: AU DELA DE L'EFFET NORMATIF QUE LES DROITS FRANCAIS ET ALLEMAND RECONNAISSENT A LEURS ACTES COLLECTIFS, LES DIFFERENCES SONT MANIFESTES : REPRESENTANT ELU OU SYNDICAL, EFFET ERGA OMNES OU NON, NATURE DES MATIERES COUVERTES PAR L'ACTE. EN FAISANT COEXISTER DEUX NIVEAUX DE NEGOCIATION, AUXQUELS CORRESPOND A CHAQUE FOIS UN MECANISME SINGULIER DE REPRESENTATION, LE DROIT ALLEMAND NOUS AMENE A REVOIR LES TERMES DANS LESQUELS ON ENVISAGE LA REPRESENTATION DES SALARIES DANS LA NEGOCIATION COLLECTIVE : PLUS LA RELATION PARTIE PATRONALE/REPRESENTANT EST CONCUE SUR UN MODE EGALITAIRE DANS LA NEGOCIATION, PLUS LA LEGITIMITE DE CE DERNIER EST FORTE PAR RAPPORT AU SALARIE, ET PLUS LA NORME OCCUPE UNE POSITION ELEVEE PAR RAPPORT A LA LOI ETATIQUE. SOUS L'ANGLE DE CE LIEN LOGIQUE, LE DROIT FRANCAIS OCCUPE UNE PLACE INTERMEDIAIRE, ENTRE LE CONTRAT TARIFAIRE ET LA CONVENTION D'ETABLISSEMENT DU DROIT ALLEMAND. IL Y A DONC DIFFERENTES FACONS DE JUSTIFIER QU'UN SALARIE PUISSE ETRE LIE PAR UN ACTE AUQUEL IL N'A PAS CONSENTI, ALORS QUE SA VOLONTE, BIEN QUE SUSPECTE, EXISTE. L'HISTOIRE ET LE ROLE DE L'ETAT PAR RAPPORT A LA QUESTION SOCIALE PEMETTENT D' EXPLIQUER CES DIFFERENCES. COMME LE SYSTEME JURIDIQUE, “ LA NEGOCIATION COLLECTIVE ” EST AMENEE A EVOLUER AU CONTACT DE L'ENVIRONNEMENT ECONOMIQUE ET DU DISCOURS SUR L'INDIVIDU. ET, CE N'EST QUE SI L'ON VEILLE AU MAINTIEN DE CES DIFFERENCES SOUS L'ANGLE DU LIEN LOGIQUE QUE LE DROIT DU TRAVAIL CONSERVERA SA RATIONALITE. AINSI, L'EFFET NORMATIF PEUT CEDER PAR RAPPORT AU CONTRAT INDIVIDUEL, MAIS CET INFLECHISSEMENT NE S'IMPOSERA PAS DE FACON UNIFORMEPOUR LE CONTRAT TARIFAIRE, LA CONVENTION COLLECTIVE FRANCAISE OU LA CONVENTION D'ETABLISSEMENT. AUTANT LA LIAISON DIRECTE DU CONTRAT TARIFAIRE AUX DROITS FONDAMENTAUX PERMET DE PRESERVER L'INDIVIDU DES EXCES DU COLLECTIF, AUTANT L'INFLECHISSEMENT DE L'EFFET NORMATIF EST INCONTOURNABLE POUR LA CONVENTION COLLECTIVE FRANCAISE : ELLE NE POURRA JAMAIS IMPOSER DES CHOIX EN TERME D'EMPLOI AU SALARIE, MEME AU NOM DE LA MAJORITE.

Book excerpt: Bourdieu and Literature is a wide-ranging, rigorous and accessible introduction to the relationship between Pierre Bourdieu's work and literary studies. It provides a comprehensive overview and critical assessment of his contributions to literary theory and his thinking about authors and literary works. One of the foremost French intellectuals of the post-war era, Bourdieu has become a standard point of reference in the fields of anthropology, linguistics, art history, cultural studies, politics, and sociology, but his longstanding interest in literature has often been overlooked. This study explores the impact of literature on Bourdieu's intellectual itinerary, and how his literary understanding intersected with his sociological theory and thinking about cultural policy. This is the first full-length study of Bourdieu's work on literature in English, and it provides an invaluable resource for students and scholars of literary studies, cultural theory and sociology.

Book excerpt: The novel coronavirus SARS-CoV-2, which causes the disease known as COVID-19, has infected people in 212 countries so far and on every continent except Antarctica. Vast changes to our home lives, social interactions, government functioning and relations between countries have swept the world in a few months and are difficult to hold in one’s mind at one time. That is why a collaborative effort such as this edited, multidisciplinary collection is needed. This book confronts the vulnerabilities and interconnectedness made visible by the pandemic and its consequences, along with the legal, ethical and policy responses. These include vulnerabilities for people who have been harmed or will be harmed by the virus directly and those harmed by measures taken to slow its relentless march; vulnerabilities exposed in our institutions, governance and legal structures; and vulnerabilities in other countries and at the global level where persistent injustices harm us all. Hopefully, COVID-19 will forces us to deeply reflect on how we govern and our policy priorities; to focus preparedness, precaution, and recovery to include all, not just some. Published in English with some chapters in French.

Book excerpt: In medicine the understanding and interpretation of the complex reality of illness currently refers either to an organismic approach that focuses on the physical or to a 'holistic' approach that takes into account the patient's human sociocultural involvement. Yet as the papers of this collection show, the suffering human person refers ultimately to his/her existential sphere. Hence, praxis is supplemented by still other perspectives for valuation and interpretation: ethical, spiritual, and religious. Can medicine ignore these considerations or push them to the side as being subjective and arbitrary? Phenomenology/philosophy-of-life recognizes all of the above approaches to be essential facets of the Human Condition (Tymieniecka). This approach holds that all the facets of the Human Condition have equal objectivity and legitimacy. It completes the accepted medical outlook and points the way toward a new `medical humanism'.

Book excerpt: Swiss citizens approve of their government and the way democracy is practiced; they trust the authorities and are satisfied with the range of services Swiss governments provide. This is quite unusual when compared to other countries. This open access book provides insight into the organization and the functioning of the Swiss state. It claims that, beyond politics, institutions and public administration, there are other factors which make a country successful. The authors argue that Switzerland is an interesting case, from a theoretical, scientific and a more practice-oriented perspective. While confronted with the same challenges as other countries, Switzerland offers different solutions, some of which work astonishingly well.

Available in PDF, EPUB and Kindle. Book excerpt: What happens when people communicate or dialogue with each other? This is the daunting question that this book proposes to address by starting from a controversial hypothesis: What if human interactants were not the only ones to be considered, paraphrasing Austin (1962), as “doing things with words”? That is, what if other “things” could also be granted the status of agents in a dialogical situation? Action and Agency in Dialogue: Passion, incarnation, and ventriloquism proposes to explore this unique hypothesis by mobilizing metaphorically the notion of ventriloquism. According to this ventriloqual perspective, interactions are never purely local, but dislocal, that is, they constantly mobilize figures (collectives, principles, values, emotions, etc.) that incarnate themselves in people’s discussions. This highly original book, which develops the analytical, practical and ethical dimensions of such a theoretical positioning, may be of interest to communication scholars, linguists, sociologists, conversation analysts, management and organizational scholars, as well as philosophers interested in language, action and ethics.

Available in PDF, EPUB and Kindle. Book excerpt: LAW, SOCIETY, AND INDUSTRIAL JUSTICE is a foundational study of workplace justice, still engaging and referenced a half-century after its original publication. The 50th Anniversary Edition adds an extensive, substantive Foreword by Berkeley’s Lauren Edelman. She writes that the book “remains important for how it conceptualizes law, for how it conceptualizes organizations, and for the theory Selznick offers regarding the moral evolution of organizations as they become ‘institutions,’ or living entities infused with values.” It is “a profound book for many reasons,” as she critically examines. Norms and values still matter in organizational governance — even in what amounts to “private government” — as this classic work reminds us. “Selznick’s classic text invites the reader to understand the interplay of formal and informal structures that produce new organizational norms, which, at their best, would replace workplace arbitrariness with due process protections like those embodied in the Rule of Law. It is not just an extraordinary contribution to the fields of sociology and jurisprudence, it is the theoretically foundational precursor to entire subfields in sociology and law.” — Laura Beth Nielsen, Chair, Department of Sociology, Northwestern University; Research Professor, ABF “Philip Selznick laid the foundation for one of law and society’s most vibrant areas of inquiry: law and organizations. Although this book has often been underappreciated, its 50th anniversary is a good opportunity to reassess its significance. Indeed, the current #MeToo movement lends more urgency to Selznick’s highly relevant ideas about conceptualizing organizations as legal orders, the importance of changing norms and values, the role of law within organizations, and organizations’ influence on the law.” — Ashley T. Rubin, Sociology, University of Hawai‘i at Manoa “Selznick’s study is undoubtedly the most erudite and imaginative example of the natural-law approach to appear. ... It is a very fine, even extraordinary piece of legal scholarship. It displays much craftsmanship, depth of learning, and creativity. It is elegant in style and graceful in presentation. Every legal sociologist should read it.” — Donald J. Black, American Journal of Sociology “A contribution, brilliant and substantial, to the literature on private government.” — Winston M. Fisk, American Political Science Review “Very enlightening and reminiscent of a good lecturer able to pull all the strings together chapter by chapter. ... The volume can be recommended to all students of law, industrial organization, and industrial relations.” — Industrial and Labor Relations Review

Book excerpt: In 2009, the International Labour Organization (ILO) celebrated its ninetieth anniversary. The First World War and the revolutionary wave it provoked in Russia and elsewhere were powerful inspirations for the founding of the ILO. There was a growing understanding that social justice, in particular by improving labour conditions, was an essential precondition for universal peace. Since then, the ILO has seen successes and set-backs; it has been ridiculed and praised. Much has been written about the ILO; there are semi-official histories and some critical studies on the organization's history have recently been published. Yet, further source-based critical and comprehensive analyses of the organization's origins and development are still lacking. The present collection of eighteen essays is an attempt to change this unsatisfactory situation by complementing those histories that already exist, exploring new topics, and offering new perspectives. It is guided by the observation that the ILO's history is not primarily about «elaborating beautiful texts and collecting impressive instruments for ratification» but about effecting «real change and more happiness in peoples' lives».

This book was released on 2013-10-23 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: The International Labour Organization was created in 1919, as part of the Treaty of Versailles that ended the First World War, to reflect the belief that universal and lasting peace can be accomplished only if it is based on social justice. As the oldest organisation in the UN system, approaching its 100th anniversary in 2019, the ILO faces unprecedented strains and challenges. Since before the financial crisis, the global economy has tested the limits of a regulatory regime which was conceived in 1919. The organisation's founders only entrusted it with balancing social progress with the constraints of an interconnected open economy, but gambled almost entirely on tools of persuasion to ensure that this would happen. Whether that gamble is still capable of paying-off is the subject of this book, by a former ILO insider with an unrivalled knowledge of its work. The book forms part of a broader inquiry into the relevance of founding institutional principles to today's context, and strives to show that the bet made on persuasion may yet pay off. In part, the text argues that there may be little alternative anyway, showing that the pathways to more binding solutions are fraught with difficulty. It also shows the ILO's considerable future potential for promoting effective, universal regulations by extending its tools of persuasion in as yet insufficiently explored directions. Starting with an examination of how the organisation's institutional context differs from 93 years ago, the author goes on to evaluate the prospects of numerous proposals put forward today, including the trade/labour linkage, but going beyond this. As a case study in how strategic choices can be made under legal, social and institutional constraints, the book should be valuable not only to those with an interest in the ILO, but to anyone who studies international organisation, labour law, law and society or political economy.
